Simple Marijuana Bust Leads To Government Banning Free Speech

Hello Bob,
I’m sorry to read of this near conclusion of your run-in with cannabis prohibition laws in SD. Like you, I’d hope to see a suspended sentence, or a lower sentence all together.
With 98% of all criminal cases being plea bargained, I’m sure this Hobson’s Choice was a difficult one to make.
Being banned from public advocacy regarding something you–and clearly tens of millions of other Americans agree should be discussed publicly–maybe the cruelest cut of all. One that I suspect is ironically going to draw more attention/media awareness to your ‘run-of-the-mill’ cannabis bust than any cannabis possession case in your state’s history (if it has not already).
You may have to remain mum about marijuana advocacy (for a year), but groups like NORML never will, and where your voice has been temporarily silenced by a system (i.e., the mechanisms of cannabis prohibition) no longer worthy of public respect in America (and South Dakota), know full well that hundreds of thousands of your like-minded friends and fellow cannabis consumers will be LOUDLY protesting the continuation of cannabis prohibition from the halls of Congress, to Statehouses across the country, to the streets and parks in protest of both a failed public policy—and against any government or court mandates that seek criminal sanctions against citizens who disagree with prohibition laws, and will not allow them to share their views with the general public.
When a simple cannabis arrest turns into government restrictions on protected First Amendment speech and right of assembly, cannabis consumers and concerned citizens need to re-double their efforts to end our country’s expensive and destructive cannabis prohibition laws.

Hello everyone;
This will be the last email I send under the banner ‘South Dakotans for Safe Access‘ at least for a year.
By now, most of you know I plead to a felony count of possession of marijuana in May. Today I was sentenced.
In an hour-long sentencing hearing, Judge Delaney waxed reminiscent as he described his admiration for Muhammad Ali’s stance against an illegal war, which cost him millions of dollars and his peak performing years, during which time he did not complain, nor did he leave the country that so abused him for his beliefs.
Then, citing the fact that he (Judge Delaney) had to account for his actions to the hundreds of kids he sees in juvenile court, he sentenced me to a year in the Penn. Co. jail, with all suspended but 45 days. During the suspended part of the sentence I will wear a bracelet that senses alcohol use and I will be subject to arbitrary piss tests by a probation officer to detect illegal “drug” use. In addition I may have no “public role” in cannabis law reform advocacy during that year.
Work release is an option, but I have few marketable skills, especially in a time when everyone else is getting laid off. I’ll follow any leads any of you might have.
It was somewhat harsher than I expected, and probably less than I deserved. At least it did not cost me a career worth millions, and my peak performing years won’t begin until July 6, 2010. And that’s about all I feel comfortable saying about it. For a year.
I’ll turn 61 in prison, doin’ six weeks for smokin’ a joint. Mama cried.
I will do my time beginning sometime in August. If I have a job of the conventional sort (you know, with a time to get there and a time to leave) I can get work release. So, if you have any ideas for me along those lines?…
Thanks again to all who sent letters to the judge, and to those who have sent messages of support to me.
For 40 years I have watched as dozens of people I know–and thousands I know of–go through this same, ummm?, procedure. Now it’s happening to me, and I feel the same frustration over the purposelessness of it all as I have felt for all those other people, many, many, many of whom were treated far more viciously than I.
Someday this war will be over.

  1. I’ve had online contacts with Bob Newland over the course of several years, and both he and his plight are real. He led a walk around the entire State of South Dakota a few years ago to publicize legalization and medpot. He has led ASA in South Dakota for the past few years.
    He needs our help. He needs a job first, to get him out of jail early. He (and we ALL) need to help him appeal that part of his sentence which prohibits him from speaking freely. Our legal system has disgraced itself AGAIN by purporting to take away his constitutional rights which the courts are supposed to have sworn to protect. I am rather surprised that NORML hasn’t already decided to take this on, along with the ACLU. I thought Federal law punished people who violated our citizens’ constitutional rights. It should. I think Bob Newland is a hero, and I think we all ought to stand alongside him in his fight, which is our fight, for freedom of speech and thought.

  3. This is unconstitutional! You must appeal this sentence to a higher court for scrutiny. This judge has acted beyond the scope of his authority and impinged the US Constitution and the SD Constitution

    What would happen if all of us constant bloggers here on this website posted our best and lengthiest blogs on What if we attacked their system with massive amounts of pure, from the heart posts on this subject? Enough to let congress know that they cant ignore this for ANOTHER session… maybe they need to be really reminded of the fragility of the office the hold, and how one pissed off individual with a vendetta can take that ALL away from them. Can someone find out if we can attack that site? C’mon russ- I know you moderate these comments…could you find out an answer for me?
    Then all of us bloggers on here need to ambush that website. Non-general Jake, R.O.E., Jeremy R., Manfor Mantis, myself- lets take them out. They want articulation and passion? I think there’s plenty of it here…

    They have told BOB he can have freedom of speech!?! Well our leaders are trying to pass a bill criminalizing hate speech(freedom of speech)!! Well I dont agree with someone bullying someone online til they commint suicide but this bill leaves interpurtitaion wide open to as what hate speech really is!! From The way it looks to me,they(our leaders) could ,if this bill is passed, use what we say here in these posts!!! OR ANY OTHER POSTS THAT OPENLY STATE THIER DISSENT FOR THE GOVERBNMENTS ACTIONS!!     If you do not mind I would like to send this letter as well. I hope you respond back as I will not use your words without permission. I think that this is well written and anything that we can do to get this out to public officials should be done. I would hope that others send this as well.
    The more we make our voices heard the better off we may be in the next few years. I have written everyone I can from Alaska to Hawaii and Florida to Maine and I will continue until they do something about these injustices. My governor and state reps all know my name and even if they laugh when they get another email or letter I dont care…I wont stop.
    My wife is scared I will go to jail (I have stopped smoking so they cant easily use that against me) for making too much “noise” and after reading this type of “justice” she may be right…but they dont have room to lock us all up.
    I hope everyone has a peaceful night.

