Emery Prosecutor: Legalize Marijuana Now

I don’t smoke pot. And I pretty much think people who do are idiots.

This certainly includes Marc Emery, the self-styled “Prince of Pot” from Canada whom I indicted in 2005 for peddling marijuana seeds to every man, woman and child with an envelope and a stamp. Emery recently pleaded guilty and will be sentenced this month in Seattle, where he faces five years in federal prison. If changing U.S. marijuana policy was ever Emery’s goal, the best that can be said is that he took the wrong path.

As Emery’s prosecutor and a former federal law-enforcement official, however, I’m not afraid to say out loud what most of my former colleagues know is true: Our marijuana policy is dangerous and wrong and should be changed through the legislative process to better protect the public safety.

  2. Medical marihuana is not a farce or a scapegoat. This drug has been proven to cure cancer and slow progressive neurological diseases like parkinson, MS, and SCA among other neurodegenerative disease’s. It IS A VIABLE MEDICINE. And until everyone is educated about this plants true use in our society you are correct we will fail as a Country.

  3. Justin curious how much tax $$$ is it going to cost to support Marc Emery in jail? I bet there goes all my tax earnings I make to not even support a % of him… seriously I am very curious.

    I really can’t believe our government is wasting so much time, energy, and tax $$$ to do this to a harmless man.
    I mean 5 years!!!! come on!!! Rapist get shorter terms than that, much more permanently damaging and sick and twisted offenses get a lesser jail sentence?

    I wish the punishment for a crime would literally be equal to the crime itself, because if that was the case, Marc Emery should deserve a bong hit from every plant that grew from his seeds!

    Amazing how a simple flower could all of a sudden be a demon after over 8,000 years of being enjoyed and loved once the time of racist and extremely biast politicians came into office in the 1930’s!!!!

    In order to do this we would need to test any adult who wishes to purchase marijuana. Maybe a standard IQ test would suffice, but what would the cut-off score be? Would anyone who scores average or above be denied the right to purchase and use? And what if, after using, a low IQ person scores better on the test? Would they then be denied any further purchase of marijuana because they’re now too smart?

    You address some of the issues well and apparently your cognitive dissonance prevents you from addressing ALL of the issues. You see, what another person does with their own body, horrible laws notwithstanding, is ALWAYS their business.

    When we use government force and limit peaceful people from owning themselves, we are promoting what? The real issue isn’t cannabis, it’s whether all people have the natural right to control their OWN bodies.

  6. Why is it that these people who work in law enforcement are willing to say it should be legal. But in the courtroom they wont stand up (using their constitutional right) and refuse to prosecute someone because the law is unjust. It is our responsibility to tell the government what laws we want. I know we have all been screaming for a change for years, but the voice of the people falls on deaf ears. What would really create a change is if jurors, judges and lawyers began refusing to prosecute non violent offenders even though the misguided law says they should go to jail.

    It is sad to know that the person responsible for putting Marc Emery in jail couldve personally taken a step towards what he believes is right by refusing to send an innocent man to jail

  7. as i keep saying: even assuming everything the media says is true (like this guy does) you don’t have any chance of converting potsmokers into wholesome, healthy, safe-driving, puritan suburbanites by sending them to jail and relegating them into a situation in which they can never earn above minimum wage again.

  9. I really like how McKay talks out both sides of his mouth…a typical politician.

    He makes a stand for legalizing, and is condescending to those who partake of it. He uses completely outdated and false examples of the “dangers” of smoking cannabis.

    Personally, I was offended by Mr. McKay’s tone but am encouraged by his message. What some of these idiots in office can’t fathom is that there are many of us who would simply GROW our own weed if we could and not be sent to jail…risking our homes and personal property isn’t something we feel comfortable with. Grow a dozen plants and they tag you as a “distributor” and seize all your assets. The risk is too great until it is decriminalized.

