Missouri SWAT team shoots family dog during raid over “small amount” of marijuana

(Columbia Daily-Tribune) In response to widespread “misinformation” developing on message boards and blogs, as well as a death threat toward Columbia police officers, Columbia Mayor Bob McDavid and Burton held a news conference Thursday afternoon.

Burton said police have fielded questions from several agitated callers concerning the two dogs shot. Some callers have received incorrect information that the corgi is the dog that was killed for being aggressive toward officers, and others told police they were told the pit bull that was killed because of its aggressive behavior was in a cage.

“It’s simply not true,” Burton said.

The chief, who is personally conducting the internal investigation, walked reporters through his understanding of the incident. Three officers shot at the pit bull, and the first missed completely, which is when the corgi is believed to have been shot in the paw, he said. The pit bull acted aggressively toward a SWAT member again as they pushed into the home, which resulted in the animal being shot, he said. After being shot, it moved to attack a SWAT member, which is when the dog was killed.

Here it comes: the victim was a dangerous druggie, a narcotics kingpin with a lethally aggressive pit bull.  Because two confidential informants (read: snitches with something to gain by rolling on someone, true or false accusations be damned) alleged he had large amounts of marijuana and a police garbage search yielded pipes and baggies with pot residue on them.

(Columbia Daily-Tribune) “It was unfortunate timing,” said Lt. Scott Young, SWAT commander.

Deputy Chief Tom Dresner, former SWAT commander, has said he is confident narcotics were in Whitworth’s residence before police entry.

Columbia police spokeswoman Jessie Haden said there sometimes was a lag between the time a warrant was issued and when SWAT could execute the warrant. The problem was SWAT members’ primary assignments, such as their role as beat officers or investigators, would take precedence over SWAT and they would have to work overtime to participate in SWAT operations.

So, in the police opinion, the mistake wasn’t in sending automatic-weapon wielding cops into the family home, shooting up the place with a child present and killing the family pet.  It’s that they served the warrant too late to catch the victim with what they believed to be large amounts of weapons of mass destruction, er, marijuana.

We’ve told the story of drug war canicide – dog murder – before here on the NORML Stash Blog. From the LAPD dog killing during dispensary raids to the Buffalo man who pleaded with cops to let him put his beloved pets in another room before cops gunned them down, and even the mayor of a town in Maryland forced to sit handcuffed near a pool of his slaughtered black labs’ blood during a SWAT raid that turned out to be in error.

This incident in Missouri happened in February and is just one of the 100-150 militaristic raids on homes every day in America, most often to serve narcotics warrants, which usually means marijuana, the substance involved in almost half of all drug arrests.  But never before have we brought you actual video of law enforcement protecting us from adults smoking a bowl in their own home and serving us by executing family pets in front of small children.

(Warning: if you love your dog as much as I love Roscoe P. Coltrane, my Jack Russell terrier, scratch its belly and get to your serenity place before you view this.  It is very disturbing.)

If you notice toward the end of the video you can see what appears to be a small bong on the coffee table.  The Columbia, Missouri SWAT team sure took down a big-time drug kingpin while he slept peacefully with his wife and seven-year-old child, huh?

(Columbia Daily-Tribune) Police discovered a grinder, a pipe and a small amount of marijuana, Haden said. Because the SWAT team acts on the most updated information available, the team wanted to enter the house before marijuana believed to be at the location could be distributed, she said.

“If you let too much time go by, then the drugs are not there,” she said.

Drug distributors traditionally have a history with firearms, which is why the SWAT team is used when executing such warrants, [police spokeswoman Officer Jessie] Haden said. If the SWAT team believed they could have executed the warrant successfully during the daytime when the wife and child were not present, they would have, she said.

Well, the “drugs” weren’t there, now, were they?  But let’s pretend they were.  Let’s say the man was holding enough marijuana to qualify for a felony charge in Missouri (over 35 grams).  Are we to understand that holding any more than an ounce and a quarter in Missouri is justification enough to send SWAT to burst into a man’s home late at night and start firing weapons and slaughtering his pets and terrorizing his wife and children?

And what exactly is it that made the SWAT team believe it couldn’t execute a successful warrant in the daytime?  The presence of his pit bull and corgi (yes, these cops shot a corgi) or that his wife and child would be away so he wouldn’t mind going down guns blazing to protect his lucrative marijuana empire?  And if he had enough pot to have a lucrative marijuana empire worth shooting cops over, how exactly did he manage to get rid of it all in the few hours between daytime and that night?

