Medical Marijuana's Great (And Odd) Midwest Test: Iowa

Iowa, America’s breadbasket, home to liberal scion Tom Harkin and conservative contrarian Charles Grassley, is vetting the issue of medical marijuana politically like no other previous state has by conducting a series of public testimonies, convened by the Iowa Pharmacy Board (who was ordered by a Polk County judge to do so in April in response to lawsuits brought by medical marijuana patients in Iowa against the IPB).

Two of the first four public hearings have already happened (August 19 in Des Moines and Sept. 2 in Mason City); the next hearings are:

October 7 in Iowa City and November 4, Council Bluffs

At the Mason City hearing on September 2, eight speakers, all but one in favor of medical marijuana law reforms, spoke out against the prohibition of medical marijuana in Iowa.

Des Moines resident and multiple sclerosis patient Ray Lakers, 42, who was jailed for possessing less than a gram of medical marijuana in 2005, spoke of medical marijuana’s utility and benefit to his life. Conversely, Maedene Sappenfield of Mason City spoke out against it in the Globe Gazette, “I have a son-in-law in North Carolina who has MS and he functions without marijuana very well, so it is possible.”

The IPB does not have the authority to legalize marijuana for medical use, but it could suggest to lawmakers to move marijuana to a schedule lower than I. In turn, Iowa lawmakers would have to pass amending legislation. An AP article indicates an interesting legislative challenge (some would say ‘poison pill’): “the [IPB] said that the drug [marijuana] would have to be used as treatment in all states for Iowa to reclassify it.”

  2. We had over 30+ speak in support and 2 detractors who had a different point of view afterwords. The first accoutn of 8 was based on # of speakers at lunch per registration #. I was #13 at 1:45 pm. Five people pre-registered for times also.

    (ABC 6 NEWS) — Should marijuana be legal for use to relieve the pain from some medical conditions?
    That’s the center of a debate-taking place right now in Iowa today.
    “There’s a lot of people suffering from chronic pain,” said Chris Young who is in a wheelchair.
    “It’s a constant pain in the right side of my body,” says Ray Lakers.
    Lakers and Young both suffer from pain.
    Lakers has Multiple Sclerosis and Young broke his back in a diving accident.
    They’re just two of more than a dozen who shared their medical marijuana success stories with the Iowa Pharmacy Board on Wednesday.
    Both Lakers and Young say marijuana works better than pharmaceutical drugs.
    “The relief it provided me was nowhere in comparison to relief and the benefit from using marijuana,” says Lakers.
    “To tell you the truth, marijuana is far more effective and has far less side effects than those medications,” says Young.

  4. Maedene i’m glad your son in law functions very well without using cannabis, I only hope that the drugs that he is using are not slowly killing him. Have you read the side affects of the drugs he is taking? Let us look at the side affects of cannabis. #1 An extreme feeling of happiness, and well being. #2 An increased appetite. Just what are the side affects of the usual drugs given for MS? I know a man with MS, he said the drugs given to him by the Drs pretty much turned him into a zombie. Then he tried cannabis, well lets just say he certainly didn’t look, or act like a zombie when I met him.

  5. If I sound stupid forgive me however, this is good news really. A Polk County judge made it happen after lawsuits – that sounds good to me. People are doing the right thing and keeping the issue in the faces of the nay-sayers.

    Apparently it was necessary to discredit Ray by telling everyone he was “jailed for possessing less than a gram of medical marijuana” while Maedene (perhaps busted for something in her past) was protected from mentioning that. Of course I don’t know if she ever was but my point is that Ray’s arrest did not need to be mentioned. This could have some believe he is a criminal that should not be taken seriously. I’m just sayin’.
    So Maedene says “I have a son-in-law in North Carolina who has MS and he functions without marijuana very well, so it is possible.”
    It boggles my mind when prohibitionists reason in this way. Do they not realize this argument is invalid?
    How about this Maedene:
    My father lives in Southern California. He has 4 vertebrates fused in his lower neck and he functions very well without Oxycodone or Vicodin, so it is possible.
    So he prefers taking a less damaging over the counter pain killer and live with some pain. That just happens to be his choice. If he prefers that or using cannabis or whatever to alleviate his pain it is his choice. The same should be allowed for people that prefer cannabis to alleviate their ailments whatever condition they may have.

