Judge Andrew Napolitano, host of Fox News.com’s Freedom Watch, has long been on the right side of the war on drugs, and his scathing critique of the deplorable police actions in Columbia, Missouri is no exception.
(To recap for those who have not yet seen the video: under the cover of darkness, a team of militarized SWAT agents enter a family home and immediately engage in gunfire — killing one of two family dogs and wounding the other — and likely inflicting lifelong trauma to the family’s seven-year-old son. Police ultimately seized a small amount of marijuana residue and associated paraphernalia, which resulted in a misdemeanor charge and a $300 fine.)
In fact, Napolitano’s very first question to befuddled Columbia Mayor Bob McDavid is: “When are the cops who did this going to be arrested and put in jail where they belong?” It’s a valid question that, not surprisingly, leaves the new mayor speechless.
In less than a week nearly one-million people have watched the graphic and sickening footage from Columbia. It has, quite understandably, inspired public outrage and, apparently, some welcome changes in police procedure.
Yet as NORML Outreach Coordinator Russ Belville astutely points out on today’s edition of the NORML Stash blog, none of these minor amendments to protocol in any way gets to the heart of the problem, and that is this: Police and politicians still “accept the premise that this level of force is appropriate to keep people from using marijuana.” Ultimately, this societal mentality must change.
That is why, while on the one hand NORML (obviously) supports cannabis medicalization and decriminalization efforts, we also recognize that these efforts fall woefully short for many Americans. In short, the only way to fully protect all our citizens from these kinds of abhorrent events is through the legalization and regulation of marijuana for all adults. Help us make this a reality.

This carousel of hopelessness continues to ruin good peoples lives. We continue to see our government hide behind rhetoric that marijuana is a heavy narcotic. We have to hide our live from our family and children so as to not be demonized by a society that overtly uses and abuses “legalized drugs”, alcohol, tabacco, and others that are shown to have decidely worse side effects. We fill privatized jails and correctional facilities with pot offenders. my house was also rated on May 4t 2010 at 9:30 am,they did pretty much the same thing on this video,scared my 13 yr &15yr and a 5 month old baby i was babysitting,they found about 0z or so of marijuana ,that believe it or not that i use for my legs,it had orange peels (home remedy for years past from my grandma,was pretty much old and pretty much dirt and ya i smoke ones in a while,but never sell,they broke all my windows,my house pretty much empty due to me moving to Colorado.told them the baby was in the house and still broke window ,fired a bomb of some kind, very very loud,put my 13 yr old on the floor with a gun on all our heads even his,im serious, it was bad,this is US and we get treated like this, the land of the free, na this is not the land of the free we are in a scary land,the police treat us like animals,all they had to do was knock on my door and say can we come in we have a search warrant,i would of let them in no questions asked,this needs to stop,my kids are scared and hate the law do to all this,scary.
Nice to see a story about this but as much as I love dogs there have been plenty of people treated in this manner in this exact situation. If I recall correctly.. A while back a swat team got a no knock warrant for some old lady’s home on a tip about marijuana. They bust in scaring the shit out of her. Prompting her to grab her gun and start firing as she lived in a really bad neighborhood. The police killed her and found no drugs. Stupid drug laws.

A very important meeting will take place on Wednesday evening, May 12, at 7:00 p.m. at the Columbia City Council Chambers at 8th and Broadway in downtown Columbia. The Columbia Citizens Police Review Board (CPRB) will be meeting and will hear comments from members of the public regarding the recent incident in which two dogs were shot by Columbia Police Department SWAT team members executing a search warrant for marijuana. One dog was killed and the other was wounded.

Having a SWAT team raid a family home without justifiable cause…? Killing the family dog, traumatizing the little ones, wrongly accusing someone of a crime (small amounts of pot are merely a fine in MO.) and the guy DID NOT even have ANY! The local police force in many states including MI. have on many occasions endangered innocent lives. This is a private family residence… not a drug king-pin for goodness sake. They better have adequate information before busting down a private families door and vitally impacting the entire family over… “inadequate information”. Incidentally, the present “power” that our local law enforcement sustains is dangerous. I don’t know about you, but I’d like to think I am safe at home! Moreover, I had a friend that was battling a “psycho” ex-wife, who vengefully called the Police and falsely informed them of “alleged” drug use and dealing. And the above situation was precisely the same result… (aside from the dog shooting and sadly, his elderly parents were there when the raid took place). And, all of this traumatic chaos in their home (children were present)… just for the law to find absolutely NOTHING, NADA, not even a piece of residue. Frankly, he never was guilty of such activity and the cops just backed out without an apology nor did the ex-wife have a consequence to pay for false allegations (using our tax $, I might add). I saw how that impacted their lives… anyone at anytime can falsely accuse someone of such an act and the Police have the power to “act” with brutal force, lacking proper information. I think a good word for this situation would be is… “ABOMINABLE”.
To me the biggest shocker of this whole story is that Fox News actually was sympathetic to the victim of this raid. Their audience is of course largely conservative and seeing a conservative “news” station starting to open up to marijuana decriminalization is groundbreaking. A big part of this could be the channel’s recent (since Bush left office) slamming of our government, but hey, if some of the conservatives start becoming exposed to the truth about the relative harmlessness of marijuana, we may see rapid reform.
The police video all encounters and “raids” so that if any evidence is needed to justify their shooting of a suspect,they have it on tape. Most traffic cops have a video camera that records every traffic stop,to cover their ass in case it gets violent. If you want to see pissed,have a passenger start recording your next traffic ticket. While the police feel they are allowed to record their actions,they don’t believe you have the same right.

