Daily Caller: "Is The DEA Legalizing THC?"

Reporter Mike Riggs at The Daily Caller has an important story online today revealing how U.S. Drug Enforcement Administration officials are making plans to reschedule natural THC under federal law.
Under the plan, THC derived from the marijuana plant would be classified as a Schedule III controlled substance, while the plant itself would remain classified as a Schedule I illegal drug. Sound fishy? It is.
As a DEA spokesperson quoted in the story explains, “THC, natural or synthetic, remains a schedule I controlled substance. Under the proposed rule, in those instances in the future where FDA might approve a generic version of Marinol, that version of the drug will be in the same schedule as the brand name version of the drug, regardless of whether the THC used in the generic version was synthesized by man or derived from the cannabis plant.”
So, in other words, if a pharmaceutical product contains THC extracted from the marijuana plant, that would be a legal commodity. But if you or I possessed THC extracted from the marijuana plant, that an remains illegal commodity.
Wait, it gets even more absurd.
Since the cannabis plant itself will remain illegal under federal law, then from whom precisely could Big Pharma legally obtain their soon-to-be legal THC extracts? There’s only one answer: The federal government’s lone legally licensed marijuana cultivator, The University of Mississippi at Oxford, which already has the licensing agreements with the pharmaceutical industry in hand.
Riggs writes:

In other words, THC in plant form or as an extract, will still be illegal. What won’t be illegal is if a pharmaceutical company buys THC from a government-licensed provider, puts it in a pill, receives the DEA’s stamp of approval, and sells it a price that will likely be far higher than the price of marijuana.
Armentano said such circular reasoning is a product of decades of hostility towards marijuana research.
“This is the insane rationale necessary for banning medical marijuana,” he said. “Take away the prohibition and the political elements, and you would never have the stretching of logic necessary to pass organic THC but only if it mimics Marinol.”

Expect the DEA’s ‘stretching of logic’ to become even more absurd in the future.

  1. There are literally hundreds of plants growing in the US that contain schedule 1 substances, but are not illegal. One only breaks the law when one tries to extract or concentrate the active ingredients…
    This seems to be the complete opposite case?
    Extracting the active ingredients would be legal (if you’re big pharma) but growing the plant would be illegal?
    WTF?
    So if the therapeutic power of DMT was discovered by big pharma would the DEA try to exterminate/regulate all the reeds, grasses, trees, and animals (including ourselves) that contain said substance?

  8. I’m with 113.Brethren of the Genesist Faith. We have to take what we know from the internet community and let it be known to everyone. The government is nothing but corrupt in my opinion. If the people come out against the unjust laws of our land, we have a chance.
    The prohibitionist ideology is in complete violation of free choice. The bigger Picture here is that we have a whole slew of different evil people in power – and guess what- they know exactly how they benefit from the unjust laws that are in place as I write this.
    Here is another problem we have to recognize. People know it is their right to do what they wish with their own bodys if it is not in conflict with another persons own liberty of life. Prohibitionist say drugs ruin families and lives of people- but that is a cover up for the law- as you all know, that is no reason to put people in jail and ruin people lives in another way.
    I feel there is almost no harm associated with marijuana use, and users should not be condemned for it. Freedom of choice is what I am fighting for.
    I’m sick of the bureaucratic government, I’m sick of the DEA and there power to do what is truly unjust to the People.
    This might be taking a big step, but I will come out and say that these laws are a part of a conspiracy against free will- we HAVE to recognize that, we have to let it be known that our rights are being violated. It is absolutely horrible there are so many people in jail for drugs- yet pharmaceuticals flourish in our society of now, now, I want it now. What they are doing is creating a loophole in the Drug Schedule specifically for Big Pharma to get involved in pharmacologically certified naturally derived cannabis medicines. Why would they do that?
    The USA patents on Marinol have expired. Marinol had been partially effective, but too potent and purified as synthetic THC for treatment of many ailments. Cannabis has many active ingredients beyond THC, which Big Pharma has been unable to duplicate synthetically at a low enough cost to compete with the natural cannabis plant.
    Big Pharma can either get on the cannabis bandwagon, or abandon a potentially lucrative market. But there is already competition for naturally derived cannabis medicine, in 15 State-approved Medical Marijuana programs. And there will at some point be an off-shore Big Pharma competitor with a cannabis product in the USA market — Savitex.
    The USA government is stepping up to the plate regarding medical cannabis, finally, but only to enrich Big Pharma instead of improving the health and well-being of all citizens. Their ready reply: A denial that smoked cannabis is medicine, and that any home-made cannabis concentrates are medicine. Only if that medical cannabis product comes from Big Pharma, with Big Pharma’s big price-tag is it to be considered medicine.
    There is a term that applies to such legalistic machinations — FASCISM, essentially government by, for, and of the corporations for their private profit. This is not so very different from the Too Big To Fail / Too Big To Jail Banksters’ bailout, by taxpayers — Corporate Welfare. “Privatized Profits, Socialized Risks” is a core principle of fascism. 70+ years after the beginning of cannabis prohibition, which Big Pharma had a part in instigating, they are finally ready to re-enter the medical cannabis market in force, just so long as they have no competition from the peons.