    I will be going to the Iowa City hearings. I will let all of you know my thoughts on it at that time.
    One thing I do know, there are a lot of rec cannabis and Medical cannis supporters here in Iowa.
    More people smoke cannabis here than polls show too. I mean really. Would you answer truthfully on a poll if you thought there was a chance of the info getting out? NOO!! Many people here in Iowa only talk to those that are in the know.You never know where or who is watching or listening. This is more reason to legalize. We shouldnt have to be wondering who is watching. No wonder we are paranoid. We have to fear our government, thats tryanny …Not liberty or freedom.
    I look at prohibition like alcoholism.
    If your in it,unless you admit to its damage and try to change it, you deny its harms and wont listen to or accept reason.
    I sincerely hope Iowa becomes the next Med state. We should also concider legal hemp. Our food prices are much higher due to using corn in Ethanol. Hemp could replace all the ethanol production,make food cheaper as well as fuel. If none of ya have yet, go to the Iowa norml site. It shows the huge piles of hemp we used to harvest here.
    Its funny how veiws are changing. I ran into a couple in their 40-50’s yesterday. I had no idea I would end up into a conversation about cannabis and drug cartels. They had some idea of the truth of it all,but by the time I was done talking, they were shocked at the money cartels and terrorists make from our supporting prohibition and how the US forces its influence on other countries through prohibition. It was about a 45 minute conversation that was good.
    Any way, I’m looking forward to Iowa City next month. I imagine I will here many interesting conversations.

  17. There is a lot of confusion about what is going on in Iowa. In May of 2008, I filed a petition with the Iowa Board of Pharmacy to remove marijuana from Schedule I of the Iowa Controlled Substances Act because it has accepted medical use in the United States. That’s because 13 states have accepted medical use of marijuana since 1996. The Board said it wanted scientific proof. I’m sorry, but there’s no amount of science that can prove those 13 states have not accepted the medical use of marijuana. A Polk County District Court judge agreed with me on April 21, 2009, and ordered the Board to rule on my petition without any science. The Board again rejected my petition on July 21, 2009, saying the judge ignored the law. The judge has another hearing set for September 21, 2009, to review the Board’s July 21, 2009, ruling. The court did not order the Board to hold public hearings or to review the scientific literatue. The Board is doing that on it’s own because it is embarrassed I won in court. They are scrambling to find a reason to reclassify marijuana based on science instead of law. I don’t blame them for doing that, but NORML owes its readers the full explanation of what’s going on, rather than the smoke screen the Board of Pharmacy is throwing over it.

By the way …The Drug , Alcohol and Tobacco Companies have come out with a New propaganda / B.S. ad on the radio . It starts w/ a Mother telling her son that soon they will be doing Drug testing in his School . So , she asks him if he’s ever done marijuana ? She then says , cocaine , heroin , speedballs , etc .     It’s very simple. Marijuana has accepted medical use in the United States and no longer meets the statutory requirement for inclusion in Schedule I. The Iowa Board of Pharmacy cannot explain why it has not removed marijuana from Schedule I, because it should have removed it 13 years ago when states began accepteing it for medical use.

  27. You go R.O.E., I definitely like your style. If you don’t remember I’m one of those who won’t inhale because of the possible ramifications. It is really hard to abstain however, I do it.
    In addition to my comment (#31) this is my plan:
    Move to Portland Oregon, join the NORML Chapter there, retain a NORML approved lawyer and then get busy in whatever way NORML recommends or suggests. Talk, get in law makers faces, never stop. I will go beyond MJ advocacy and challenge Lobbyist’s as well.
    We may be moving come October/November. If that’s not possible then June. We’re saving our money now.
    BTW, we live in Utah. The Mormon’s have a strangle hold on this state and I really believe it’ll be one of the last states to accept MJ.

  28. Medical marijuana is real. I have Multiple Sclerosis, and went blind in 2003. High Steroid doses returned enough vision to walk, but I could not see colors, and had a blank spot in the middle with good peripheral vision. I started marijuana after not having used any since the 70’s. My vision eventually came fully back. Yes, it may have anyway. But I was blind, and have wanted to suggest others going blind from MS should try it. The difference for me, after 10 months, was full recovery. The doctors are afraid to take the concept publicly, but it helped me. There is some science behind this.