No, folks, the justification is simple: shock and awe.  These cops are taught that “druggies” are dangerous armed hostile mentally deranged lunatics who all emulate Tony Montana from Scarface.  Then they are taught how to dominate and intimidate and that one of the quickest ways you can do so is to show them you have the power of life and death.  And they do this as a message to all the other “druggies” out there that they are not safe and that they are serious about engaging the “enemy” and winning the “war”.

Radley Balko at Reason’s Hit and Run (a top libertarian blog) has been following the story and promises an update from the victim’s mother, who was present at the raid.  Jane Hamsher at FireDogLake (a top progressive blog which has recently begun a new campaign for legalization), Scott Morgan at Drug War Chronicle, and Pete Guither at DrugWarRant have also been following the story.

In the end the victim pleaded guilty to the misdemeanor charge of possession of drug paraphernalia in exchange for dropping the charges of misdemeanor marijuana possession and second-degree child endangerment.  Yes, you read that right: the police burst into this man’s home, shooting weapons in his home and killing his dog with his seven-year-old sleeping in the next room and he’s the one who was endangering his child by smoking pot in his own home.

P.S. You’d think the ASPCA or PETA would be all over this, wouldn’t you?  I did, but found no reference to any police-shooting-dog stories on either of their websites.  I once got in contact with people in their organizations but got no interest from them on addressing these clear cases of cruel and unethical treatment of animals.  I even tried contacting Bill Maher, a high-profile PETA supporter and marijuana legalization supporter to spotlight the topic, but I’ve never received any response.  None of these animal rights supporters seem to think a family pet has a right to be protected from police brutality if the owner is thought to be a “druggie”.

P.P.S. Paul Armentano reminds me that in 2004, seven in ten Columbia, Missouri residents voted for the end of the “arrest, prosecution, punishment, or sanction” citizens for their medical use of marijuana, and six in ten voted for the decriminalization of marijuana for personal use.  So the dog was murdered and the family terrorized over something only 30%-40% of residents believe is a crime.

  3. I’m at a loss for words. I made the mistake of watching this at work and I am in my office swimming in tears. There is too much lunacy infecting the Missouri law enforcement. I only speak for them because this video makes it very clear that they thought they caught a big-shot drug dealer when they really only ended up killing a family pet. Where is the humanity in that?

  14. Talk about police brutality. Understanding it was a raid, I have also been involved in a raid, and needless to say these officers must have been obiding by their own set of rules. The raid I was involved in also only INVOLVED A SMALL AMOUNT OF MARIJUANA and some paraphernilia. But instead of killing the family dog, which there wasn’t one, they let THEIR K-9 UNIT shit INSIDE the house and they stepped in it and tracked it all throughout the house not bothering to clean it up. Also they destroyed several hundreds of dollars worth in furniture trying to find the “big” bust of which they never found. Tell you what, it was also around 3AM that it happened.. hmmmmm should try during the daytime, might get better results.. But to all officers involved, you should be ashamed of yourselves, put yourself in his situation….

  23. Why is that they can’t use “less than lethal” force on animals on these raids instead of routinely dispensing of peoples pets when these folks aren’t even charged with a crime yet?

  27. I never make comments regarding such statements but that may have been one of the most painful videos to watch hearing the dogs dying in the background. For many families a dog is a member of the family and is loved. And really? A corgi is about as threatening to a 200lb body-armored individual as one of the stuffed animals from the kid’s room where he was sleeping. And to kill them in front of a child, for shame.

    While I have great regard for police in many aspects of what they do, their behavior towards the public with regards to drug policy and in this case needless murder of innocent animals makes me agree with NWA, F* the police. Such behavior should make respectable law enforcement ashamed because what is happening is not protecting the public but making them fear and despise the people meant to protect them.That kid is sure gonna be a proud supporter of police for the rest of his life I’m sure.

  31. Actually, shooting dogs is quite tame for American law enforcement–state police forces and SWAT teams–at least by the standards of liberal minded, urbane and civil Massachussets. One of my mother’s friends has a daughter who was raped by an MA State cop and was impregnated. Actually one state cop even took a you-tube video of himself sexually violating a pornographic actress (barbie cummings?) during a “routine traffic stop” in exchange for not charging her with drug possession–this case unfortunately is quite rare, as only the stuppidest most thuggish of cops videotape their own misconduct (as those filmed shooting the little corgi did). The trick is getting to photograph them without their shooting you (or worse, destroying the camera!). For precisely this reason cops are notoriously sensitive about being photographed: if enough people took photos of them murdering and raping people (not just innocent Welsh Corgis) they would be at the top of the public enemy list.