  15. Talk about a rigged “game”. President BH Obama talks the talk about having a reasonable debate regarding re-legalizing cannabis & hemp, but sticks to the official government mantra that only USA government approved scientific studies are relevant.
    The stick in USA citizens’ eye is that the DEA only approves “scientific” studies from researchers who seek further government grants, and those grants will not be forthcoming if the “correct results” are not obtained. Even those studies are few and far between. And government funded studies about cannabis from the past, like the La Guardia and Shafer Commission Reports, have been shelved and ignored — because they obtained results the government didn’t like.
    All foreign scientific studies are not approved and paid for by the USA government (DEA), and therefore considered only anecdotal, and their results dismissed out of hand. How much different is this from a petulant child that covers his ears, shouting “la, la, la, la, la, la … I can’t hear you”?
    So now the DEA, after multiple attempts by DEA Judges themselves to reclassify cannabis from the most stringent Schedule 1 over the course of 10+ years, is now talking about reclassifying cannabis from Schedule 1 to Schedule 3 — but only for the benefit of Big Pharma. The DEA has managed, with some effort, to twist this reclassification of cannabis into a “special interest benefit” for Big Pharma and the government’s sole supplier of medical cannabis, the University of Mississippi. No doubt the sole supplier status will change, again to the benefit of Big Pharma. But smoked medical cannabis, as approved by at least 15 State-approved Medical Marijuana programs, keeps getting dissed by the DEA as “not medicine” — all evidence to the contrary. And those natural cannabis concentrates that even individual MMJ patients could create in the privacy of their homes — those have been monopolized by Big Pharma with these actions of the DEA.

People need to keep in mind that it is not Constitutional for our government to prohibit marijuana, which is why the people posing as The Peoples’ government currently use the Interstate Commerce clause to justify their corporate sponsored war against The People. If one would take the time to read about the I C clause, one would see that it was to allow the Federal government enough power to protect people against powerful corporate interests or abuses by the States…not to give the Federal government power over the individual, for which there is no recourse. If there is no check of power, it is unlawful.
    What we really need is a class action type of lawsuit against the Federal government, challenging the use of Interstate Commerce against the common citizen as a violation of individual rights…with the charge of treason against the sovereign rights of the American people as a threat to those who would in future seek to subvert our democracy.

    There is only one course of action that I can think of that might be effective — a coordinated three-pronged attack against the status quo. (1) Massive organized civil disobedience in the form of an economic boycott: no purchase of any new goods or services that aid the Kleptocrats — make do without, or buy used where consumers can pay cash. (2) Write (not email or tweet or facebook) each of our representatives at the State & Federal level regarding complete re-legalization (like beer) of cannabis and an end to the Drug War weekly. AND (3) Change our pattern of voting for the “lesser of two evils” — their all evil, so don’t vote for them, but absolutely don’t fail to vote for someone who actually supports re-legalization and has promised to make it happen.
    Consumer spending accounts for 60% of all economic activity in the USA, and shutting that down by 50% will get the attention of “our” politicians, guaranteed. Politicians are greedy pragmatists, and if they come too realize that their constituents have a single most pressing issue to address, at some point they will have to listen. And to make certain that “our” representatives abide by our wishes instead of their base, the Haves & the Have Mores, they need to understand that they will no longer get our votes if they don’t. Short of an armed rebellion, which I consider to be futile, this is the only way to get our rights, liberties, and freedoms back again.

