EMPLOYMENT PROTECTIONS FOR OFF-THE-JOB CONSUMPTION

  • Yes, existing state law prohibits certain employers from either refusing to hire, or from disciplining existing employees, for their off-the-job use of “lawful consumable products.” The new law now includes cannabis and hemp products among the list of state-defined “lawful consumable products.” By contrast, employees who either possess or use cannabis during work hours, or who are under its influence, can still be sanctioned.