I would love to see this happen but i live in iowa and i am not very optimistic.The laws are very harsh here and dont see Iowa legalizing until 49 other states have done so.My mom suffers from fibromyalgia and we are thinking of moving to colorado to so she can get off of the pain meds shes addicted (and which the doctors are happy to prescribe)….but in my opinion this is all grand standing to avoid the lawsuit.Please god let me be wrong.

  34. Medical cannabis. It is usefull in treating many disorders/diseases. The only one I can confidently speak of is CANCER. I have treated, successfully I might add, two Basal Cell Carcinoma lesions on my head. The substance used to treat these skin cancer lesions was Cannabis Oil. It took 8 weeks of treatment to CURE these cancers. The ONLY side affect was a bit of itching, and some redness around the lesions. The redness faded shortly after the treatment was completed, and in over a year the cancer has NOT returned. This treatment requires no one to stick a needle into your flesh, and inject a rather painfull shot of anesthetic, nor does it require a surgeon to cut into your flesh with his scaple. I have had six(6) of these surgeries, perhaps I am a wus, I don’t know, but these surgeries were an absolute horror for me, especialy considering they were all on my head, neck, and face. Tell me Maedene which would you prefer, the needle, and the knife, or a small drop of cannabis oil placed on the lesion? God forbid, but someday in the future when a doctor stands ready to plunge a needle into you cheek as he did mine, might you not wish you had given this a little more thought?

That unjust law is prohibition. Wer are all…no matter who…no matter where…committed to our culture, which includes cannabis for religious use, medicinal use, and resonsible use by adults. We are an aggressive movement who’s intent is to return cannabis to its legal status, prior to 1937, and to regard cannabis as “DIVINE SANCTION.”
    On the merits of the argument…the law was created by greedy men with ulterior motives. The law regarding cannabis was created with deception and no substancial reasoning, other than to control the migrant mexican workers during the depression. We the People…regard that action as “voidable” under the circumstances. Prohibition of cannabis pumped up the newly formed Bureau of Narcotics coffers greatly…keeping it alive. Perhaps the biggest cause of prohibition was the special interests of certain individuals who would be adversely effected by its legal status. All in all…the reasons for its prohibition are flimsy at best, and don’t hold water in today’s society…in fact are a detriment to societies advancement. If we are talking about advancing society, this out-dated, nonsensical, unjust law is a major hurdle to achieving that objective. We will never advance by advancing prohibition. Prohibition is just a way for the King to tell the people what to do. But…the King is only the King, if he has loyal subjects. We are not loyal to prohibition, or nobility in this country. When the law does more harm than it does good…common sense dictates its change. It’s a choice of “ONE.” It’s a “MANDATE TO PERFORM.” If our elected
    representatives cannot see this, without our intervention, then those representatives need a change of scenary as well, as provided for in our Constitution…”WHEN IN THE DUE COURSE, IT BECOMES NECESSARY.”
    Therefore…we gather under the plain hunter green polo/T-shirt as our battle flag. We wear our colors proudly, and spread our message when ever questioned

  37. The FDA approved Marinol ( synthetic THC)to treat loss of appetite from chemo and wasting from AIDS. So why isn’t the natural form also acceptable as a medicine? Shouldn’t this cause the government to reschedule the natural form of THC? Where is Marinol on their schedule?

  38. The petition I filed in May of 2008 said that marijuana must be removed from Schedule I because it has accepted medical use in treatment in 13 states in the United States. I filed one with the Iowa Board of Pharmacy and the other with the DEA. The Iowa Board of Pharmacy ruled on my petition in October of 2008 and the DEA ruled on my petition in December of 2008. Both of them said that states don’t matter, only science. In April of 2009, a Polk County District Court ruled the Iowa Board of Pharmacy did not to see any science and told the Iowa Board of Pharmacy to rule on my petition without any science. In July of 2009, the Iowa Board of Pharmacy denied my petition again for the same reason and then announced these series of 4 public hearings and a review of the scientific literature. In the July Order, the Board said the Iowa District Court was wrong. The Iowa Distric Court has set another hearing for September 21, 2009. The Board is continuing with the hearings. So, Eric is right. The Board is just grandstanding. However, I still have them cornered and there’s no escape. They cannot explain why they are not obeying the law. The federal court of appeals just dismissed my case against the DEA saying I don’t have an injury that will be cured by a favorable ruling. My plan is to get the Attorney General of Iowa to file the petition with the DEA.