This is absolutely ridiculous, I am very angry that my tax money is going to things like this, what a discrace to America. So the police can kill your dog if they feel threatened and send their k-9 cop to attack you, but if you defend yourself against their K-9 cop you can be charged with (not animal cruelty) but with the endangerment or murder of a police officer?     SWAT officers raided the home of Jonathan Whitworth, the dog’s owner, eight days after securing the search warrant on suspicion that Whitworth was dealing marijuana, Burton said. The officers encountered a pit bull and a Welsh corgi when they burst through the door of Whitworth’s home at 1501 Kinloch Court in southwest Columbia. They fatally shot the pit bull and wounded the corgi. Whitworth’s wife and child were also in the home when the police executed the raid, according to a report in the Columbia Tribune.

    Whitworth pleaded guilty on April 20 to a misdemeanor charge of unlawful use of drug paraphernalia and was fined $300.]

    As far as I am concerned, if California (Richard Lee) really wants to get serious about legalizing marijuana this year, stories like this need to hit the mainstream airwaves. I will gladly donate money for commercials that demonstrate the widespread animal abuse that is going on in the war against marijuana. Our local heehaw police yanked my 18 year old daughter out of her bed with a gun to her head. Just glad he didn’t pull the trigger.     Deputies Mark Noffke and Robert Sillers are no longer apart of the Grand Traverse County Sheriff’s Office.

    Both Noffke and Sillers responded to the crash of a Traverse City Police Officer, Joseph Sofferdine, but never conducted a field sobriety test.

    The Sheriff believes both deputies gave Sofferdine “preferential treatment”.

    Now, Officer Sofferdine is accused of drunk driving and running his car off the road in February.

    Sofferdine is awaiting trial but there is a possibility of a plea deal.

    Human beings in all cultures throughout history have regularly altered their minds with a wide variety of drugs. Drug use is hardly an isolated anomaly — it may even be part of human nature. Billions around the world derive positive benefits from mind-altering drugs (especially from alcohol, nicotine, caffeine, and marijuana).
    Many respected, productive people, including many of you honorable members of Congress, are (or were) regular users of illegal drugs. Many of you are regular “users” of alcohol or nicotine. Demonizing and criminalizing some drugs, while approving others, without rational criteria, is patently arbitrary and deceitful.
    Just as the vast majority of alcohol users consider their drug of choice a positive part of their lives, the vast majority of illegal drug users consider their drug of choice a positive part of their lives. No matter what their drug of choice, we should show compassion and help those with problems. They need treatment, not prison. We don’t put alcoholics in jail.
    Why are “drug dealers” condemned for “pushing poison” or “ruining lives,” but alcohol and nicotine dealers aren’t?
    Propaganda generated by our government (and other special interests that profit greatly from prohibition) necessarily demonizes those who use prohibited drugs. It’s fine to have a few beers at the ball game, or smoke cigarettes to get a mental boost, but if you relax with a joint, you’re a low-life “drug user” or “druggie.” It’s then a small propaganda step from “druggie” to “criminal.”

