Marijuana POW dies in custody in Houston

(Raw Story) A woman serving a short sentence in a Houston, Texas, jail for possession of marijuana died in custody over the weekend, and officers are not saying how or why.
The 29-year-old, identified as Theresa Anthony, had expected to spend just two and a half weeks behind bars in the Harris County lockup. On Saturday, Cynthia Prude, Theresa’s mother, received a phone call from the jail’s Chaplain informing her that her daughter was dead.
Prude has not been allowed to see the body, nor has the Harris County Sheriff’s Department even spoken with her, according to area media.
On 4 June 2009, the Justice Department concluded a 15 months-long investigation into the Harris County facility and determined in the subsequent 27-page report that over 142 prisoners had died there since 2001. Most expired due to lack of medical care, the report claims.
The Associated Press noted that after the Justice Department declined to make its findings public, The Houston Chronicle was able to obtain a copy, which it released on the Internet.

Wait a minute, how is this possible? According to our last Drug Czar, John Walters, finding a non-violent offender in jail or prison for simple possession is like finding a unicorn.
Theresa Anthony could be you or me. Or could have been a young Barack Obama. Just another dead unicorn, expiring in a cage for the crime of preferring the safest choice of social relaxant or therapeutic medicine.
President Obama, if you can stop giggling for a moment, could you please put “legalization” back on the table? Director Kerlikowske, could you please find the time to add “decriminalization” to your vocabulary? You have the power to see to it that Theresa Anthony is the last unicorn to die in a cell.

I was in a Houston jail for the same thing a few months ago, only just for 24 hours instead of 2 1/2 weeks, was hit and knocked out by another inmate, and was refused medical attention. When I got out I went to the hospital for my splitting headache and it turned out I had a concussion. If I had fallen asleep I could have had brain damage or even died. God Bless America.

  3. I too was a victim of something such as this. I was incarcerated for non-violent drug offenses and I am diagnosed with epilepsy. There were times they didn’t even care about giving my medication. I had many seizures in jail, even fell on my head a few times. This has got to stop. Medical treatment for prisoners has got to get better. Whether they are violent or non-violent offenders. Its a scary thing to have a seizure episode in jail and wake up not know where or who you are.

  4. WOW…I am a native Houstonian and I cannot believe the injustices in the jail system. 142 inmates in 8 years, mostly due to lax medical care! Sad thing is, people die free every day due to no medical care.

With his parent’s permission the patient used the medical marijuana to help in regaining his appetite and relieve pain. The medical marijuana helped the young man. Mr. President, you smoked pot, you got the munchies—do I have to draw you a picture. Mr. Lynch will spend a year in jail, his life destroyed, a criminal. You must feel satisfied; Mr. Lynch received a fair trial, he could not bring up the facts: that medical marijuana in California was legal, and that he followed all of the guidelines set up by the state and the city of Morro Bay to comply with zoning, security and patient registration. This is what amounts to a fair trial in our U.S. District Courts? Really?     You must have your stones in a vise. That’s a phrase, “stones in a vise”, an old Vet shared with me as he lay dying trying to explain his own condition, frail and wasting away. No access to medical marijuana in Florida, but if he was lucky enough to be dying in Michigan, New Mexico or California where VA Physicians can recommend this course of treatment to restore appetite and thus life sustaining food he might have a better outcome. Tough shit soldier, the law and our inane rules matter more than his worn out, used up in battle, tired and dying ass. Care to go with me to a Vet Hospital and be introduced to a new generation of warriors, smart and brave who are not going to believe and stand by while the Government lies to them about medical marijuana not providing relief to over 48 mental/medical ailments and conditions. Actually a war on patients and care-givers, isn’t the most despicable part of this, if you can overlook the fact that in many instances it is more cost effective and provides for a better outcome for the Veteran suffering from PTSD and in some cases Traumatic Brain Injury to forgo the mind numbing pharma solutions doled out. We know the Doctors have been brainwashed and in some cases paid off by big drug company’s to push the pills and belittle the use of a cheaper and better performing treatment (medical marijuana) that the patient/care-giver can grow in a garden for next to nothing. Imagine Tom Slater’s disgust as Rhode Island Governor Carcieri vetoed an act to provide a single dispensary, regulated by the state and off the streets, for medical marijuana for the 1000 currently enrolled Rhode Island patients and care-givers. As part of his reasoning for the veto, Governor Carcieri’s primary fear was that Grandma will be on a street corner reselling cannabis to kids, now unless that economy gig doesn’t get better, he may be right. Governors Pawlenty (who also vetoed a Compassionate Use act in Minnesota) and Carcieri are willing to let people suffer, because they think kids will have more access to marijuana? Really? Governor Carcieri hope you don’t feel bad when you get the override of your veto.
    I can list more ailments and more of our sons and daughters, brothers and sisters, moms and dads to the list, but I think you get it, Mr. President. You need to do all that you can to ensure this situation gets resolved. Thank you for the chat, Mr. President.