What i don’t understand is how that they can say that there is no science when there are hundreds of state of the art,double blind,pure reviewed,placebo controlled studies out there.Also organizations like the American College of Physicians,American Public Health Association,American Nurses Association and many others in favor of medical cannabis.Things like this makes me believe that there is other motives at work or personal opinions and ignorance are clouding the judgment of these so called medical professionals.In that case they need to be removed from their positions for the safety of Iowa patients.

    Eric, Here’s one of the ironies. They’re going to turn all of us into experts on this matter! I have to admit it’s a pure hassle that they expect each one of us to go on trial and be able to recite a litany of benefits, instead of just doing their homework and learning it on their own, but the upshot is they are bringing all of us closer together to scrutinize their crooked ways and causing all of us to learn way more than we ever anticipated about this issue/these issues.

I filed a petition telling the Board to remove marijuana from Schedule I because it has accepted medical use in the United States and the law clearly says anything in Schedule I must be removed if it has accepted medical use. The Board of Pharmacy violated a court order and decided to hold these public hearings instead of obeying the court. If you look into this a little deeper than it is being reported by the media, you’ll see something is going on here in Iowa that is extremely significant in the overall scheme of things. I’ve managed to get a court in Iowa to agree the Board of Pharmacy is disobeying the law. This is going to snowball. Get ready for the avalanche.

  50. NORML has tried the Roe v. Wade approach. See NORML v. Bell, 488 F. Supp. 123 (D.D.C. 1980). You’ll see that case cited every time someone tries to make this argument based on the right to control your own body. I’ve got the only legal argument that can tear this down, and I’ve already won a preliminary ruling in Iowa District Court. I go back to court on Monday, September 21, 2009, for round 2. The Board of Pharmacy says accepted medical use in the United States means all 50 states, 13 is not enough. We’ll see what the judge has to say about that. No state can every decide what the law is in another state. The Full Faith and Credit clause of the U.S. Constitution requires Iowa to acknowledge that 13 state have accepted medical use of marijuana and that makes it accepted in the United States as a matter of law. Watch and see.

Thirteen states say marijuana have accepted medical use in their states. Iowa law requires the Board of Pharmacy to make recommendations on changes to Iowa’s drug law annually. While thirteen states have enacted medical marijuana laws since 1996, the Iowa Board of Pharmacy has done nothing to correct the misclassification of marijuana in Iowa as having no accepted medical use in the United States. Obviously, the court order I got in April got their attention and now they are scrambling to hold hearing to determine whether marijuana should have accepted medical use in Iowa so they can avoid having to decide whether it has accepted medical use in other states. The Board of Pharmacy is boxed into a corner. They have nothing to show to explain how thirteen states “in the United States” have not accepted the medical use of marijuana. Watching them squirm is just a joy to behold. You should come to Iowa and see it for yourself. It’s an extravagancy spectacular and we are savoring every moment of it.