    To protect their drug money, special interests within our government have dishonestly thwarted legitimate medical marijuana research for decades.
    Marijuana has been used as medicine in many cultures throughout history. It’s been shown to be effective for treating a variety of ailments. Recent studies have identified cannabinoid receptors in many parts of the human body, including areas outside the brain that control vital bodily functions. This suggests there may be multiple medical uses for marijuana yet undiscovered.
    But pretending to stop adults from using marijuana is much more profitable to our government than medical marijuana research.
    Hemp
    Prohibition also bans hemp, once a mainstay of the American agricultural economy. Hemp, “nature’s perfect plant,” could bring a bonanza to American farmers, greatly reduce America’s dependence on fossil fuels, and thus help mitigate global warming and climate change.
    This environmentally friendly plant grows without herbicides, nourishes the soil, matures quickly, and provides high yields. Hemp is the number one biomass producer in the world — ten tons per acre in four months! It could be an excellent fuel-producing crop.
    Hemp can be made into paper, paneling, injection-molded plastics, clothing, and thousands of other useful products. The highly nutritious seeds can be used to make flour, cooking oil, and even cattle feed.
    But pretending to stop adults from using marijuana is much more profitable to our government than easing global warming.
    Conclusion
    Supporting a government policy guaranteed to both fail and cause vast human suffering is egregiously immoral.
    Prohibition is a deep, self-inflicted wound on humanity. Arbitrarily punishing users of certain politically incorrect drugs is just plain cruel. Severely punishing those who produce and deliver illegal drugs is like dangling meat in front of starving dogs and then beating them unmercifully when they disobey your command and lunge for the meat.
    Prohibition guarantees lucrative jobs for desperate people all along the chain of production and distribution. Most are motivated by survival not greed. Rampant corruption of foreign governments (e.g. Mexico, Columbia, Afghanistan) is driven by massive drug profits — human life and human rights are secondary.
    Yes, if prohibition ended, many businesses would fail. Many government agencies would lose billions. Tens of thousands of decent Americans would lose their government jobs. But that’s no reason to continue this insane war against our fellow human beings for even one more day.
    Even if one accepted all the positive claims of prohibitionists, the benefits don’t come close to outweighing the massive costs in cash and human suffering. For what? Most of the drug war billions are spent trying to stop adults from using marijuana.
    The best interests of the American people would be better served by treating drug users who need help instead of spending billions arresting and jailing them. Treatment could be totally financed by taxing and regulating these drugs.
    We, the undersigned, demand that you uphold your moral duty to represent the best interests of the American people. We hereby demand you honorable ladies and gentlemen use the power we have entrusted in you to peacefully end the blatantly dishonest, extremely expensive, highly destructive, futile-by-design, government tyranny know as the “drug war.”

    10 officers on the scene, 8 hours overtime pay @ roughly 60$ an hour, + cruiser costs, court cost comes out to around 8000$ just for this operation.

    All of that was done in order to serve a 300$ citation.

    I saw the video yesterday of your “SWAT” team in action last February, storming a home in the middle of the night, the shooting of family dogs, and the excecution of a search warrent.
    I waited until today to send my response, since I did not want emotion to cloud the message.
    I understand the necessity for an occaisonal operation of that sort, but I highly doubt that this man posed enough of a threat, even if he HAD been dealing Marijuana, to justify the actions your officers executed. If even the simplest of background checks let alone adequate investigation had been done, then you had to be aware of the presence of a young child and animals in the home. I assume from the actions of the SWAT members that they most certainly were aware of the dogs, since the first thing they did was chase the Corgi, and gun down both family pets. Obviously the only danger the Welsh Corgi could have presented was getting stepped on, so why was it shot? I’ve also heard the pit bull was caged when it was shot and killed. I don’t know if this is fact, but if it is, this along with the shooting of an “ankle biter” is CLEAR misuse of a firearm, and the officer(s) responsible has/have no business carrying a weapon.
    The child was present for these senseless acts by an officer, and due to the child’s age, he will never understand whatever justifications your office may chose to give, for in the eyes of a 7 or 8 year old, there are none. You have traumatized him, and the repercussions will last his entire life. Do not be surprised if this child grows to hate ALL authority, since you KNOWINGLY have proven to him that authority equals cruelty and terror.
    The cost of this operation, both monetarily and morally, is not justified, and goes a long way to reinforce the opinion that law enforcement is ineffecient, and full of foolish wasting of resources. It also goes much further than you would imagine to reinforce the belief that police forces across the nation are now populated by tyrannical, adrenaline driven, maniacal drones incapable of human empathy or feeling. They act as if the population were the enemy, not their boss.
    All in all, the damage caused by this act of terror could never be worth whatever you believe to have been gained by it. I sincerely hope your police department has learned this.

  173. This is another perfect area of the country for police departments to get their budgets cut due to the bad economy. All of these law enforcement officials need either to take an across-the-board cut so they all can keep their jobs or some of them need to be let go. That will sink it into their thick skulls that marijuana needs to be legalized and some of the tax revenues from it used to pay them. A consolidation of police departments and contracting out to a different low bidder for neighboring police services to downsize to a regional force is called for here.