Yes #8 that happened in Atlanta, Georgia. The old lady’s name was Katherine Johnston. It happened shortly after my family’s house got busted just 60 miles north of Atlanta. We in the North Georgia mountain deal with the “Appalachian Drug Task Force”. I believe they were assembled to combat the meth problem we had. But they do not stop there. We had 6 cops in my hallway at 4:30 a.m. with guns drawn banging on my bedroom door before my dogs even started to bark. Keep in mind they didn’t have a “NO KNock” Although they said the knocked and rang the door bell and that the door bell was broken. Yeah right and you did not even wake up the dogs. Needless to say they didn’t need to break down my door because they were all unlocked. They actually just opened the door and walked right in. What drug dealers do you know that sleep with all of their doors unlocked? They had a warrant based on a crack-head snitch trying to save his butt. My daughter had been out in town and saw an old classmate and was hanging out with him. Yeah you guessed it he was dealing. Yeah and your Point? That my daughter was dealing too? She had not seen this boy in years. No surveillance, no investigatory work, just come in guns blazing and do as you please. My daughter at the time was going to school full-time and working part-time. The cop got everyone up stairs under their power and headed to the basement where her bedroom was. They pulled my 19 year old straight A college student out of her bed by her long hair with a gun to her head. Her alarm went off at the same time and thank God the cop didn’t flinch with his finger on the trigger. In the end they found some paraphernalia and 1.4 grams of marijuana. She was out on bond and under governmental control for over a year before we finally went to court. At court with a plea deal she got 1 year probation and lots of money fines and community service, but no “Record”. This so affected my family I could not even begin to tell you, 3 years later, she called to tell me that she had slept for the first time through the night. We all as a family and every one of our friend and family look at these people we hire to protect and serve us in a very different light. I was not afraid to sleep with my doors unlock before that night, but I can guarantee you this my doors are now locked and I have a big big gun by my bed. No one will come in my house unannounced again. Be it criminal or cop.

3. The police chief, commisioner and all management of that SWAT Unit be replaced.
4. If I were not a Christian I would call for the SWAT officers to watch their families watch their pets being shot. (No need to punish innocent pets though).
Compensation to the innocent family who had their civil and Constitutional rights violated:
$50 million awarded to them by the State of MO for trauma, pain, suffering, wrongful arrest, home invasion and the merciless killing of their pets. Someone has to be held accountable! I believe the state should be accountable, not just the city. It’s time to stop passing the buck and take responsibility!
Lifetime paid health insurance for entire family and relatives of the family, including psychiatric since everyone involved will need a life time of counseling.

First of all, the news has never reported exactly what types of drugs the police were looking for during the execution of this search warrant. They may have been looking for much harder drugs than pot. We just don’t know. Also, the video I saw did not show the actual shooting of the dogs, so we don’t know what the dogs were doing when they were shot. If they were threatening the officers in any way, they were justified in shooting them, like it or not. A person’s life outweighs an animal’s life and the person has a right to defend himself, even if you don’t agree with why they were in the home. Before we call for the jailing, castration, or worse, has many have suggested, we just need more information. INNOCENT BEFORE PROVEN GUILTY APPLIES TO THE POLICE, TOO!

Do the police have anything else better to do? There are much more important issues in this world than the war on “drugs” and it still baffles me to why people think cannabis is a drug…its not. So why is it included in the “War on Drugs” fiasco? It should definitely not be worth killing over or any drug for that matter. Doesn’t matter, it’s all about money and control anyway. But the thing is no one seems to realize; we’re all on drugs! Its ridiculous to believe that you don’t use drugs, we all do. It’s right in your medicine cabinet. Because we’re all addicted to something and then we get medicine for that and then become addicted to that. The problem is people like to abuse them, like everything thing else we’re addicted to. No matter what, there is always gonna be a “WAR ON…” phrase on the news and people buy into it. Especially when the war on whatever is completely biased and says nothing logical or moral. We need a true leader! No more harmless kids in prison just for smoking a plant that’s so much healthier than tobacco and alcohol. If things would be less illegal, then no one will have the need to sneak it around. No more racist pigs beating little colored kids. This Drug War was created by the Federal Government and pushed upon the states. If President Obama does not recognize that this is his responsibility to address, he will not be reelected.
The right thing to do is to order all Federal and State police agencies to not utilize a SWAT team for use upon nonviolent domestic issues like marijuana possession or sales. This was not a known kidnapping. A known murderer was not held up in the home. Anything short of this should not call for a SWAT team.