But no U.S. Legislative body, past or present, has the congressional privilege or right to abrogate the natural inalienable rights secured in the United States people based on distortions, fanciful conjecture, and intentionally misleading medical and legal information. No where in the people’s founding contact adopted by the people and sworn to by this elected government does it allow deception, criminal and civil fraud, intentional misinformation, purposely tainted testimony, and the denial of any expert testimonies as bases for granting any elected and sworn U.S. Legislative body present or past with the misuse of it’s privilege or right of abrogation which allows the outlawing of the inalienable rights of the peoples’ of these United States without proper due process of law.
    Therefore the foundation laid in Congress to abrogate the natural inalienable rights of the people lacked any real evident that the cannabis plant is or was, ever a safety issue which negatively impacted the health and welfare of the American Society, in part or as a whole. Furthermore, the U.S. Congress did not, can not, and still does not have the privilege or right granted in the United States Constitution to write any such legislation that would abrogate the American people from their natural inalienable rights to use the cannabis planet for reason of traditional medicine, or as a traditional food supplement, as an alternative fuel source, for the making of clothing, used as a replacement for wood, used in the making of traditional paper, and or for the peoples’ ancient spiritual, religious, or cultural practices of which is clearly protected for all time sake by our founding fathers’ constitutional preamble and the first ten amendments of the United States Constitution.
    Hence, the United States Legislative actions known as the Harrison Narcotics Act of the 63rd legislative session, the Marihuana Tax Act of the 75th legislative session, and the Comprehensive Drug Abuse Prevention and Control Act of the 91st legislative session and all those sub-action therein, which abrogate the natural inalienable rights of the people to have unfettered access to the cannabis plant is built upon a fraudulent act and therefore unconstitutional because these legislative foundations are based on fanciful propaganda which lacks any real legal scientific evident that demonstrates any negative impact on society by the use of the cannabis plant. The three legislative action listed above do adversely effect the safety and welfare of the America. These fraudulent acts of congress continue to harm the nation and drain the people of their valuable resources. Most importantly these acts have eroded the relationship between all three branches of government and the people they are suppose to represent.
    Our Federal Congresses in the above named sessions have acted upon the U.S. constitutional provision involving the American peoples’ natural inalienable rights and have unlawfully abrogated those natural unalienable given rights of the United States people based solely on questionable congressional witness testimonies, a bombardment of fraudulent media presentations, and grossly misquoted medical and legal data, of which is still pervasive today in the minds of the American people. There is however an overwhelming, and ever growing mound of world-wide scientific data that demonstrate to the contrary the fraudulent education material perpetrated upon our society as well as the 63rd, 75th, and 91st United States Congresses.     Does these acts of congress preserve the inherent & inalienable rights of the people? How are the inherent & inalienable rights preserved by the government for the people?   60. With all of the pharmaceuticals out there being used for off-label purposes, is the argument about needing FDA approval legitimate? I read a recent article which stated the results of a survey given to U.S. doctors about commonly-prescribed drugs. Upwards of 80% of the doctors surveyed could not name the on-label usage the drug was FDA-approved for. So we have doctors prescribing drugs that are “FDA-approved” for diseases they were never or not fully tested to be used for. What good is an FDA rubber stamp at this point? Combine this with the myriad of side effects many drugs carry, and one wonders how they were ever approved to begin with. The FDA approval process is severely flawed in that most of their funding comes from the companies whose pharmaceuticals the FDA is tasked with approving. The public’s safety is seriously compromised under this present model. As much as laws need to be examined, our country’s agencies and how they obtain funding. Without separation of the money from the science, there is no safety, and it is laughable that any reservations are voiced to medical marijuana based on the lack of FDA approval.

If you have a pill FDA-approved for such use (which, although it may improve quality of life in some aspects)why then is cannabis held to a different standard. It carries no such grave side effects, and its users are merely trying to better their quality of life to some degree, -sometimes to resounding levels of success. Just as it was deemed unconstitutional in Argentina to prohibit marijuana for personal use, the medical application and peoples’ desires to better their lives and medical conditions are a GOD-given right. Prohibition, especially when waged against medical patients, is unconstitutional.

  65. What you have to understand about what is going on here in Iowa is that we are in the process of evaluating the science. We don’t know what the Board of Pharmacy is going to say. If the Board says something like Judge Young said in 1988 (and the science has only gotten better and more favorable toward marijuana since then), we could see a bill to decriminalize marijuana and remove it from the Iowa Uniform Controlled Substances Act rather than make it available for medicine. Or, we could see something like a new Schedule VI instead of just 5 schedules. We really have no idea what we’ve got here until we see the report from the Board of Pharamcy. We are certainly not going to let marijuana be classified as a dangerous drug if the evidence doesn’t support that. In 1988, DEA Chief Administrative Law Judge Francis L. Young, said, “Marijuana, in its natural form, is one of the safest therapeutically active substances known to man.” A conclusion like that would certainly support removing criminal penalties for possession and distribution without profit, as the 1972 Presidental Commission on Marihuana found. The 13 states that have legalized medical use of marijuana have unanimously allowed patients to grow, possess, and distribute without profit, marijuana under a doctor’s supervision, so you can see that marijuana is being classified as something safer that the drugs in Schedule V of the state and federal controlled substances acts. I don’t think the nation realizes what’s going on here in Iowa. I’m not aware of any discussion of it at the recent national NORML conference and I doubt anyone will mention it at the Drug Policy Alliance conference in Albuquerque, NM in November. It seems to be completely off the radar of the drug policy reform groups.