Your job is to protect and serve the people, and by carrying out these types of destructive home invasions you are not doing your job.
    I understand that in the eyes of all LEOs marijuana is a dangerous drug that makes people go crazy, but I believe that you have a moral responsibility to do some research not only on the real effects of marijuana, which in nearly every unbiased medical research shows cannibis to be less harmful than nearly all other vices out there.
    You also have a moral responsibility to do a proper investigation of a tip instead of going in guns ablazing. Even though in this case some marijuana was found, how often does it occur that nothing is found.     despite a corgi’s short stature, they were bred to herd cattle and are a working class dog…they can be territorial and protective of their family and could be perceived as aggressive…i’ve had an australian cattle dog (aka blue heeler) which are quite similar to corgis in that they are working herding dogs and she was intimidating to strangers and quite vocal if anyone unfamiliar came too near her territory…again NOT defending the cops – they used excessive force and i don’t think the chief’s account of events is at all supported by the video…all the cops involved should be summarily relieved of duty immediately and should NEVER work in any kind of law enforcement EVER (not even as mall cops)

Only an individual of the utmost ignorant, cruel and inhumane mind set could deny those who are in medical need the right to use marijuana. Additionally, marijuana can help cure alcoholism and millions of people need the help of this natural herb in order to break the terrible cycle of alcohol use and addiction. Our Federal Government should seek the trust and support of our citizens and until the hypocracy stops and marijuana is legalized our citizens will continue to believe that corrupt political officials are standing in the way of legalization due to the huge amounts of money changing hands from the alcohol and pharmaceutical lobbies. Legalization will serve to much better protect our young people from exposure to bad highly addictive drugs and will enable our government to successfully go after the real criminals and pushers who are selling these harsh bad addictive drugs and put a stop to it. It is a fact that over 80% of our adult population has tried marijuana at some point during their lifetimes by either smoking it or ingesting it with food. Due to professional license requirements such as those for lawyers and doctors and other professionals – our professional people can not admit that they have ever used marijuana or support legalization for fear of loosing their professional licenses. We can not continue to require our adult population to live within the confines of wrongful legally imposed lies and hypocracy. To do so destroys the very core of a humane being and it is simply wrong. Christ counsels us within the Gospel to “Beware of pharma” and to use natural herbs and remedies. This does not mean that all pharma is bad – surely there are many excellent pharmaceuticals available for the treatment of many serious medical conditions – but only that when a natural remedy such as a natural herb exists then we should look to use of the natural herb as opposed to the unnatural man-made chemical pharma – at the very least we should be allowed the choice. Marijuana has many medical uses including but not limited to the treatment of glycoma, cancer pain, chemotherapy nausea, severe stress, depression and anxiety, post partum depression, physical pain, arthritis – the list is long. Additionally, marijuana users should not be charged with crimes and incarcerated – the tax dollars wasted on prosecution within our judicial system and imprisonment are well within hundreds of billions of dollars annually if not approaching a trillion annually – this is a wrongful horrible waste when so many are suffering in our country economically and when there are so many other far more important issues that need the attention of our tax dollars which are being wasted on enforcing the illegality of marijuana use. Marijauna needs to be legalized for consumption and use by adults 21 and older as soon as possible at the Federal level i.e our Congress. Too many decent tax paying individuals have suffered tremendously due to the current illegality of marijuana in all but 17 of our States – and in those remaining States too many decent tax paying individuals continue to suffer for the hypocracy of “illegal marijuana”. The Big Lie needs to stop now. I am a lawyer and I support the legalization of marijuana both for medical use and for consumption and use by adults age 21 and over.

  220. Let us be clear: There is not now, nor has there ever been, a “War on Drugs.”
    What there is is a cynical program of political duplicity; the intent of which is not to prevent drug abuse (which it encourages), but to create a climate of distrust, fear, hostility, alienation, divisiveness, and violence within our society. The so called “War on Drugs” is in reality a war of cultural prejudice waged primarily against the young, the poor, the non-white and the socially disaffected to the advantage of the Elected, the Corporate, the Privileged and the Few.

    President Nixon launched this war against American citizens in 1968, at a time of extreme political and social unrest. For Nixon, it was a method of “getting even” with “uppity blacks,” “radical leftists” and “dirty” hippies” that he and the nefarious interests he represented (especially those who benefited economically from the war in Vietnam) regarded as “second class citizens” and “traitors” to the American way of life.

    On the contrary: What we were doing then, and what we are doing now, is trying to liberate America from a reign of political and economic tyranny that is sustained by rhetorical propaganda and misinformation. We love America and the Constitution and wish nothing more than to see her succeed in her Great Promise of providing Freedom and Justice for All. Those who oppose this very High Aim, whether out of ignorance, greed or bigotry, are the true enemies of our nation and its Constitution.

