Federal Legislation Introduced To Exclude Cannabis From The Controlled Substances Act

take_actionRepresentatives Tom Garrett (R-VA) and Tulsi Gabbard (D-HI) have introduced bipartisan legislation in Congress to exclude marijuana from the federal Controlled Substances Act, thus providing states with the exclusive authority to regulate the plant how best they see fit.

The “Ending Marijuana Prohibition Act of 2017” removes the cannabis plant from the CSA so that it is no longer scheduled under federal law. This legislation gives states the power and flexibility to establish their own marijuana policies free from federal interference.

Individual states are “more than capable” of deciding their own cannabis policies, Rep. Garrett explained in a prepared statement.

According to polling data released last week by Quinnipiac University, 59 percent of Americans endorse legalizing the adult use of marijuana, and 71 percent of voters — including majorities of Democrats, Independents, and Republicans, believe that state governments, not the federal government, should be the ultimate arbiters of marijuana policy.

With the recent confirmation of militant marijuana prohibitionist Jeff Sessions to the position of US Attorney General, and with comments from the Trump administration warning of a coming federal crackdown in adult use states, our best defense is a strong offense.

Speaking earlier today before the National Association of Attorney Generals, Session’s doubled-down on his reefer rhetoricdenying scientific facts that legalizing cannabis access is associated with lower rates of opioid abuse (“Give me a break,” he responded) and urging state AGs, “[W]e don’t need to be legalizing marijuana.”

If the Justice Department won’t listen to reason, then we must take this issue out of its hands. Act now to pass the “Ending Marijuana Prohibition Act of 2017” to ensure that medical marijuana patients and others are protected from undue federal interference.

      1. Take a look at the latest 4473 form, and federal overreach as far as medicinal use of Marijuana started in 2016. It is a states issue and decisions, none of federal gov. business. We are probably in for another fight.

Everyone could just download an app that could verify the link’s authenticity and independent investigations would be triggered.         And then I remind myself that any accountability of an independent investigations always goes beyond the politician to the special interests who purchase them using the money from the consumers who purchase their products. A 3D hollogram video of someone dying on a respirator popping up next to Sessions while he talks with another video image of a healthy person consuming marijuana? Is that what our average attention tolerance for research has been reduced to?
        What really gets me is Sessions was the first Senator to endorse Trump and people I know who voted for Trump acted surprised when he was nominated to AG. Aspertame, nicotine and Fox “news” cause brain damage. I seen it.

        Look, I’ll take the “states’ rights” protections that we have, and I am grateful for them. But at the same time, I don’t wish to be guilty of situational ethics, and I think human rights and civil rights are far more relevant here… because states are like corporations — they’re legal fictions, which may (or may not) be necessary social constructs, but they certainly are not flesh-and-blood sentient beings! And so, their “rights” are largely metaphorical as well, and always less than that of an actual human being. Any “rights” states may have are derivatives of the rights of actual human beings.

        Politically speaking, I think we should support the rights of states like Colorado to legalize it, because that’s the law (and because my ass depends on it personally, I don’t deny it); but our primary arguments should go deeper — civil rights, human rights, and social justice.

      5. Once, years ago, a committed, life-long Republican, who also happens to personally support marijuana legalization, told me something that has been driving me nuts ever since. He told me, “I just think marijuana legalization should happen under a Republican administration.”

        In other words, for him, it was “R’s” before “MJ’s”. He is apparently willing to wait that long (fifty years, let’s say) for the Republicans to “come around”, rather than enable Democrats in any way. By his calculation, that was worth the wait.

        If that’s a view that is representative of the rest of the lot, then we’re not going to get a lot of help from the “R”‘s for the next fifty years or so, and therefore perhaps ought not waste resources trying to persuade them, if this is indeed the case. If this is true, we should consider all pro-pot Republicans merely Republican propagandists, who would be only using the issue of cannabis legalization as a vehicle to promote their white supremacist agenda.

        We should not be complicit in this.

      I think part of the problem is the way we think about medical issues as a society — as a question of disease or not, and if so, which ones.

      But the truth is, health is really about Wellness, not sickness. Wellness is the preferred option, as opposed to simply dealing with critical illness after it happens. I suppose I’m talking about Prevention, and this includes Prevention; but it’s even broader than that: Wellness.

      Even now, intelligent people of good faith are skeptical of the “medical use” of cannabis — “You just want to get high,” they will say. Or, “I don’t think you’re really sick.”

      But they are missing the fact that Wellness is the best choice. Not being critically ill is wonderful, no argument there; but that is not a reasonable threshold for cannabis use, which promotes Wellness.

Accepting anything less from our elected leaders, especially Congress, than making laws that reflect our best known peer-reviewed science is not “slander” much less being “Alpha,” buddy; failing to call out their lies is called being the Omega bitc# in a cabinet full of treasonous gangsters.   11. Hi all. As my final post on this article….just wanted to offer something that is helping me through these hard times—inspiring music. I listen to all kinds of music, all genres, currently, it is the powerful “Halo” by Beyonce, Heaven knows we and our brothers and sisters could all use an angel right now. Music truly relaxes the soul and calms the mind. And INSPIRES. So this is my last post on this article, but of course I will be watching for more news. But if you are feeling low, like I am during these horrible times for legalization, thinking of our friends in the shops and terrified of the crackdown, turn on some of your most powerful and inspiring artists. Call their local office. Visit their websites and track down where theyre going to be. Of course this is easier to do before an election and GOP Trump-chumps arent running like scared chickens from town halls like theyre on fire… but its very important to call our federal Congressman:

        Make it personal but respectful. Staffers dont get to read every email, they just feel compelled to respond after a dozen voting constituents send the same letter.

        Hell, Ive got to deal with Cruz and Cornyn. They respond to marijuana states rights letters with “I agree with the DEA.” (Hint: NOT a state agency Senators!) Theyre staffers dont always answer either: and when they do its Senator Cruz’s office! What can one possibly expect to credibly achieve? “Please tell the Senator not to flop like a spineless fish on mandatory minimums? Woops… too late.” No, it’s not easy being respectful to a guy who looks like he never got any in high school. Or college. Or… Congress. But we have to at least try so they know what respect IS. So call. Its fun to hear them studder and squirm at the word “marijuana.”

  16. It looks like to me that removing this from schedule 1 to a much lower class or even all together would be the focus of Normal. If it was the CONgress that passed legislation that put it there then focus on that committee to make the changes. If every member would donate $10 to that cause, funding should be sufficient to but their attention. All the yelling and screaming to just legalize it has gone nowhere. Maybe its time to focus on a better way.

  19. I have gotten long sought after seizure control with medical cannabis. I relocated to save my life. I was a refugee able to return home last year after my home state legalized. I found growing in OR to be both therapeutic and the only way to ensure my medicine was grown organically! All need access to this plant and the fact that the endocannabinoid system has now been located in all mammals we all deserve the right to easy and preferred access. If the federals government wanted control they should have rescheduled long ago. Rescheduling is the only right thing to do for patients in need!
