See No Evil, Hear No Evil, Speak No Evil

Meet Hawaii’s Republican Governor Linda Lingle. On Monday, Gov. Lingle vetoed Senate Bill 1058, which called on the legislature to merely study “issues relating to medical cannabis patients and current medical cannabis laws.”
Specifically, SB 1058 called for the formation of a legislative task force to:

(1) Examine current state statutes, state administrative rules, and all county policies and procedures relating to the medical marijuana program;
(2) Examine all issues and obstacles that qualifying patients have encountered with the medical marijuana program;
(3) Examine all issue and obstacles that state and county law enforcement agencies have encountered with the medical marijuana program;
(4) Compare and contrast Hawaii’s medical marijuana program with all other state medical marijuana programs; and
(5) Address other issues and perform any other function necessary as the task force deems appropriate, relating to the medical marijuana program.

In her veto address, Gov. Lingle alleged — laughably — that the mere act of examining the medical marijuana laws of Hawaii and a dozen other states violates federal anti-drug laws.

“I am returning herewith, without my approval, Senate Bill No. 1058. … This bill establishes the medical cannabis task force … to review issues related to (Hawaii’s) medical marijuana program and make recommendations for any proposed legislation and rules. … The medical task force is unnecessary because it would attempt to deal with issues raised by medical marijuana users that can only be addressed by circumventing federal law.

Keep in mind that just days earlier lawmakers in Rhode Island overwhelmingly approved legislation to allow the state to license nonprofit facilities to produce and dispense medicinal cannabis to qualified patients. Yet in Hawaii the Governor would have us believe that just gathering feedback from patients and local law enforcement regarding the state’s nearly ten-year-old medical cannabis program somehow violates federal law. It’s an absurd position and no doubt Gov. Lingle, who vetoed a similar task force bill last year, knows it.
Of course, the true motive behind Gov Lingle’s action — and the similar actions of her fellow prohibitionists — is to silence any sort of public or political debate surrounding America’s failed marijuana policies.
This was the motivation behind President Obama’s decision to ‘laugh off’ the issue of marijuana law reform during his online town hall this past March. Silencing free speech was also the driving force behind the actions of members of Congress who earlier this year threatened to withhold funding from the city of El Paso, Texas, if they so much as dared to hold an “honest, open national debate” regarding US drug policy. And surely this was the motivating force behind a South Dakota Judge’s decision this week to bar longtime NORML advocate Bob Newland from engaging in any public advocacy of marijuana law reform for one year. (Full disclosure: Bob Newland, under the banner of SoDakNORML, had been leading the petition drive to place a medical marijuana initiative on the 2010 state ballot. In other words, Judge Delaney’s decision isn’t simply limiting Mr. Newland’s constitutional rights to free speech, it’s also potentially limiting the voting rights of all South Dakotans.)

Today in California television ads were slated to begin running in support of Assembly Bill 390, the Marijuana Control, Regulation, and Education Act — which seeks to legalize, tax, and regulate the retail sale of cannabis to adults in California. I say “were” because many major television outlets have refusedwithout comment — to air the television spots. Keep in mind, this network blackout is taking place in a state that has already established a regulated market for the distribution of medical cannabis, and whose voters solidly support legalizing the personal consumption of pot by adults.
Frustrating? Most definitely. Disillusioning? Not really.
Prohibitionists will use any means necessary to stifle honest, open debate because they know that they have no legitimate basis to defend marijuana prohibition. Their ardent refusal to even discuss the issue — and their strong arm tactics to intimidate others from discussing it as well — confirm this fact.
Nevertheless, despite their underhanded stalling tactics, the ‘national debate’ that the prohibitionists have so long feared has already taken place. Granted it did not take place in  public forum; rather, and more significantly, it took place in the hearts and minds of the American voter. And we won — hands down. We know it and our opponents know it.
And so does Gov. Linda Lingle.

Hi there – If you have made it down the scroll this far (lots of compelling things stated above), I will mention one more factor about who else has a vested interest in prohibition besides the pharmaceutical companies and the law enforcement agencies who stand to lose $$$ if cannibus were legalised.
    I’ve been informed that pot was forbidden in the the 1930’s because companies like Dupont wanted the hemp plant outlawed and used a major propaganda campaign with the aid of the Hearst publishing empire to scare most people into “reefer madness”. Today hemp is a sorely needed plant and the oil from its seeds provides a sensible alternative to petroleum. Are you aware how much this would effect our depency on foreign exported oil and the wars we fight over it if we started powering engines with hempseed oil? Not to mention the effect it would have on global warming.
    You know I’ve been saying the mess that we are all in is what happens when greed and stupidity get into bed together – And they make a very ugly baby!

    In my opinion hemp and the likes’ thereof will work itself out on its own, come out in the wash so to speak.
    Just leave Mary Jane alone…leave her out it; concentrate on the stark reality of hard manufactured drugs’ entity thereof too.
    I own one-third of an acre (so lucky still). The Church helped me keep my place of course.
    My trees are about 100′ tall some a century old or more. Kind of like me and my house – oh I’m only a half century old.
    I have a ton of fruit of all kinds each season now too. y-m-m-m organica rocks! I even got into canning my ‘maters and cherries, etc. too. Love it!
    I think we should outlaw mowing lawns entirely*!?><!* mine’s all crabgrass now anyway and very ugly no matter what I do. I’ve given up on it in fact this year.
    We had an unusual amount of rain here in this high mountain desert valley in June. I’m so glad I forfieted use of irrigation any longer. It’s a total waste of people’s time and money to cut and water cut and water cut and water WHAT? Maybe herein lies another grassroots’ movement…lawnmowers are one of the biggest sources of greenhouse gas emissions.
    I want to move to Hawaii…smile. Now I’m a dreamin of the islands I’ve never seen. My kids have (been around the world). I can picture that the flowers and such flourish too just like Spain where my Husband is from. We are divorced.

