Colorado Raids Linked to DOJ Memo Violations & Drug Gangs

On Thursday November 21, US law enforcement agents, along with local police officers raided 14  medical marijuana locations around Colorado (including dispensaries, grow warehouses and 2 private residences), making it one of the largest federal raids since the state’s medical marijuana laws went into effect.  A search warrant identifies 10 target subjects, noting alleged violations to the latest DOJ memo dealing with state pot laws that contradict federal policy.

On August 29th, the Justice Department issued a memo to federal prosecutors indicating it wouldn’t interfere with legal marijuana businesses that are acting compliance with state law, so long as they strictly adhere to eight specific areas of concern such as preventing distribution to minors and cultivation on public lands.  Jeff Dorschner, spokesman for the U.S. Department of Justice in Denver said that “there are strong indications that more than one of the eight federal prosecution priorities identified in the Department of Justice’s August guidance memo are potentially implicated.”  Two of those violations appear to include trafficking marijuana outside of states where it has been legalized and money laundering.  No arrests have been made in this case as of yet.

Many of the locations raided on Thursday had multiple marijuana-related businesses at a single address.  According to the Denver Post, “Investigators believe the businesses that were raided are all “one big operation…[and that] those targeted in the raids had been actively purchasing area dispensaries and growhouses over a sustained period of time.”

Juan Guardarrama, One of the named targets, is known to have a criminal history with potential ties to Cuban and Colombian drug gangs, according to the Miami Herald.  In 2012 Guardarrama, who is also referred to as “Tony Montana” from the Al Pacino movie “Scarface,” asked undercover police officers to transport his CO-grown marijuana to Florida and?to?”take out”?his?partner.  He pleaded guilty earlier this year in Miami in a racketeering case.

This case clearly has a lot of moving parts, and more information is needed to understand the full scope of the situation.  But, if evidence proves that there have been large-scale violations to any of the recent DOJ memo’s eight areas of concern, one can’t be surprised that the federal government would act in accordance to its own guidelines.  As more information emerges, the public will get a better understanding of the story and the alleged players involved in this operation.

  2. I stated this as soon as I heard the news. This is the way its been ever since medicinal marijuana laws changed. The government only messes with the bag people who don’t deserve to ruin it for everyone else. I don’t live in a medicinal state [yet] but if people keep making this ugly and about gangs and money laundering then I’m not going to hold my breath. Hope any innocent do gooders make it out unscathed.

    Legalization without cartels will only work when all states legalize. But there may be a silver lining in this story if legitimate, tax paying businesses were spared while the DEA focuses on what they should; illegal international black markets created by drug prohibition prioritizing enforcement over treatment and weak sanctions on countries like Cuba that can turn around and trade with anyone else. In other words, end prohibition worldwide so the DEA can stop being the world’s cartel and just defend legal commerce from criminal exploitation.

  7. The Feds seem to have a “shoot first, sort out the facts later” policy when dealing with marijuana. Instead of raids and seizures before the facts are known, why not serve these folks with some kind of summons to answer questions? If marijuana was radioactive and a dire threat to the public, I could see the sense of such dramatic action.

  10. Yet here I am in Idaho with the Mexican Mafia running a muck next door. Trafficking large quantities of Meth, Cocaine, Heroin & Fueling property crimes and violence. I have ignored this for years until they could no longer keep it on their property. So I went to the law enforcement, then the prosecutor, then the county commissioners. Now my husband is in jail because he was propelled to flee with our children for our lives and fell causing scrapes after asking for help from the other neighbors and he is being charged with multiple misdemeanors and 2 felonies. Yet my family had to abandon our home with deed in hand to flee the constant threats of the neighbors. We also have no way of freeing him because the bond is so high. Why can’t this neighbor be charged after all we have him on camera because he is golden or What? I am at a loss as why they continue to target cannabis users and not real dangerous mobster and gangs like my neighbors