  25. Of course people are in jail for simple possesion. I spent 3 days in jail for ingestion. That’s right they didn’t find any marijuana on me. They got a warrant for my piss and they found 632 nannagrams and put me in jail for 3 fucking days. I guess that’s the christmas present I get when I go back to Spink County, South Dakota for break from my freshmen year at college. LEGALIZE IT OBAMA!

  28. The crime doesn’t fit the punishment and the Czar’s unattentive attitude to change has spread fear into the hearts of medicinal patients of MJ. In general people in the United States have never had a problem with changes to law. It’s when government gets involved that things get difficult, strange and confidential. What we use to call, “More red tape,” and we’re lucky if they respond to our needs with MJ issues. For politicians using avoidance tactics with MJ issues, avoidance is not an option anymore.

  35. it’s sick and sad, but nobody on this blog understands exactly what is at stake when it comes to marijuana legalization, it would be the end to centralized power. Wealth will no longer be accruing to the few especially those in government.
    The basic economic problem, how do we fulfill infinite wants with limited resources? is only relevant in relation to another principle of economics, that is the balancing of human recources and raw materials.
    At first we lived in a non-scarcity society as hunter gatherers, this was the time when some of the greatest human innovation came to being such as language, use of fire or tools. (imagine if a group considering fire evil came to dominate all of humankind, we would be impoverished)for all our human resources at that time we could not possibly process all raw materials into finished products because we lacked both knowledge and time as we were struggling to survive.
    With the advent of agriculture came scarcity, people began to develop surplus and specialized in order to focus their efforts better. With the explosion of population and refinement of techniques we greatly increased the human resource and raw materials became scarce. Eventually a system was needed to apportion what to whom.
    We can return to a non scarcity society but it would take a total and complete change of resource bases. we would need a cheap abundant renewable resource, cannabis which anybody can grow and use. If this were to occur 80% of products would be rendered redundant and of inferior quality. Prices for items will also drop by 80% as this value was artificially created by using expensive and scarce sources for energy.
    Cannabis grown for any of the specific: fiber, seed, medicine or stalk, will also yield the other three completly cost free. with a demise of scarcity societies the great mass of people will begin to take care of themselves instead of looking to those in power to and so their influence over other men will disappear.
    The illusion is as fragile as a house of cards, but can be maintained by instilling a blind dogmatic hatred of “drugs”. labeling those who speak truth as “conspiracy theorists” and trample over people’s rights while claiming to do so in the “interest” of society (in reality it is the interest of those who control the highest levels of societal goernment).
    The nature of the human soul is justice, to expose people to injustice as we do is to pervert human beings at their very core. We can see by the ignorance and wilful complacency of the many how horribly afflicted we really are.This is just the latest atrocity.

I am strongly for the legalization and regulation of Marijuana and I agree that our current laws regarding Marijuana are ridiculous, but nonetheless they are laws and we must fight to change them through legal avenues.

    I live in Houston. This is where it happened. Here, this is where the drug czar goes wrong. Police are so power driven here it is pathetic. They have sooo many people that they have to book, it takes a day to a day and a half before they actually get a jail number so you can’t find anything else about them.
    Do something about it, I did. I wrote to Gary Elkins, Obama and Ron Paul. Go look these people up and write to them. I hope this will be a turning point in the legislation.

When I saw this I knew it had to be brought to the media so I personally contacted foxnews , CNBC ,NBC and CNN and gave them the information along with my comment I had just put on here in post # 25 with the link to the site (here on NORML). Hopefully now they will do a story on it to make sure it does not happen again as well as to help stop this in just.
    She should have never been in jail for this in the first place and shows to America just how stupid it is to do such a thing and the ignorance of keeping MJ in prohibition. This all could have been avoided and they know that . The question is now what are they going to do about it be for other cases like hers happens?

  49. How sad, that one would die in jail for possession. But, what is also lamentable is the poor grasp of the English language of many of those leaving comments on this page. I don’t claim to speak perfectly, but perhaps the anti-Prohibition movement would be more respected if the proponents could properly articulate their beliefs. I am all for the legalization of the five fingered flower, but, more important to me, is that this nation as a whole doesn’t devalue the sacrifices of those past and present who have fought and died for the rights that we still have. Granted, everyday the government (funded by powerful lobbies) does what it can to further reduce these privileges, but I believe there is still a means that a popular outrage can force the current system to respond. Violence is not the answer. Thomas Jefferson once said something to the effect that a little revolution was a good thing every now and again, so, let us who desire change follow the example of Gandhi and other peaceful protesters to achieve the change that is so desperately needed.