I knew of two sheriff deputies in south east Arizona several years ago that looked for young girls smoking pot in secluded areas. They would let them off and keep the pot to smoke later themselves, if the women would swear to never tell anyone and give the deputies oral sex. First…the cops are people, they should show a little restraint naturally if a serve and protect mentality is nurtured,so I have great reservations about the type of people they select for law enforcement and/or how they are being trained.
Second…it sounds like the judge really dropped the ball here. Then again I lived in Columbia when I was a kid and there where times when law enforcement was shot at through the door, etc. I guess that kind of thing makes judges and cops jumpy. Still, homeowners get jumpy when people burst into their homes. I can go back and forth but to be fair (yes I know, but I do expect to get what I pay for including good government) we can’t allow one group of citizens power over another, especially when receiving money in fees and fines and taking property is the motivation. So, nope on the excuses, clearly the judge should have been looking out for the rights of the citizen and seen convincing evidence of “probable cause” before signing a warrant. Voting people out of office starts locally.
Thirdly, to those people who are suggesting fear tactics are part of some widespread plan to curb use I have to say I doubt it. I can just imagine the reaction to the loss of funds (fines and legal fees) from over 800,000 people. Seriously, what would law enforcement do? They would actually have to investigate crimes committed against a victim. The government would have to figure out what else to prohibit. Like remember when alcohol blood levels were .10? It is said that once people began staying below that level and less arrests were made, the limit typically lowered to .08. If people are adjusting again does that mean it will be lowered again?
Finally, Americans need to see what is happening. Show others you don’t appreciate the way everyday people are being treated. Even if someone is doing a hard drug they are probably hurting in some way. So the answer is just to lock them up? Legalization sends the wrong message? Really? The seven year old in the video has gotten quite a message.
Republicans said they would decrease laws and they just made less for corporations, while average American saw the establishment of the Patriot Act (what a misnomer)wiretapping and eminent domain. Democrats find ways of taking money from us for our own good while jailing our children and asking what kind of people we are (the Obama internet question comment)just because we think it may be wrong to continue a war that potentially harms all of us. 1984 (read the book) is fast approaching when 1884 might be more welcome. Can we stop it? Vote out prohibitionists…also, when on a jury vote not guilty unless there is a victim. If just the state is making the claim then there can be no “beyond a shadow of a doubt”: too much corruption in the system. Can they fund a drug war if they can’t take money in from convictions?

Please Help!!!! We’re being crucified in our local media for our religious beliefs and practices. The cult that is mormon-ism is trying and crucifying us in this local paper while not even letting us defend or respond to the accusations being made. We have called repeatedly only to be ignored and brushed off, no one can even offer an explanation to why they won’t print our response. Please help us!!! They put guns in my face and threatened my life. Now I want to put cameras in theirs and let the truth be known.
Our challenges to this excuse of a story are these:
1. No one was being held against their will and if so why wasn’t it expanded on in the story. I was alone and had been so for over an hour and a half when deputies arrived.
2. There were no “other controlled substances” in the house and if there were why weren’t we charged. They are trying to slander and illegitimize our religion and beliefs.
3. Why wasn’t it mentioned that it was a church/temple that was destroyed and trampled under by those deputies. Why is so much effort being gone too to conceal this fact from the public. I thought we had the right to defend ourselves in a free press.

Two arrested during house search
Piute County investigators found a marijuana grow hidden in the attic of a Circleville home April 20. Two people were arrested as a result of the bust.

CIRCLEVILLE – The term 4/20 is often used to describe the use of marijuana in the drug subculture.
However, the term took an ironic twist for two people who were arrested after a search warrant was served in Circleville April 20.
A woman was reported as being held against her will at 290 North Center Street in Circleville. Piute County Sheriff’s Office deputies arrived at the location and knocked on the front and back door, announcing they were police officers.
The officers entered the residence, found Kellin Thompson, 24, hiding under the bed in a bedroom. Also observed by officers in plain view were narcotics and narcotic paraphernalia, according to information released by the sheriff’s office.
A search warrant was written and executed on the residence. The result of the warrant was the finding of 82 marijuana plants, grow lights, potting soil, plastic sheeting, pots, buckets, fans, heater, air conditioner and fertilizer in the attic of the home.
The plants ranged from approximately 24 inches to 4 inches in size. Also found in the residence were other controlled substances and narcotic paraphernalia, according to the sheriff’s office.
A guitar with marijuana leaves glued to the back side and the front was also found in the residence.
Thompson was arrested for cultivation of marijuana, possession of controlled substance and possession of narcotic paraphernalia.
Brittany Delia Thompson, 20, was also arrested for cultivation of marijuana, possession of controlled substance and possession of narcotic paraphernalia.
Both suspects were taken to Sevier County Jail. The investigation is ongoing with more arrests expected, according to the sheriff’s office.