    Dividing Americans against themselves, making them mistrust, fear and wage war against their fellow citizens: This is what the so called “War on Drugs” was meant to do–and that is precisely what it has done and is doing–far more successfully than even Richard Nixon could have hoped. What better way to destroy the gains blacks were making through the Civil Rights movement than to flood the ghettos with drugs which addict thousands of users, offering the allure for “quick” money and escape from poverty, while simultaneously creating divisions and violent “turf wars” between ghetto gangs? All this while creating the political justifications and judicial sanctions for increasingly militaristic police “crack downs,” arresting, incarcerating (killing when necessary) and ruining the lives of hundreds of thousands of black men, their families and their communities.

    After Nixon, both Ronald Regan and George Bush found their own uses for the “War on Drugs.” Besides the political advantages of “getting tough” on the very crime and violence that prohibition inevitably engenders, drug smuggling by covert factions within the federal system itself created vast sums of unregulated money to fund illegal military operations outside our nations boarders. What began as a cynical attitude of social malice quickly turned into a bad habit of deception and corruption. Nothing, my friends, is more addictive than power.

    At this point in our history–the election year of 1996–this insidious and increasingly malignant and militaristic policy is still with us. And to judge by President Clinton’s appointment of General Barry McCaffrey as “Drug Czar,” it may be about to get much worse. This so called “policy” has become such a part of our media conditioned perception of reality that it is difficult to imagine an America without it. Anyone who publicly opposes the inflamed rhetoric or tries to bring rational, informed discussion to the issue, is branded a “traitor,” characterized as a “drug pusher” or worse–in precisely the same way leftists were branded as “communists” in the McCarthy era of the 1950s. Witness the forced resignation of Surgeon General Jocylin Elders after she took an informed and reasoned position of leadership on this issue. She understood, as more and more Americans are coming to understand, that making criminals of drug users not only does not solve the problems associated with drug abuse, it exacerbates them far beyond the harms of the drugs. Indeed, with forfeiture laws and the kinds of invasions of our privacy that it allows, the “War on Drugs” has put the civil liberties of all citizens in jeopardy.

    It is time for us to ARM OURSELVES against this misguided tyranny with information, with conviction and with every legal strategy for a redress of grievances that our Constitution allows.

After nearly four decades of fueling the U.S. policy of a war on drugs with over a trillion tax dollars and 37 million arrests for nonviolent drug offenses, our confined population has quadrupled making building prisons the fastest growing industry in the United States. More than 2.2 million of our citizens are currently incarcerated and every year we arrest an additional 1.9 million more guaranteeing those prisons will be bursting at their seams.     The stated goals of current U.S.drug policy — reducing crime, drug addiction, and juvenile drug use — have not been achieved, even after nearly four decades of a policy of “war on drugs”. This policy, fueled by over a trillion of our tax dollars has had little or no effect on the levels of drug addiction among our fellow citizens, but has instead resulted in a tremendous increase in crime and in the numbers of Americans in our prisons and jails. With 4.6% of the world’s population, America today has 22.5% of the worlds prisoners. But, after all that time, after all the destroyed lives and after all the wasted resources, prohibited drugs today are cheaper, stronger, and easier to get than they were thirty-five years ago at the beginning of the so-called “war on drugs”. With this in mind, we current and former members of law enforcement have created a drug-policy reform movement — LEAP. We believe that to save lives and lower the rates of disease, crime and addiction. as well as to conserve tax dollars, we must end drug prohibition. Police are given way to much power over people and they clearly abuse it. Police are advised to take out dogs “percieved” to be a threat. Truth be told this is a perfect opportunity to engage in selective target engagement in real life situations, an oppportunity to evaluate live fire exercises on American families. They actually do it well in most instances if you review how many of these engagements ended in the selective deaths of family pets.   236. Kinloch Court Search Warrant Update

    Columbia Police officers served a search warrant at 1501 Kinloch Court, in Columbia, at 8:27 p.m., on February 11, 2010. The search warrant entry team consisted of eight SWAT members and the perimeter team consisted of three officers, one of whom is a SWAT member.

    Upon entry, the officers immediately encountered two dogs. During the search warrant, one of the dogs was shot and killed. This dog was a breed commonly referred to as a “pit bull”.

    The defendant, Jonathon Whitworth, was arrested.

    The police department has received numerous inquiries from citizens who have received misinformation. While the investigation is still ongoing, the department recognizes the need to provide information prior to its conclusion to clarify some specific questions, many of which are based on misinformation.

