See No Evil, Hear No Evil, Speak No Evil

Meet Hawaii’s Republican Governor Linda Lingle. On Monday, Gov. Lingle vetoed Senate Bill 1058, which called on the legislature to merely study “issues relating to medical cannabis patients and current medical cannabis laws.”
Specifically, SB 1058 called for the formation of a legislative task force to:

(1) Examine current state statutes, state administrative rules, and all county policies and procedures relating to the medical marijuana program;
(2) Examine all issues and obstacles that qualifying patients have encountered with the medical marijuana program;
(3) Examine all issue and obstacles that state and county law enforcement agencies have encountered with the medical marijuana program;
(4) Compare and contrast Hawaii’s medical marijuana program with all other state medical marijuana programs; and
(5) Address other issues and perform any other function necessary as the task force deems appropriate, relating to the medical marijuana program.

In her veto address, Gov. Lingle alleged — laughably — that the mere act of examining the medical marijuana laws of Hawaii and a dozen other states violates federal anti-drug laws.

“I am returning herewith, without my approval, Senate Bill No. 1058. … This bill establishes the medical cannabis task force … to review issues related to (Hawaii’s) medical marijuana program and make recommendations for any proposed legislation and rules. … The medical task force is unnecessary because it would attempt to deal with issues raised by medical marijuana users that can only be addressed by circumventing federal law.

Keep in mind that just days earlier lawmakers in Rhode Island overwhelmingly approved legislation to allow the state to license nonprofit facilities to produce and dispense medicinal cannabis to qualified patients. Yet in Hawaii the Governor would have us believe that just gathering feedback from patients and local law enforcement regarding the state’s nearly ten-year-old medical cannabis program somehow violates federal law. It’s an absurd position and no doubt Gov. Lingle, who vetoed a similar task force bill last year, knows it.
Of course, the true motive behind Gov Lingle’s action — and the similar actions of her fellow prohibitionists — is to silence any sort of public or political debate surrounding America’s failed marijuana policies.
This was the motivation behind President Obama’s decision to ‘laugh off’ the issue of marijuana law reform during his online town hall this past March. Silencing free speech was also the driving force behind the actions of members of Congress who earlier this year threatened to withhold funding from the city of El Paso, Texas, if they so much as dared to hold an “honest, open national debate” regarding US drug policy. And surely this was the motivating force behind a South Dakota Judge’s decision this week to bar longtime NORML advocate Bob Newland from engaging in any public advocacy of marijuana law reform for one year. (Full disclosure: Bob Newland, under the banner of SoDakNORML, had been leading the petition drive to place a medical marijuana initiative on the 2010 state ballot. In other words, Judge Delaney’s decision isn’t simply limiting Mr. Newland’s constitutional rights to free speech, it’s also potentially limiting the voting rights of all South Dakotans.)

Today in California television ads were slated to begin running in support of Assembly Bill 390, the Marijuana Control, Regulation, and Education Act — which seeks to legalize, tax, and regulate the retail sale of cannabis to adults in California. I say “were” because many major television outlets have refusedwithout comment — to air the television spots. Keep in mind, this network blackout is taking place in a state that has already established a regulated market for the distribution of medical cannabis, and whose voters solidly support legalizing the personal consumption of pot by adults.
Frustrating? Most definitely. Disillusioning? Not really.
Prohibitionists will use any means necessary to stifle honest, open debate because they know that they have no legitimate basis to defend marijuana prohibition. Their ardent refusal to even discuss the issue — and their strong arm tactics to intimidate others from discussing it as well — confirm this fact.
Nevertheless, despite their underhanded stalling tactics, the ‘national debate’ that the prohibitionists have so long feared has already taken place. Granted it did not take place in  public forum; rather, and more significantly, it took place in the hearts and minds of the American voter. And we won — hands down. We know it and our opponents know it.
And so does Gov. Linda Lingle.

  1. Being that many states are courageously fighting prohibition (an unconstitutional and counter-productive policy which keeps drug dealers powerful and wealthy and denies patients their medicine), why are other elected officials still trying to silence us? Do they respect the 1st Amendment?
    I’ve said it before and I’ll say it again. Could NORML please compile a list of political candidates by state with their stance on drug policy so we can all make informed decisions on who to vote for and dump next election? I think if NORML, MPP, Drug Policy Alliance, LEAP, and ASA all put this info up, we could sway elections in our favor and end drug prohibition once and for all!
    [Editor’s note: Generally speaking, no such list exists as members of Congress rarely cast votes that have anything to do with cannabis, because, there are too few pro or con cannabis legislation that comes before them which inform the public of their views on cannabis (the last ‘indicator’ vote in the US House was two years ago for a medical cannabis-related spending amendment called Hinchey-Rohrabacher Amendment, which unfortunately lost 262-165).
    However, some of NORML’s interns this summer are researching and drafting a list of current federal policy makers using past votes, their constituency letters where applicable, written statements submitted for committee testimony, guest commentary/letters-to-the-editor and any other public (or private) communications that indicate whether or not they support cannabis reform. This lobbying list will be used by NORML’s staff as the current decriminalization bill moves slowly through the legislative process, likely, later this fall. The listing, when completed, will be published and broadcast by NORML via the Internet for all concerned citizens to employ in their lobbying efforts.]

