Cincinnati City Council To Suspend Marijuana Recriminalization Law

Cincinnati City Council members are expected to vote 5 to 4 on a 2011 budget plan that repeals the city’s four-year-old marijuana recriminalization law. Council members’ decision to suspend the law is one of several cost-cutting measures that will be enacted in the new budget.
Under Ohio state law, the possession of up to 100 grams of marijuana (approximately three ounces) is classified as a ‘minor misdemeanor’ punishable by a $150 fine and no criminal record. However, in 2006, Cincinnati council members enacted a separate citywide marijuana ordinance making minor marijuana possession offenses punishable by up to 30 days in jail, a $250 fine, and a criminal record. Statistics released shortly after the law’s passage reported that the ordinance failed to reduce criminal activity and drug tourism within the city, but did significantly increase local law enforcement costs. Nonetheless, council members voted 7 to 2 in 2007 to make the municipal ordinance indefinite.
By repealing the ordinance, local police and prosecutors will once again have to apply the state law to defendants found to be in possession of marijuana within the city limits.
The Cincinnati City Council is expected to finalize the vote on Thursday, the Cincinnati Enquirer reports.
In recent months, the cities of New Orleans and Philadelphia have enacted municipal proposals reducing minor marijuana offenses from criminal misdemeanors to summary (non-arrestable) offenses. In California, legislation reclassifying the possession of up to one ounce of cannabis from a criminal misdemeanor to a civil infraction became law on Saturday.

  1. Anyone who possesses drug paraphernalia in Ohio needs to understand that it is a criminal offense! So it’s a non-criminal offense to have a joint or blunt, but it is a criminal offense to have a pipe, bong, etc, and you can be arrested for that.
    Still, I’ve lived throughout Ohio and I’ve noticed most cops are not too concerned with busting people for pot.

    The sheer lunacy of telling people they must pay money, face jail or lose their property for the “crime” of owning themself over a plant is very telling. We are advanced technologically, but this is still a very primitive society relying on force rather than intellect and free choice to determine outcomes.
    Legalization wouldn’t be an issue if people really knew anything about respect for others and freedom of choice.
    Legalization of cannabis is about much more than the plant itself. Either you own yourself or you don’t, WE DON’T. This IS still a SLAVE society in many aspects.

  13. Somebody correct me if I’m wrong but in Ohio, a baggy with weed in it, joints, blunts are all considered drug paraphernalia correct?
    So when the ordinance is repealed, to only get hit with the 100$ penalty, you would have to have weed on you that is not in a container and also not have any paraphernalia on you.
    How would it work for making baked goods with thc in them? Say I have a weed brownie in a baggy, would that be considered paraphernalia? I would imagine that would be the case.
    I support the repeal of this as I’ve been punished by the ordinance twice in fact. I’m not going to complain since its better than what it is currently.
    I will say though that I think the paraphernalia laws make no ethical sense when compared to the law for possessing marijuana in Ohio. Maybe its just the way the government works. Maybe they are trying to sneakily get you for paraphernalia possession by having such a weak punish for possessing marijuana in low quantities.

    #16 and even more ironic, you can legally PURCHASE said parapherniala and they can legall SELL it, but once it’s been touched by the resin for which you would get a civil infraction is when it becomes “paraphernalia.” Fucked up laws.
    I’ve never been caught, never come close. and I’ve smoked pretty openly, in parks, waiting for a bus, sitting on a ramp hitchhiking….it’s all a stupid waste of time and money and resources and human life.

  16. I don’t understand why Alcohol is legal and pot isn’t. The only thing I can think of is that the government isn’t getting tax money for it. I know gambling was illegal for years because the government couldn’t tax it. Now it’s legal why? Because the government is getting tax money for it. It’s a sad day when you get a bunch of buracrats making up rules as they go along. Turning innocent people into criminals.

    I’d like to correct this story. The City Council DID REPEAL our Marijuana Ordinance on Dec 30th during their emergency budget hearing for 2011!
    It was a 5-4 vote! In fact, the deciding 5th vote was from Councilman Cecil Thomas who’d pushed the law through in 2006, one year after former Councilman David Pepper had tried and failed in 2005.