    * The pit-bull type breed dog was not confined; it was not in a cage and it was not behind a gate.
    * The other dog, described as a Corgi, was not killed. This dog is believed to have been struck once.
    * The defendant’s wife and child were at the residence. However, neither was in the presence of the officers or dogs when the dogs were shot.
    * The officers did not force entry into the home. The door was unlocked and an officer opened it.
    * The search warrant was not served for a misdemeanor amount of marijuana. The Columbia Police Department does not pursue search warrants for misdemeanor amounts of marijuana. The search warrant was for Marijuana, A Schedule I Controlled Substance and the evidence of the crime of drug trafficking. A copy of the affidavit is attached.
    * A diversionary device or “flash bang” was not deployed during this incident

    Police Chief Ken Burton requested the Internal Affairs Unit conduct an investigation into the uses of force involved in the incident. A total of seven shots were fired.

    The investigative review also examines training practices, and the department’s current practices in general with regard to the service of search warrants. Since that time, the department has received inquiries from individuals expressing a desire to know if an investigation is being completed.

    Upon being briefed about the incident Chief Burton concluded that this search warrant should not have been served in the delayed fashion that it was, but rather should have been disregarded when the department was not able to serve it within a reasonable time. He has made members of his department aware that policy changes with regard to search warrant service are underway. In the interim, he will personally be responsible for approving search warrants in which forced entry may be required.

    When the internal investigation is complete, a news release will be issued with its results.

    Many phone calls and e-mails are being received by the members of the police department, as well as other City departments, regarding this incident. The department is doing its best to reply with a statement to the inquiries that contain a legitimate e-mail address or phone numbers, and which include questions that we can answer at this time.

  244. The Columbia, Missouri SWAT team and the city attorney’s office deserves articulate, well reasoned FEEDBACK on how this incident was handled.

    Over 800,000 Americans are arrested every year over this issue, some like the folks above, who were raided by the Columbia, Missouri SWAT team, had their pet dogs shot (Just say no! Really? A Corgi? Really?) and a child threatened with abduction, all under color of law.

    Yes, thousands of emails may be ignored, but add dozens of well reasoned, articulate calls, faxes and letters a day and you have their attention. Of course, include your letterhead if you are an attorney, it gives them . . . pause.

    We share your concern about the circumstances under which these dogs were shot. We understand that the responsible agency is conducting a thorough internal review of the incident, and we sincerely hope that this review will lead to policy changes that will ensure that it is never repeated.

    These tragedies happen more often than one would imagine. It seems we’re inundated with calls every week from people whose dogs were shot by law-enforcement personnel. Officers appropriately resort to deadly force when they believe that their lives, or the lives of others, are in danger. But sometimes officials draw their guns unnecessarily or too quickly. If cops are here to enforce laws, why don’t they choose to go out and ticket people parking in handicap spots that aren’t supposed to, or go around and make sure buildings are up to code, or hell spend time solving real crimes?   258. A search warrant would not be issued just for having a small amount of pot. In order to get a warrant, detectives would have had to purchase narcotics inside the home (probably at least twice). So the guy deals weed in addition to smoking it. Shame on him for putting his family in the middle of that. Who cares if you agree with that law, it is the law. So guess what happens when you break it? You’re all right, it’s too bad they shot the innocent dog instead of him. He’s a whiny crying punk.

It makes me so sad to see how police turn to killing and military tactics of everyday American people just to get their kicks.People we think should protect society and it’s people have become the enemy of the people.I had just had open heart surgery and cancer surgery,my sick 60+ year old wife with COPD in Maryland was harassed by state police because another neighbor told them(police) I told rabbits and deer to make paths in the woods(neighbors angry because we would not sell them our home),police came to our home 3 times with K-9 dogs and police car back up late at night,no evidence,no charges.Being a combat veteran,fought for this country in combat.I thought police were there to protect people not do their friends dirty work for them.Are we any different then Russia and China when it comes to Civil Rights ! NO ! Just like this story,POLICE ARE OUT OF CONTROL IN AMERICA !

  268. I began Googling incidents of police shooting dogs after reading about Cisco in Austin & I’m horrified by how often this happens. You can be totally innocent & have to worry about cops breaking into your home & killing your dogs at any given time, apparently.

    Now I’m afraid to call 911, ever. It’s as if they’re not the good guys any more.