  11. It’s good that this guy got arrested because it sounds like he was trying to cut everyone’s throat. It looks like he was buying up shares in a pot business instead of doing it legit.   12. I believe we should keep our cool about things like this…Our Federal Government is set in place to uphold the law. I believe they are only doing their job and following through with the law….Take marijuana out of the picture and put something like traditionally prescribed drugs in its place… It is legal to take them if prescribed…It is legal to buy them from a licensed pharmacy if prescribed. It is illegal for the pharmacy to manufacture and sell prescriptions in any way other than by laws set. If this guy is bending the rules to profit from or allow holes in the industry, he deserves to be in trouble… If we want our rights to this freedom, we need to recognize the repercussion of someone getting caught for breaking the law and accept that it is not us upholding the law causing trouble…Let the feds do their job…Just keep educated on your rights and don’t step out of the boundaries.   15. I had the feeling that the long list of restrictions the DOJ had made was a set up. It didn’t long for the DOJ to act upon it. So I guess, Juan Guardarrama did it for the DEA. Isn’t that how they do it?

  16. As time goes on, this is going to happen. They will keep looking for violators of their guidelines. It’ll take some time, but as more states legalize, this will happen less as often.
    This is only the beginning of some craziness, that’s going to happen more and more for awhile. I can’t wait until the Feds find themselves overwhelmed, and then eventually have to change the laws on a federal basis.

    Hm. The feds are kind of dumb, as they seem to not be following legalization very well here in a lot of ways. They ought to just to it on a federal level.

  17. they were doing their job! this guy was shipping weed illegally to Florida and laundering the profits through his dispensaries…he deserved to be busted! what he did was illegal, even in Colorado. i suppose you stoners would have dispensaries be completely immune to any and all laws…who cares what they do right? bars still get shut down everyday because they serve booze to minors or don’t report their income properly…it’s the way of the world.

  19. Let’s all pause for a moment and thank the accused. The legalization movement has been born on the backs of those who dared to ignore the prohibition laws for the last few decades. NONE of them deserve prison for the simple act of possessing a plant. Look around you…public opinion has changed. YOU HAVE LOST THE WAR.   21. I live and work in the mmj industry here in colorado. Unfortunately, alot of dispensaries that I grow for our a little shady. The owners that I work for also come from south florida and even have a trim manager that was arrested for cocaine distribution. Who do you think is interested in starting a dispensary ex-coke dealers who were able to legetimize their money. There are alot of players here from south florida, thats who is attracted to this industry.

  23. Law enforcement is still hauling runners down in Idaho, another one just yesterday. Guy was from Billings Montana. he was caught with weed, hash, and mushrooms. Heads up Norml a news report here in South East Idaho says law enforcement, the Bear River Task Force is working on a lawsuit claiming that people trafficking drugs through Idaho are illegal profiteers out for personal gain breaking federal law and causing trouble in Idaho. Its a good bet that an attempt will be made by the states of Idaho and/or Wyoming to shut legal Washington, and Colorado marijuana businesses down. If you plan to travel in Idaho be careful in the area of American Falls. Dishonest Idaho law enforcement will claim smelling marijuana even when they don’t then demand a search.
    Tip: when you load a pipe or roll a joint, and enjoy marijuana its a good bet that 99% of the smell is on your hands. If you must go out in public after toking up simply wash your hands.

    Thanks for the final Tip. Another example why “rolling a joint” is obsolete, even post legalization.

    Serving one (1) 25-mg single toke with a one-hitter reduces this hazard (though maybe not in any-excuse-to-search Idaho). Afterwards breathe in and out of a “disposable” paper bag (breathbonnet); if no water nearby, carefully suck/tonguewash every finger ten seconds or so (rotating tongue around finger in direction of grooves). (Ingesting minute quantities of whatever else is on fingers is not unhealthy, quite contrary, forget taboos about germs.)

  34. Let’s think about this for a second. If they know that this man committed these crimes why in the world has NO ONE BEEN CHARGED????? Does this make sense to anyone? All I know is that the asset forfeiture laws are in full effect and this has to stop. It’s like shooting fish in a barrel. Allow dispensaries, allow them to pay state and federal taxes and when they get to be one of the bigger dispensaries….. the DEA goes in with their face masks and semi automatic weapons smashing in the doors and taking EVERYTHING AND CHARGING NO ONE!!! They take all the money, cannabis, computers, houses ect. Then the state cops get 80% of that money and the DEA get’s 20%. Again all while arresting no one. Sounds like a gang to me!
