Plaintiffs are seeking to permanently enjoin federal agencies from providing hemp-derived products to Medicare beneficiaries.

Most products contained THC percentages exceeding legal limits and half of the products tested positive for the presence of lab-produced cannabinoids.
The provisions target products containing delta-8 THC and similar compounds, as well as products that are synthetically derived from hemp.
Consistent with findings from other jurisdictions, most unregulated hemp products tested positive for levels of THC exceeding current federal guidelines.
“The state need not provide just compensation every time it adjusts its regulatory scheme, even if those changes incidentally impair or even destroy the businesses of some,” the Court ruled.
The decision reverses a lower court’s preliminary injunction halting state officials from taking legal actions against intoxicating hemp providers.
“Regular 3-month application of the emulsion based on cannabis sativa L. oil considerably reduced inflammation, erythema, pruritus, and scaling of the skin,” investigators concluded.
Researchers said the study’s results indicate “widespread noncompliance” with state and federal laws.