I can never understand why Americans could vote for such a politician, who’s motivations, when it comes to the health and well being of a (albeit not SO large) certain number of her own constituents, could just blatantly disregard reality; especially when it will directly contribute to PAIN and SUFFERING of sick individuals who cannot get access to the medicine they need.
    Have you ever seen Spartacus Paul? Remember when he is taken as a slave, rowing on a Roman vessel? The historically unrealistic part (I am a Classics major, focused in Latin and Ancient Greek language, going on to a phd, eventually in Ancient Roman History) is that the Romans would NEVER use slaves on a ship to sail; it was a highly paid (relativily speaking) and highly trained position. Sailors would even have their own customized rows and seat cushions.
    Do you know what Linda Lingle would NOT want you to know? Roman sailors, as part of their routine workdays, would be given at least 3 breaks, accompanied by a tall hot glass of Cannabis tea; for relaxation of the muscles.

The world is looking to America to take the lead to some positive direction. I wish Lingle could at least consider it and we are no minority group either!

  38. A question I have is where the article brought up Rhode Island allowing “NONPROFIT” compassion centers. My question: why are state medical marijuana bills being forced to include a not-for-profit clause in the transfer and sale of cannabis? Why can’t people make money off of it? Why are we being denied to have a free market when the economy is shit? What is the problem with people making money of a legal, regulated cannabis market? The most obvious answers would be because of ‘compassion’, or not to make money off sick people. Ha, if that were REALLY a concern, then we need to look into the healthcare and pharmaceutical industries. The not for profit clause is just so the DEA and government still has reason to get their hands dirty in the business. If a dispensary is found to be making profit, the DEA then has a reason to rob them, er, raid them as they call it, and keep their money coming in from marijuana prohibition, even when it is not prohibited. And why does the DEA block FDA studies? Because they know when the FDA conducts it’s studies, they will find a massive amount of medical uses for cannbinoids found in cannabis. Drug companies will lose money. And rightfully so. Greed is the underlying reason it is still illegal. It is ALL about money. This lady from Hawaii was most likely paid off to veto this bill.

  40. It’s time to focus on Barney Frank’s legislation to get the feds out of the way. Officials are there to do the job but have bills of their own, many of whom are not independently wealthy enough to finance themselves if no longer in political office–politicians and robotic functionaries such as drug czars or flak groups.
    We need to get past the arm-twisting stage of now. Keep running the economy into the ground a while longer and maybe it will sink in to the rest of the American public to go for the savings and revenues from legalization.
    Any handbooks for county & local structuring of cannabis clubs for other states to use? Once the feds are out of the way, you won’t need much arm-twisting at all to have all levels of revenue from regulation varying from age limit to excise and permit models. People will want the guidelines to get things set up and going fast.

  45. Governors,like senators and state representatives are just as easily bought with big pharmacy lobbies and cartel money. Millions are changing hands keeping marijuana illegal. And I wonder what the Attorney General is making not clarifying the 5 month old but nobody knows what it is medical marijuana policy?
    If the feds would change the laws to accommodate medical marijuana,the gov wouldn’t have that rock to hide behind.
    The television ads may have been a purely economic decision,the possibility of losing those 4 or 5 pharmaceutical ads every night because they ran an ad for marijuana might have been strong armed by big pharmacy.

  46. As a resident of Hawaii, I have a ringside seat to this onesided bout. Not only has our Gov. vetoed this with all the wand waving of the Wicked Witch of the West, she still panders to her base. Even though she is not up for re-election. Lingle serves the Fed. The Fed. runs Hawaii. We are an extension of every brance of the armed forces and agency, dark or otherwise.
    Cheers to the Big Island for not buckling to this regime when they removed penalties for adult posession, growing and transfer of marijuana las Nov.
    On Oahu though, NO ONE is aware of this. Its well known, annecdotally, that old school corruption and glad handing is pervasive from the local select boards up through the Govs. office.

