2017 Maine: Lawmakers Approve Emergency Measure Delaying Retail Marijuana Sales

Summary: House and Senate lawmakers have approved emergency legislation, LD 88, amending various provisions in Question 1: the Marijuana Legalization Act.

The bill was signed into law on January 27.

Passage of this measure delays the implementation of regulations overseeing the commercial production and retail sale of marijuana until at least February 1, 2018. It also prohibits the possession of “edible retail marijuana products” until this date.

Separate provisions of the measure clarify marijuana possession laws to permit adults to possess up to 5 grams of marijuana concentrates. Provisions in Question 1 allowing adults to privately possess up to 2.5 ounces of herbal cannabis and to cultivate up to six marijuana plants went into effect on January 30, 2017.

Those between the ages of 18 and 20 face a civil violation for possessing marijuana.