  67. I do have them in court. The next hearing is Friday, October 9. The Board says the meaning of the phrase “accepted medical use in treatment in the United States” means accepted medical use in all 50 states. They are now holding hearing to determine whether marijuana has accepted medical use in the United States, which they have already said they will not do unless all 50 states accept it. The court is going to find that a state agency doesn’t have jurisdiction to determine what the law should be in another state. Marijuana currently has accepted medical use in 13 states in the United States and Iowa is not one of those 13 states. When the Iowa Legislature wrote our law, it made it conditional on what other states do by including “in the United States” in the language of the statute. The Iowa Board of Pharmacy is bound by that law and it must obey it.

    The “attitude” the state of Iowa takes is they are hiding behind state semantics, and have no where to hide when the Federal law trumps them.

  69. The Sept 21 hearing was continued to Oct 9. What does federal law superceding state law have to do with my case? Have you read my case. Have you read Garden Grove v. Kha and San Diego v. NORML? My case is about Gonzales v. Oregon, 546 U.S. 243 (2006). Read that case so you know what federal law actually says about state drug laws. The Iowa Board of Pharmacy tried to say federal law trumps them and the court ruled against them in April. Gonzales v. Oregon describes the concept of “federalism” where the states retain sovereignty to regulate the health and welfare of their citizens without federal interference. This is hot. Check it. Feel it. Taste it. Absorb it. Then, do it.

    MADD is NOT a government agency. MADD was/is a private organization bilking people out of money with the governments approval and rubber stamp (and several of their directs have been picked up on OWI’s)! I called the state and was told they have never sold any marijuana tax stamps in 15 plus years!   78. I am not a lawyer, to “do it” I would have needed to have been busted otherwise I would have no “standing”, therefore it would be a “moot” issue; but you already knew that? You could “do it” with someone who already has been busted.
    Instead of reinventing the wheel, a civil tax on those who are busted could be affliated with NORMAL, so what do you think you could acheive say with a budget of $50 million dollars a year towards decriminalization?

  83. We are exposing their corruption. The Iowa Board of Pharmacy has a duty to review the drug law annually and make recommendations for changes to the Iowa Legislature. The Board of Pharmacy has just sat on its hands while 13 states have enacted medical marijuana laws and haven’t even suggested reviewing marijuana’s classification in Iowa. That is a total breach of duty owing to the citizens of Iowa. They have been exposed and today they will be further exposed as a front for the big pharmaceutical companies to put profits ahead of the health and welfare of the Iowa citizens.

    Hope all is well at ground zero. Been kinda quite on the home front since the Iowa Board of Pharmacy lacks any crediability.
    I have been doing some work as it relates to Iowa’s use/abuse of administrative laws. They make claim that all 50 states must adhere to the same laws, when in fact they selectively abuse the constitution by claiming certain actions they bring against citizens are a “right” they have, as the levy is against abuse of a priveldge, not a matter of law; all the while individuals are also being prosecuted in a criminal court. FAR from 50 states abuse it’s citizenry this way…
    Too many constitutional issuses to list here right now. Simply put VERY few states adhere to this double prosecution standard. It originated in Louisanna under French/Cajun law…way out in the ozone law. Iowa uses it to generate cash flow at the expense of it’s citizenry…they levy HUGE fines and unequitable sentences as a DOUBLE punishment. Only about 4 states use such draconian means to fill their coffers.
    I may use the Iowa Board of Pharmacies ass backwards legal logic to attack the administrative laws in Iowa.

  85. Anything to do with controlled substances begins at the state level. Read Gonzales v. Oregon, 546 U.S. 243 (2006), and the appeal court and district court rulings in that case. It lays out the entire scheme of the federal drug law, which does not define accepted medical use. Accepted medical use is defined by the state. The first thing the Iowa Board of Pharmacy tried to tell me is that federal law prevents the state from rescheduling. Iowa rescheduled marijuana in 1979 and again in 1987, proving it knows damn well it is not bound by federal scheduling. They stepped right into the tar baby and got stuck. It was so easy, I didn’t even have to work hard to get them to expose their blatant ignorance of the law.