Thanks to the U.S.Navy I got a chance and would tell you that it ranks right up there with Thai stick ( which I also got to try thanks to the Navy). If they were to legalize cannabis in that state the revenue stream would be wide and very very long. Like California, cannabis could be one of the greatest commodities of their region ( like California wine or Kona Coffee).   54. I just got back from Hawaii on a vacation. Weed is easy there already. What Lingle does not get is that her policies are holding the native Hawaiian farmer back.
    The sugar cane business is the most part over. All Hawaii’s got is some pineapple. Their main trade is tourism. This are already slowing down in Hawaii with high oil and world recession.
    Imagine if Hawaii legalized cannabis like California is proposing to do? This would give Hawaii a new twist to visit her islands, like Vegas used to be in the day — that will attract normal people. Hawaii could be a perfect model, since their could also be drug free Islands too. She could legalize on the Big Island or Maui and leave the others out.
    Also, progressive States are passing medical marijuana laws at least. Could legal patients be importers (mail order customers) to Hawaiian bud and other products?
    This could give Hawaii a HIGH demanded crop that could give a boost to her local farms that often lay bare or derelict. Hawaiian farmers could have a legitimate, new (rare due to world laws) product that is slowly being legalized in the USA, and other places like Europe. There is a growing demand base here. But no one yet has a totally legal product that can be advertised and sold to an adult. The world is waiting to buy!
    Lingle is going to get lost in the old and white past. The Hawaiian citizen, especially native farmer, needs a boost to their economy, not a bust! She needs to get real about drugs like ICE that are dangerous and need to be stopped, not farmer cannabis.
    The people will vote this kind of slavery out. The future is legal cannabis. It’s just a matter of when and then where….
    Hawaii has a pearl with her famous climate and soil that produces some of the best marijuana in the world. Lingle is sitting on a gold mine and she won’t get real and do what other states like California and RI are doing best. Finally telling the Truth!

  62. I live in Hawaii and Lingle is just beyond words. To put it more into focus for everyone not in Hawaii, there’s a family that lives in one of the parks. They have been there for generations, and Gov. Lingle has been trying to get them evicted. People came together for the family and sang songs and such but the fact still remains the goevnor is trying to kick people off land that they have been maintaining for generations.
    Hawaii just now is getting hit by the economic crisis. We were fine up until this summer, because we rely on tourism as our main source of income. Im on the big island in Hilo and you couldn’t get a job washing dishes to save your life. The tourists just arn’t coming over and were suffering big time. Food was expensive before but its going up even more now.
    Now, instead of passing the bill and possibly finding a new source of income for the state, the govenor is taking about $160 million from the University of Hawaii school system. Not to mention the furloughs too. So now 3 days out of the week state employee’s wont be paid for working. Some people are even talking about closing the schools for 3 days out of the month.
    In my opinion it seems that since Gov. Lingle knows she won’t be n office again, she’s has decided to go all out and skrew Hawaii over right up until she’s out of office because she doesnt have to look good to get re-elected anymore.

Hi there – If you have made it down the scroll this far (lots of compelling things stated above), I will mention one more factor about who else has a vested interest in prohibition besides the pharmaceutical companies and the law enforcement agencies who stand to lose $$$ if cannibus were legalised.
    I’ve been informed that pot was forbidden in the the 1930’s because companies like Dupont wanted the hemp plant outlawed and used a major propaganda campaign with the aid of the Hearst publishing empire to scare most people into “reefer madness”. Today hemp is a sorely needed plant and the oil from its seeds provides a sensible alternative to petroleum. Are you aware how much this would effect our depency on foreign exported oil and the wars we fight over it if we started powering engines with hempseed oil? Not to mention the effect it would have on global warming.
    You know I’ve been saying the mess that we are all in is what happens when greed and stupidity get into bed together – And they make a very ugly baby!

    We had an unusual amount of rain here in this high mountain desert valley in June. I’m so glad I forfieted use of irrigation any longer. Maybe herein lies another grassroots’ movement…lawnmowers are one of the biggest sources of greenhouse gas emissions.
    I want to move to Hawaii…smile. Now I’m a dreamin of the islands I’ve never seen. My kids have (been around the world). I can picture that the flowers and such flourish too just like Spain where my Husband is from. We are divorced.

    An indescribabely (almost) heavenly upbringing I was fortunate to have had.
    One beautiful sweet little tiny Church. I loved it and still do of course. The dozen or so surrounding homes were happy healthy and tightly knit.
    I have thousands of relatives here.
    It was always strange to me that our Church would keep getting out-grown it seemed year by year.
    So the little cute one was torn down.
    A bigger one replaced it; then it was torn down.
    A bigger one replaced it and just kept propagating itself.