  50. This does not suprize me at all.
    I was arrested in the 90’s in Houston jail, for less than a gram (simple possession). The jail mess up my bond from 1000.00 and printed it on paper as 100,000.00 Which keep me in jail for 2 weeks, because of this mess up.For those with any doubts I still have the paper work on the mess up with the bond. While I was in jail I personally saw a spanish kid coughing and the guard which the other inmates called Sargent Slaughter took the kid out of the way of cameras and beat him in the chest reapeting this until he cried and no longer coughed. I grew up in Houston in the 60’s… the cops have always been borderline criminals weilding their own justice… I was hitchhiking abd the car was pulled over, the cop found a tab of acid in one of the occpants wallet… We were hauled to the jail and I was told I could go down right now and join the military or go to jail… the cop drove me down the street to the recruter and waited until I was all signed up… welcome to Texas…

    How many people have been robbed, assaulted, or murdered while trying to procure marijuana from the only source available?
    Compare that to how many people have died as a result of using Marijuana.
    How many people have died as a result of lung cancer from cigarettes? How many of those might have been saved by marijuana, which has recently been shown to not only prevent and inhibit cancer development, but also cures at least seven different forms of lung cancer?
    How many billions of dollars have made their way to washington on the backs of the tobacco lobby? (Keep in mind, my family grew tobacco in NC for more than 150 years…we stopped in the early 90’s when it became clear how corrupt and dishonest the big labels really are)
    How can the government possibly continue to claim that the laws prohibiting the use, possession, sale, and cultivation of Marijuana protect not only society, but the individual as well?

    So for the night they throw us in a cell with a couple drunken lunatics who wouldnt shut up and a scuzzy methhead who seemed a little off and wouldnt stop staring at us. Not to mention the fact that the room stunk like piss. It was like being caged up animals.It was quite a dehumanizing experience. In 1978 as a member of N.O.R.M.L. in Nebraska we got a bill passed that decriminalized possesion of less than one ounce of cannibus to a civil infraction ( traffic ticket) with a fine of $100.00. The way we convinced lawmakers to do this was by using an example of teenagers in a car being pulled over for a tail light being out and being arrested for possesion of cannibus. At the time it was a felony. If convicted they would not be allowed to vote or carry a firearm or more importantly they would not be allowed to hold a public license such as a nurse, doctor ,barber,real estate agent, etc. Our focus was to point out that the penality didn’t fit the crime ( death while in jail or a criminal record that would follow them the rest of their life). It passed with only one vote against it.I think this latest death due to possesion should be used in the same way. DOES THE PUNISHMENT FIT THE CRIME. IT SHOULD NOT BE A CRIME AT ALL.

Even then, you may spark up the legalization/decriminalization topic with some conservatives, and they may just agree with it. I’m proud to say Congressman Ron Paul, of Texas, is among those few.

    You see, I honestly don’t think the country will be ready for legalization/decriminalization without winning over Texas. I don’t want to divide this site into regions, but a lot of people in rural areas identify with Texas. I understand other States have pushed for more sensible laws than Texas, but I feel if the ball would really get rolling if marijuana was decriminalized here. The problem is, there is no real movement for this cause in Texas. Sadly, Ron Paul appears to be our only hope.

    Theresa Anthony (RIP) and so many others like her should be a wake up call to us all. There needs to be mass protests in cities across the country as well as a march on Washington, DC over 1 million strong. In these protests, we need to carry posters with pictures of people who either died in custody or as a result of SWAT brutality, or pictures of people whose lives have been ruined by having a criminal record as a result of a possession conviction. As was mentioned above, would Obama be President if he had been caught smoking MJ? He committed an illegal act and should be jailed; just like they tried to do to Michael Phelps. Do you think that would be a wake up call? If Obama can do it and become President, why can’t any of us?
    Everyone needs to write to their elected officials, saying that they will NOT vote for them again unless they put legalization on the table, and in a very public way.
    Inaction turns us all into sheeple; exactly where they want us. Better smarten up, and fast.