    Being a life long resident of Iowa I can tell you of the good ole boy rule here. Until the state is challenged it is business as usual to attach exorbinate fines, jail sentences way out of proportion to the offense, deny citizens protection under both the state and federal constituions. As I had previously mentioned their use of “administrative law’ and phoney marijuana “tax stamps” is but one of many…
    This goes in many directions, their “drug tax stamp’ to impose a “civil”/”administrative fine” on top of any criminal charges and/or fines is just one of many. They will impose a “civil” fine just because they say they can >> because you don’t have a permit which the disclaimer on the application form openly admits the tax stamp is worthless. Their intent is VERY clear here,to sell you a worthless piece of paper claiming to exempt you from “civil fines” all the while to bilk money out of people through duel prosecution.
    The Iowa DOT is even worse, you can be innocent in a court of law but guilty in “their” court and be fined, forced to jump through “their” hoops, lose you licence, pay huge insurance fees, with NO LEGAL STANDING. Their hiding behind driving is a priviledge BS. They make extreemely short appeal times (couple days), much like the federal conviscation laws. You are never allowed a court appearance, only a call in hearing with their judge who only works for them. “The fox guarding the hen house”.
    When you PAY for a licence, you PAY for state and federal gas/road use tax,you PAY for a rubber tax on new tires, you PAY for car insurance, you PAY for licence plates, this extends beyond a “priveledge”, it denies you the right to earn a living.
    The state receives $200 million plus a year in FEDERAL road use tax monies. There are no 50 state federal mandates allowing the DOT the “rights” above and beyond the law and the federal constitution; they claim to have the “right” to deprive citizens of their use of federally funded/supported transportation systems, all the while they are violating the federal constitution and grabbing all the federal dollars they can get their hands on to abuse and misrepresent the Federal constitution… Somewhat of a conudrum to the medical marijuana issue.
    Iowa is infamous for their abuse of “civil penalties” to rob the citizens into suppression; the DCI, DOT, DNR… nearly every Iowa state agency abuses the system.. This is their new TEA TAX/CASH COW system…
    ENOUGH IS ENOUGH… EVERY state agency in Iowa is deep in the tar, but way in the RED by incompenency… I am about as far to the right when it comes to love of this country but off the scale to the left when it comes to OUR inalienable rights as OWNERS of this country >>> time to take back what is already ours…

  87. I have an extremely narrow focus – marijuana. I’m sure that the Board of Pharmacy is not the only administrative agency abusing its power in the state of Iowa, but it’s the only agency I’m dealing with. I’m proving that you can hold them accountable, but it’s no easy thing to do. If you look at the amount of work I’ve put into this, you’re looking at the amount of work it would likely take to challenge any administrative agency in Iowa. If you feel up to the task, go for it. It won’t change unless people do something about it. I’m doing something about it. I can’t do everything. I’m doing what I think is a priority. I hear people talk all the time, but I don’t see many of them doing anything about it. People look at what I’m doing and start telling me all kinds of stuff I could be doing. Sorry, I’m just one person and I can only do so much. I hope my success will encourage others, but its taken me 30 years of legal research to get this far. You won’t just slap a legal argument together in a couple days. It takes a tremendous amount of work.

  90. I agree about the abuses of power, but I’m proving that something can be done about it. I won in court in April, and the Iowa Board of Pharmacy announced two weeks ago that it is going to recommend legalization of marijuana for medical use in Iowa. That’s a couple of victories in a row and I still have my civil case pending against the Board. If I can do all of that, then so can others. I’m proving that peaceful, non-violent resistance still works the way our founding fathers intended it to work when they established the form of government hoping that they had just fought a war that others would not have to fight again. I do have to fight, but my weapons are words not bullets.

    This significant issue is the bona-fide medical use of marijuana for pain relief and other benifits. The government don’t give a shit about your body or your rights to it. They see the individual as their cash machine. If you can make them money being alive, what good are you?
    This comes back to the bona-fide use as a medicinal treatment, even the DEA’s own judge has testified marijuana is the safest known form of treatment for a wide range of medical problems based on it’s THC, CBD, CBN and other components.
    There has never been one recorded over dose in recorded history due to marijuana, while the big drug companies kill a couple hundred thousand a year; both with prescription and over the counter “drugs”.
    The MLD for marijuana you would have to consume SIX (6) pounds orally or over 100 grams of pure THC. NEVER happened and NEVER will.