  9. Right on MP. I would like to make all of you aware of the fact that when you become a convicted felon in the U.S. you sacrifice all of your constitutional rights. You become a ward of the state. Even after your sentence has been completed you remain a convicted felon which means you still have no right to vote, hold a public lincense such as a nurse,lawyer, doctor etc. you can not own a firearm of any type. The list goes on and on. My point in all of this is that the worst thing that happens to a person that consumes cannabis is the government will punish you(put you in jail)and strip you of all of your rights!!!!!
    We need to keep after our elected officials to right this terrible wrong. Remember to always speak the truth about cannabis. The truth will allow us to finally rid ourselves of this prohibition.

  17. How on earth can they make a ruling like that in america? It is unconstitutional! Clearly we have bigger issues to confront other then marijuana prohibition, it would appear our very freedoms are at stake here! People if we don’t act now things will get worse. If you want pot legalized we must take down the tyranny that drives the prohibition. The silencing of legal US citizens is not something the people should take lightly and it breaks my heart to see that noone is doing anything signifigant about it. Do you think your government is even gonna budge with non violent protest? Im sorry but we need to fight violently if we want to be a free people again.   19. Bob I wish there was something more I could do to assist in this matter. You and I have spoken by email several times in the last 2 yrs on this matter as well as other matters pertaining to the marijuana laws of the state of ass backwards South Dakota.
    My conversations with our current state reps has fallen upon deaf ears and has only merited a paper response indicating their displeasure of the topic let alone marijuana itself.
    Even our own Senator Johnson who has suffered from a stroke and other health issues strongly opposes such conversations and actions, as if it alone would save him from the gates of hell.
    I dont know for sure how this will effect the NORML chapter of South Dakota, but I am sure it will have a negative impact at some point.
    Knowing that you can not be a voice for the movement at this time, will not deter me from taking on a similar role and out beating the streets in Vermillion(Clay co) to collect the needed signatures to bring this to the state ballot 2010.
    Medicinal marijuana is and always will be a part of the life in this country.
    It is time to show the people that even a FDA approved drug acetaminophen (Tylenol) causes and can further to cause greater risk then the use of the hemp and marijuana plants.
    During our own personal trauma at home with a newborn delayed my writing and sending of the letter I promised, however I did send it to the address you provided in the emails.

  20. I just voted on the website about California legalizing cannabis. Over 86 percent of the voters were infavor of lifting prohibition. Over 86 percent!!! Do you think any of the elected officials in California are paying attention? Do you think any of the politcians are getting worried about their jobs?
    Do you think the DEA,ATF,FBI,for profit prisons and local law enforcement are getting that uneasy feeling in their gut? I hope they all start loosing a little sleep over this.

The Holocaust would not have occurred if the Nazis hadn’t gradually taken away freedoms as opposed to if they’d laid their cards out on the table from the get-go.   25. Is not the sentence deny the defendant’s Right to Speech itself un-Constitutional? I would think it would have to be overturned on appeal. The un-Constitutionality of the Federal marijuana prohibition should also be mentioned loudly and often. This judge, the fact that he believes himself authorized to remove a defendants right to speech should be looked at by e.g. the Bar Association. THe man is obviously not competent.

  26. The judge’s position amounts to “I have to force this un-Just Law on some kids, later, so I’m going to inhibit your Right to Speech, here and now, so you can’t tell them I’m oppressing them under color of Law.”
    He’s violating one man’s Right’s in order to be allowed to conitue to violate the rights of [probably] many other of his victims – and I say ‘victims’ because this judge is clearly engaging in criminal behavior, and trying to cover it up by silencing those who would Speak Truth to Power.

    parents didn’t like what school “AUTHORITIES” were calling their kids.
    This all contributed to our “WAR AGAINST THE SQUARES.”
    a war we won handily, and without an ounce of violence.
    It was a war against out-dated convention and moral authority. It was a war against the Jones’, and society’s attempt to keep up with them. We said…”No phony balogne…keep it real…knock off the pretentious bull shit…come back down to earth.”
    It was a war that included…”OUR FIRST TIME VOTE.” Vote we did…for a young man that stood for change. Youth and change…that was our ticket. It was “WE
    …Class of ’57″…that elected JFK…and…it was “WE” that put him Camelot. In turn…it was “HE” that passed the torch to a new generation. That generation was “US.”
    We fought against tyranny and injustice. Does not freedom and independence still radiate within us. Today…we are fighting the same war…again. History repeats itself. Can you be a “FREEDOM FIGHTER” one more time…before its time.

  28. Bob, I will be praying that you come out of this ordeal and are restored whole . . . my family was plunged into darkness in ’07, and I feel your pain. Unfortunately, when it comes to the criminal sytem, the goverment feels entitled to beat us up in any way they choose. . .

  29. Good luck Bob. I know how messed up the SD judicial system is. I lived most of my life in Rapid City,even got to check out the lovely Pennington Co jail for smokin a joint on Skyline Drive. I almost crapped myself to find out that a judge can order someone not to talk about something for a period of time. WTF is this country turning into?

    A fifteen-year prison sentence loomed over my head in order to protect the police.
    The Children had been suffering already.
    My Dear And True Christian Sister has now recovered from meth addiction.