In regards to someone being held against their will that was a false tip or lie made up to enter Our Peace Church illegally. My wife was not home and hadn’t been so for over an hour and a half. Deputy Mike Gayler also threatened my life, I said “I would never come into your church and threaten people with weapons, he replied “I would blow your f***ing head off if you did.” I was refused medical treatment, water, and food for over 11 hours after they illegally detained me. I was refused a bathroom to use. After hours of asking and knocking on the door I had to relieve my bladder down the drain in the cell I was being illegally detained in. I have x ray and doctor records from the day before this debacle of law enforcement took place, confirming I was injured yet they would not loosen my cuffs and I still have cuts on my wrist from them tightening cuffs too tight and making me sit on my hands for hours. My wife was never read her Miranda rights either, she was led to the jail under the false pretense that she was just signing a statement stating everything was a misunderstanding, then they put her in a holding cell in booking never charging her or telling her what was going on. All she was told is “you have to wait for the boys from Piute.” The cell she was held in did have running water and a toilet the standard protocol for arrests and such, yet I was not given those basic rights or luxuries. I had several panic-attacks and nightmares of the officers shooting me while incarcerated. I was refused medical treatment or E.R. visit for my hand which was injured badly with torn ligaments and muscles. I’m not defending the actions of the police involved in this incident for one second. I too believe they should be removed from the police force and probably jailed for several years. But, not all police are bad. I might be naive, but I prefer to think that most of them are good. I was caught once, while driving, with a small amount – appx 1/4 oz. The 2 police officers let me go with a speeding ticket (10 mph over the limit…) and took my weed. I know I was very lucky they were the ones that caught me because if I had got caught by any of the officers involved in the Columbia incident, my life would probably have been ruined. Instead, I have had a successful career as a computer programmer and have a great family. I am and have always been a good citizen. Sadly, the idiotic marijuana laws we are all forced to abide by are the problem and I don’t see the people with the power to change it, like President Obama, doing anything about it. I had great hope he would truly usher in a era of change like he promised, but it seems like he has gone through the same brain-washing machine the other presidents of our country were run through…

Shooting a family pet gets the point across and “takes the fight” out of the people being raided. This is a widely used tactic that gets very little attention from the media. Pointing guns and children, using “distraction devices” (Flash-bangs) and CS gas in homes with children present is the norm. Obama is just as happy with this as the former leaders of this country, use what ever means necesary to control the populace. Time for Americans to learn their history and understand their rights, this is our fault for not paying attention. We need to realize, the revolution is already starting, but this one is breaking the nation apart rather than reform is because it is designed to fail and to be used as an excuse to further chain us down. To really make a difference, you need to show this video to every non-smoker and ask them, what if tomorrow they banned sugar, or some other item deemed dangerous to the individual and used these tactics to obtain an arrest because an individual might not care what it does to them. In fact they discourage others from using it. When people see that what happens here can happen to them just as easy, because someone else says it does us no good and so we can’t have it, which only encourages our natural tendencies to rebel. I was horrified by the actions of these cops. I do not use weed or any other “illegal” drugs, and don’t hate cops, but the groupthink, mindless following, and willingnes to harm the innocent demonstrated here are abominable and should have no place in our supposedly free scoiety. I hope at least some of these men have sufficient conscience and empathy to be forever haunted with guilt when they look at their own pet, or wife, or child. I live in supposedly liberal Washington state, and recently, there has been a big push to toughen or eliminate medical marijuana by our governor and other officials normally perceived as liberal. I am a home health nurse, and know that many chronicly ill not so young patients swear by marijuana as the best method of pain and anxiety relief, antinausea remedy, and appetite stimulant. What a hideous waste of tax money it is to spend money on terrorizing innocent citizens in a time when so many much needed programs to benefit citizens are being cut or eliminated. I plan to share this with as many people as I possibly can. While I generally find Fox news coverage and its commentator anything from questionable to despicable, I am so grateful to Judge Napolitano for presenting this, especially to the more conservative citizens of this country, who often buy into the notion that the police are justified in whatever actions they take. Many of those same conservatives have driven drunk many times, and would be outraged if treated in such a manner while being arrested for a crime which we know kills, maims, and destroys lives each year. God help us all. I sometimes depair that this nation will ever mature to encompass a reasonable and just society.