  107. To the Editor. Your comment to #128 was right on the money. Too many cannibus users are afraid to speak out. They have kept a very low profile for years and they associate that with success for not getting busted. They think if they do speak out the government will round them up and put them in jail to die! I have been a very outspoken person on this subject since 1975 when I came home from the war in Veitnam. I have not been harrassed by anyone.     As a student of history I have learned that “If you do not learn from history and strive to better yourself it WILL repeat itself.” Allow me if I may to make a quick Comparison (I most likely misspelled that)
    In the 1860’s in America, many new laws affected the South to a higher degree than the North. The south tried for a time to end the (in their opinion) unjust and hypocritical laws through legal and nonviolent methods. However after a time finding that nothing they tried was working they finally settled on a solution; a Secession. Which would declare them a completely separate nation. They believed that it would become a second American Revolution. They believed that it was the exact same situation for which the founding fathers (many of which were in fact southern themselves)seceeded themselves from the rule of the British.
    I actually wouldn’t mind repeating that history minus the defeat of course and so I say…
    I the Sole citizen (so far) of the Cannibas smoking Republic of Ganja-topia (better name pending) hereby seceed from this mockery of a Union that you call the United States of America.
    Legalize now because even in a fake democracy we should get what we want some of the time.

I am 20 years old, therefore a responsible adult. i have been imprisoned for more that 30 days total. not for alcohol, not for tobacco, which by the way kill thousands of people each year, but a harmless plant that GOD PUT ON THE EARTH!!!!! It makes me ashamed to call myself an American citizen. There is absolutely no use in having the constituition, because it is being openly defied. LIFE,LIBERTY,AND THE PURSUIT OF HAPPYNESS. That says to me that if an adult is responsibly using marijuana for medicinal, or recreational use, they should be allowed to do so without fear of being labeled a “criminal” give me a fucking break. I am no longer allowed to get federal aid to go to school, because of a possession of marijuana charge( i had 1.5 grams WITH THE BAG) meanwhile a convicted arsonist, thats someone who got arrested for burning buildings,cars, etc. Is still granted aid to go to school. I burn a plant, that asshole potentially kills people,and Im the bad guy? ridiculous. I am now paying my own way thru community college, with the hopes that i somehow fall into a lot of money, so that i may go to the University of Iowa someday to complete my degree. I am trying to be a productive member of society, by graduating college and getting a better job, but the federal government thinks that since i smoke weed i should not b able to go to school. isnt that backwards? The government is always supposedly trying to make America a better place. How the hell do they expect to accomplish that goal by turning down responsible marijuana users pleas for a fucking education for christ sake? There is one, and only one explanation for this. All the government cares about is making money, and they do that by trapping responsible marijuana users in the court system. They make you jump through all these hoops, supposedly in the hope of helping you become a better person, but then deny you the opportunity to get a higher education? thats the most hypocritical, twisted, assinine excuse ive ever heard. ITS TIME FOR THE AMERICAN PEOPLE TO STAND UP FOR WHAT THEY BELIEVE IN. IN THE BIBLE IT SAYS THAT GOD PUT ALL SEED BEARING PLANTS ON EARTH TO USE. I am not a very religious person, however i do not judge other people based on their beliefs, race, sexual orientation, or anything like that. I do however judge our politicians, for each and every one of those bastards are lying, cheating, assholes. If marijuana is not decriminalized, or at the very least made acceptable for medicinal use by the end of 2009, i am moving to Holland. I have already ordered my Rosetta Stone language learning software, just in case it doesn’t happen. This is not a laughing matter, weed makes you hungry, happy, and sleepy. It is impossible to die from using marijuana. Legalize it, or face societys rath. The time is far past due for the American public to make a stand. Each citizen can do their part, by writing each and every public official.

  112. Make that 143 immates. I was in the Harris County Jail for possesion of marijuana in late June of 2009 and I saw a man have a seisure and the guards did nothing about it. They dont care about regular citizens. I have never hurt anyone or stole anything. Everyone needs to open their eyes and say STOP to this nonsense.
    I will be putting up legalization signs across south houston. Anyone willing to make signs and put them up around the houston area or all over america would be greatly appreciated

My fellow Americans, my fellow Houstonians, are hurting, dying, for the laws meant to “protect” us. Protect us from what??     We need to focus on the root of the problems in the world. You can’t kill a weed by picking at the leaves. The root of the worlds ills can be summed up:
    1. We have made nature illegal
    2. We draw imaginary lines on the earth
    3. We fight for the resources given to us freely by the earth. (oil, diamonds, etc)
    Until we can fix the root problems, this world will continue to suffer.

    The Tulia Effect almost happened in Tyler, Texas 30 years ago. It started with drug agents posing as a young couple who were new to the area. Then it became an out-of-control witch hunt. Many people were being rounded up and arrested, and most of the victums had no clue what was going on and why? It ended when the judge and the members of law enforcement families and relatives were on that list.