I’m vacationing in Hawaii right now on the beautiful island of Kaua’i and I have to say it makes me furious to think such an amazing place has such a bigoted leader. The Hawaiian islands have been cultivators of Pakalolo (Cannabis) for decades if not centuries and for some shortsighted cunt to take that away is despicable.

Well – while I would like to see marijuana legalized, her point is perfectly valid (if not, from a weak stance), that, until the Federal Government (which trumps state laws), repeals some of their existing legislation, her defying that position is merely going to take more time and tax payer dollars.
    So – my vote is to get rid of the federal legislation first, and then let the states decide how they want to manage the prohibition/marijuana debate.

    I stood alomost naked at the Salt Palace in 1974.
    I only wanted to be a ramp model.
    I was thrown into the Miss Utah/U.S.A Pageant/Universe.
    My first nervous breakdown was inflicted upon me then by people, Nixon, watergate, mother, friends, family, and the expectation of me to be a piece of meat then.
    To help promote a phony charade of reality.
    For two straight years in 1974 I literally could not utter a word. I ran to L.A.
    The stark contradiction then in my mind was the still eary era of up-front footage of you guys in combat splattered across daily t.v. every day day after day like mind numbing the numb.
    I was just a baby, so were you.
    I could not comprehend then that if we cannot even trust our own president then who in the fuck do we trust?

    You saw the destruction of the American Dream with record number of divorces…most likely caused by the new wave of sexual freedom. Divorce caused more trauma to a young or even older children than any other thing you saw. You were called the “SHOPPING BAG BRIGADE” You saw little kids going back and forth to parents with there shopping bag suite cases
    You saw everything there was to see. and more. You saw what you didn’t want to see…in your formative years. YOU WERE TRAUMATIZED by the T.V. which in many cases was your babysitter.
    For that I apologize. I wish I didn’t have to apologize…but…I have a conscience, and that’s the least thing I have to offer you…and…I only hope that you can find it within your heart to at least understand that the trauma was inflicted on everyone
    …children and adults alike. But that’s no excuse because it was our responsibiltiy to protect you from that trauma…and…quite frankly we failed.
    I’m so, so sorry you had to go through the X-decades and witness all of that traumatic crap.

    A BILL FOR AN ACT
    RELATING TO CONTROLLED SUBSTANCES.
    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
    Part I
    SECTION 1. (a) There is established a medical cannabis task force that shall be placed within the department of public safety for administrative purposes. The purpose of the medical cannabis task force shall be to review issues relating to the medical marijuana program. The director of public safety shall be responsible for administering the work of the medical cannabis task force. The medical cannabis task force shall:
    (1) Examine current state statutes, state administrative rules, and all county policies and procedures relating to the medical marijuana program;
    (2) Examine all issues and obstacles that qualifying patients have encountered with the medical marijuana program;
    (3) Examine all issue and obstacles that state and county law enforcement agencies have encountered with the medical marijuana program;
    (4) Compare and contrast Hawaii’s medical marijuana program with all other state medical marijuana programs; and
    (5) Address other issues and perform any other function necessary as the task force deems appropriate, relating to the medical marijuana program.
    (b) The medical cannabis task force shall consist of thirteen members as follows:
    (1) The director of public safety or the director’s designee;
    (2) The director of health or the director’s designee;
    (3) The director of transportation or the director’s designee;
    (4) The attorney general or the attorney general’s designee;
    (5) The chairperson of the board of agriculture or the chairperson’s designee;
    (6) The president of the Drug Policy Forum of Hawaii or the president’s designee;
    (7) One medical cannabis advocate who is a patient that uses cannabis in a medically authorized or recommended manner to be appointed by the governor;
    (8) A physician who authorizes or recommends the use of medical cannabis that is nominated from a list jointly submitted by the senate president and speaker of the house of representatives to be appointed by the governor;
    (9) A Hawaii-licensed physician who specializes in pain control and has issued a medical cannabis recommendation that is nominated from a list jointly submitted by the senate president and speaker of the house of representatives to be appointed by the governor;
    (10) The president of West Oahu Hope for a Cure Foundation or the president’s designee;
    (11) The director of Americans for Safe Access – Honolulu Chapter, or the director’s designee;
    (12) One registered caregiver to be appointed by the governor; and
    (13) One representative of the American Civil Liberties Union.
    (c) The members of the task force shall select a chairperson from among its members, who, in conjunction with the director of public safety, shall establish task force procedures, including the meeting schedule, voting procedures, and member duties.
    The members of the task force shall serve without compensation, but shall be reimbursed for necessary expenses, including travel expenses, incurred in the performance of their official duties.
    (d) No later than August 30, 2009, the legislative reference bureau shall complete and submit to the task force a report on the policies and procedures for access, distribution, security, and other relevant issues related to the medical use of cannabis for all the states that currently have a medical cannabis program.
    (e) The director of public safety shall submit a report of the medical cannabis task force’s findings and recommendations, including any proposed legislation and rules, to the legislature no later than twenty days prior to the convening of the regular session of 2010.
    (f) The medical cannabis task force shall cease to exist on June 30, 2010.