    It started with the assassination of our President.
    When you assassinate your President, you assassinate democracy. “OH JOHN”
    TIME MARCHES ON!
    You were an eye witness to the first televised war.
    Before that…it was forbidden to show a dead American soldier. But because of the wonders of T.V. or the propaganda box…you counted body bags at the dinner table, even naked little girls running down the road screaming, or perhaps monks torching themselves. All of which boosted the news department’s ratings.
    TRAUMATIZRD TRAUMATIZED TRAUMATIZED
    You saw dad burn his draft card.
    You saw mom burn her bra.
    You saw bro and sis burn the American flag, and an effigy of the President.
    You saw someone burn the ROTC building at Kent State…then…some American soldier shoot the kids DEAD.
    You saw wars at home on everything but the kitchen sink. The war on this…the war on that…the war on ourselves.
    You saw hits on Martin Luther King, Bobby Kennedy, and George Wallace.
    You saw every major city in the U.S. go up in flames…and…rioting in the streets. You saw the 2nd American Revolution.
    You saw blacks, whites, protesters get their heads caved in, or bitten by dogs.
    You saw sex, DRUGS, and rock’n’roll. (You notice I capitalize DRUGS).
    You saw the destruction of the American Dream with record number of divorces…most likely caused by the new wave of sexual freedom. Divorce caused more trauma to a young or even older children than any other thing you saw. You were called the “SHOPPING BAG BRIGADE” You saw little kids going back and forth to parents with there shopping bag suite cases
    You saw everything there was to see. and more. You saw what you didn’t want to see…in your formative years. YOU WERE TRAUMATIZED by the T.V. which in many cases was your babysitter.
    For that I apologize. I wish I didn’t have to apologize…but…I have a conscience, and that’s the least thing I have to offer you…and…I only hope that you can find it within your heart to at least understand that the trauma was inflicted on everyone
    …children and adults alike. But that’s no excuse because it was our responsibiltiy to protect you from that trauma…and…quite frankly we failed.
    I’m so, so sorry you had to go through the X-decades and witness all of that traumatic crap.
    Ya know…in the GOOD OLD DAYS…the news was only 15 minutes long…and…they used to apologize for this brief commercial interruption. I saw a blerp some time ago on T.V….a pop up that said “VIEWER MODIFICATION COMPLETED.” What’s up with that?

    A BILL FOR AN ACT
    RELATING TO CONTROLLED SUBSTANCES.
    BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
    Part I
    SECTION 1. (a) There is established a medical cannabis task force that shall be placed within the department of public safety for administrative purposes. The purpose of the medical cannabis task force shall be to review issues relating to the medical marijuana program. The director of public safety shall be responsible for administering the work of the medical cannabis task force. The medical cannabis task force shall:
    (1) Examine current state statutes, state administrative rules, and all county policies and procedures relating to the medical marijuana program;
    (2) Examine all issues and obstacles that qualifying patients have encountered with the medical marijuana program;
    (3) Examine all issue and obstacles that state and county law enforcement agencies have encountered with the medical marijuana program;
    (4) Compare and contrast Hawaii’s medical marijuana program with all other state medical marijuana programs; and
    (5) Address other issues and perform any other function necessary as the task force deems appropriate, relating to the medical marijuana program.
    (b) The medical cannabis task force shall consist of thirteen members as follows:
    (1) The director of public safety or the director’s designee;
    (2) The director of health or the director’s designee;
    (3) The director of transportation or the director’s designee;
    (4) The attorney general or the attorney general’s designee;
    (5) The chairperson of the board of agriculture or the chairperson’s designee;
    (6) The president of the Drug Policy Forum of Hawaii or the president’s designee;
    (7) One medical cannabis advocate who is a patient that uses cannabis in a medically authorized or recommended manner to be appointed by the governor;
    (8) A physician who authorizes or recommends the use of medical cannabis that is nominated from a list jointly submitted by the senate president and speaker of the house of representatives to be appointed by the governor;
    (9) A Hawaii-licensed physician who specializes in pain control and has issued a medical cannabis recommendation that is nominated from a list jointly submitted by the senate president and speaker of the house of representatives to be appointed by the governor;
    (10) The president of West Oahu Hope for a Cure Foundation or the president’s designee;
    (11) The director of Americans for Safe Access – Honolulu Chapter, or the director’s designee;
    (12) One registered caregiver to be appointed by the governor; and
    (13) One representative of the American Civil Liberties Union.
    (c) The members of the task force shall select a chairperson from among its members, who, in conjunction with the director of public safety, shall establish task force procedures, including the meeting schedule, voting procedures, and member duties.
    The members of the task force shall serve without compensation, but shall be reimbursed for necessary expenses, including travel expenses, incurred in the performance of their official duties.
    (d) No later than August 30, 2009, the legislative reference bureau shall complete and submit to the task force a report on the policies and procedures for access, distribution, security, and other relevant issues related to the medical use of cannabis for all the states that currently have a medical cannabis program.
    (e) The director of public safety shall submit a report of the medical cannabis task force’s findings and recommendations, including any proposed legislation and rules, to the legislature no later than twenty days prior to the convening of the regular session of 2010.
    (f) The medical cannabis task force shall cease to exist on June 30, 2010.