  108. Kind of reminds me of 1937 when the American Medical Association opposed the Marihuana Tax Act. Congress passed it anyway. And, again in 1972 when the Commission on Marihuana recommended decriminalization for person use and distribution without profit. Congress ignored the findings of the Commission. And, again in 1988 when the DEA’s Chief Administrative Law Judge said marijuana was extremely safe for use under medical supervision and the DEA Administrator rejected those findings. So, here we are in Iowa, in 2009 about ready to get a favorable ruling from the Iowa Board of Pharmacy and the Iowa Legislature says it will not consider legalizing marijuana for medical use in 2010. Deja Vu, isn’t it?

I have been studying state, federal, and international drug law for a long time and one of the things I’ve learned is that coca leaves and opium poppy are both in Schedule II even though they have no accepted medical use in treatment in the United States. The DEA claims they were put there because useful pharmaceutical drugs are made from them. When I suggested that Marinol could be made from marijuana, the DEA responded by saying that Marinol is made from synthetic delta-9-THC so it does not come from the marijuana plant. If you look at the scientific literature, it says delta-9-THC is the principle psychoactive ingredient in marijuana. It even says that in the Federal Register when Marinol was scheduled by the DEA (to Schedule II in 1986 and to Schedule III in 1999). And, of course, the HHS now has a patent on extracted cannabinoids since 2003. So, the case for removing marijuana from federal Schedule I has been strong since at least 2003, if not 1986. This AMA recommendation should be the final piece, but I’m not sure the DEA will just do this voluntarily. It would be really great if some brave state filed a notice with the DEA telling the DEA that marijuana now has accepted medical use in treatment in the United States, and that it no longer meets the requirements for inclusion in Schedule I. The federal law says “in the United States” and the last time I counted there were 50 of them. One of those states should step forward and assist the DEA in doing the right thing.

IMO, alcohol is a far more serious problem here than weed, and it is basically promoted and often cops look the other way when it comes to drunk drivers and public intox, people don’t like to ruffle feathers in Iowa, but I truly believe if we were allowed to have a public vote, marijuana would be legalized. Think of the tax revenue, people, think of putting the dangerous people that use dangerous drugs in jail, not the pothead down the street who will never hurt anyone or steal anything. Maybe, drugs like meth would become less of a problem here if everyone was allowed a safer, alternative like pot to get their high. I think if we don’t resolve this issue soon, there will be an even worse migration of young people out of this state and into areas of the US that provide the legislation we all want.

  147. Maedene Sappenfield is one of the nicest people I have ever had the pleasure of meeting. But I feel her religion affiliation may be a motivating factor behind her “opinion” on medical marijuana. She is a christian scientist. Although medical attention is aloud in this religion, prayer and denial of the diseases are often the recommended route in healing. Studies have shown higher mortality rates among Christian Scientists than those using conventional medicine, there are cases of individuals who have died following their choice of Christian Science care over medical treatment (my mother being one of them.) I’m not here to start a debate on whether this religion is right or wrong, but in this particular case I feel ‘someones’ opinion is highly influenced by it.

  148. Maybe it is time to begin ousting members of the politariate who are so blind as not be able to read scientific data in support of medical marijuana use. Just like was done to the Supreme Court justices in Iowa.
    “We the people”… not… “we the sheeple”… lead by megalmanical power freaks”.
    This “we are too busy” attitude of the state of Iowa is BS!Board of Pharmacy passed the buck off thinking they wouldn’t have to respond…BUT then it was determined THEY have the authority, THEY changed their tune again >>> time for them to go!! Sucking off the tax payers and refusing to act in behalf of the majority of Iowans…
    The state could generate millions in tax revenue and save law enforcement millions in victimless crime enforcement. The prisons could be used to house violent criminals.
    So good ole boys, what is your justification to NOT backing the majority of Iowa citizens wants?

  149. It is typical government as usual, the pharamacy board said they didn’t have the authority or they would, they it was found out they did have the authority and refused “we need more time”. GIVE IT UP!!
    Would you rather have your kids smoking K-2 or some other BS that WILL kill them or marijuanam which has NEVEr been known in history to cause a death or overdose!!
    This governement is out of control and is in violation of the United States Constitution contract. It is illegal to make a right into a priviledge or make something illegal that is a right; and it is illegal to require a license for something that is a right. These are all cases which have been decided in favor of the citizens “we the people” by the United States Supreme court..so what’s so hard people? WE HAVE RIGHTS guarenteed by the UNITED STATES CONSTITUTION contract… STAND UP FOR THEM OR LOOSE THEM..