    Correct me if I’m wrong. Thanking you in advance for your information.
    The law clearly indicates a wide range of clinical applications [serious medical conditions] for which cannabis provides symptomatic relief from pain and suffering with no side effects. These indications, – in and of itself – is an admission by the FDA, that cannabis “has current recognized medical purpose. ” In fact – it should be noted that federally supplied cannabis users have been receiving and using cannabis for 11 to 27 years “with clinically demonstrated effectiveness” in the treatment of glaucoma, chronic musculoskeletal pain, spasm, nausea, and spasticity of muscular sclerosis. Furthermore, there is “no evidence that these patients have suffered any negative side effects from the use of cannabis.”
    In 1976 the federal government created the Investigational New Drug (IND) Compassionate Access Research Program to allow patients to receive up to nine (9) pounds of cannabis from the government each year. Today, five (5) surviving patients still receive medical cannabis from the federal government, paid for by federal dollars.
    The National Institute of Drug Abuse (NIDA) provides cannabis on a monthly basis to a few medical users through the “Compassionate Investigatory New Drug (IND) Program” of the Food and Drug Administration (FDA). So!…It’s apparent that cannabis is respectfully, or more likely disrespectfully, in the Investigatory New Drug Program. Now! – all the FDA has to do is examine the preponderance of evidence and research in its favor, including its own, stop dragging their feet, and take this “Wonder Herb” out of purgatory (schedule I substance). It is, therefore, also appropriate to expand the natural curiosity within us, to ask for, even demand, a reasonable explanation as to governments own “double standard, and mendacious role” in medicinal cannabis prohibition. It also seems appropriate to ask” – if it has no medical purpose [why then], for 33 years, since 1976, has cannabis been malingering in the Investigatory Drug Program” – collecting dust? Talk about being buried – WOW! My question, obvious to everyone but the FDA is, “You mean to tell We the People that – in 33 years – you couldn’t find one medical purpose in a medicine that already has efficacy for more than 250 medical conditions.” This audacity defies logic and reason, and is an insult to common sense.
    “If” – we are to believe the omnipotent FDA, [that] cannabis has “no medical purpose,” [why then] on October 3, 2003 did the U.S. government, represented by the Department of Health and Human Services, file for, and was awarded, a patent for its use as a antioxidant and neuro-protective. That – at least to me – conclusively I might add – does not indicate the absence of medical purpose. It does however – once again – demonstrate the governments attitude – “It’s mine, and you can’t play with it.” Now! – “Whose kidding who?” Frankly, my intelligence is extremely offended by such immature views and actions, and needs reminding of who and/or what view is presented.

  23. It comes down to one thing and one thing only. MONEY!!! The plant doesn’t put money in Pharma Co’s pockets but a manufactured “equivalent” does. The smartest thing the gov here in the US can do for the people is allow taxed plants to be grow by people for their own use or for the use of others who cannot grow. It can create jobs (which is a major need these days), tax revenue to help with our nations debt and allow people to choose natural methods for their health care choices over the known issues that come with the Pharma products. I don’t see the “War on Drugs” keeping their sites on the pill abuse that has increased 10 fold over the past few years because in my eyes, too many “higher ups” have their hand in the pot with their sales. My request to the government is to please listen to the people and look at the bigger benefit for the people.

  24. The DEA does NOT (legitimately) “make money” through this. It should be found out what corrupt individuals ARE making money from this, and I mean being “paid off” under the table and they should prosecuted for “abuse of power.”
    In a “free society” we/anybody should be able to walk into a pharmacy and buy pretty much ANYTHING they want. They should be required to show ID and have their purchases kept track of. Any excessive purchasing could be looked into to prevent selling to minors, etc., and they should be severely prosecuted if that’s what they’re up to. Maybe excessively “high” (no pun intended) personal use could be referred (sold) to companies advertising “Detox Services” or something…………..