    Mr. McKay needs to do some follow-up research on the subject before he speaks publicly about it…those of us who KNOW about cannabis could make him look really stupid in a public forum. And if he intends to run for office, he’ll be exposed to us to do just that.

    Keep up the pressure NORML…I was just reflecting on when I stopped by your table @ Wright State 30+ years ago and got literature. I remember thinking back then that I MIGHT see it in my lifetime become legal…and we are getting oh so close.

  12. The argument against Marijuana is a ridiculous one. We all know, if we care to investigate it, that pot has many uses in a therapeutic way. We all know that there are chemical substances sanctioned by the medical establishment that have far more harmful side effects and less therapeutic value. Do the research for yourself. It is time we stopped messing around with this stupid war on drugs and started looking at what is needed to benefit mankind. Get your head out of your butt and you may see sunshine.

    The following quote is upsetting for me: “While I suspect nothing good can come to anyone from the chronic ingestion of marijuana smoke, its addictive quality and health risk pale in comparison with other banned drugs such as heroin, cocaine or meth. Informed adult choice, albeit a bad one, may well be preferable to the legal and policy meltdown we have long been suffering over marijuana.”

    This man is by a college professor, a man responsible for teaching our children! He should be fired from his job for lying. Lawyers should not lie and he is setting a very bad example for his students. It’s a well know fact that, compared to coffee, Marijuana is not addictive and eating it has zero health risks and some health benefits. HE COMPARES POT TO HERION!!! He should have compared it to coffee.

  14. I fully enjoyed reading this article until I came across Mr. McKay’s third point. “We should limit pot’s content of the active ingredient THC…”

    Throughout the article, and as expected, cannabis is compared to alcohol. While certain limitations are placed on alcohol ‘proof’, most of those restrictions are placed onto the product by the makers themselves. Whereas there are certain governmental limits such as serving 3.2% beer. However consumers have the choice to puchase alcohol ranging from nearly no alcohol content up thru and including grain alcohol. Society has been educated, and society is given the choice of what they would like to consume, regarding alcohol.

    Limiting THC content is a step in the wrong direction. Expensive tests and genetically altered cannabis would likely lead to a more expensive product prone to “additives” that have plagued the tobacco industry for years. Limiting THC is not necessary. Consumers should have the ability to limit their intake much the same as if a person was choosing grain alcohol or 3.2% beer. Educate society, and let them decide.

    While I applaud Mr. McKay’s open-minded approach to end the prohibition laws that he once enforced with passion, his formula still violates the liberties of a free society. Not a “swing-and-a-miss”, but closer to a foul ball. Keep swinging Mr. McKay, at least you’re in the ball park.

    I don’t drink alcoholic beverages and i don’t take all the prescription medications i had to as an alcoholic to keep my blood pressure down & to reduce the ” fat ” in my blood .I pretty much think people that take these drugs are idiots when Marijuana is a safer & healthier alternative to the deadly drugs that you undoubtably use . We are killing & destroying peoples lives with prohibition & misinformed people like you who believe the rubbish ( lies & more ) spewed out of the mouths by those who profit by prohibition needs to change .     Pot prohibition fills the pockets of “Mexican and other international drug cartels and gangs,” even though marijuana is nowhere nearly as harmful to users as other legal drugs.

    The policy is wrong, the law has failed, the public is endangered, no one in law enforcement is talking about it and precious few policymakers will honestly face the soft-on-crime sound bite in their next elections.

    It is a rhetorical question, of course, and McKay has answers: Recognize that the real public safety danger to Americans is not from marijuana but from prohibition, build policy on “sound science, not myth,” and… drum roll please… “We should give serious consideration to heavy regulation and taxation of the marijuana industry (an industry that is very real and dangerously underground). We should limit & regulate its sale to those want it and maintain criminal penalties for sales, possession or use by minors, drivers and boaters.”

    Not to worry, though, McKay assures his erstwhile partners in the prohibition racket. There will be years to come of extirpating criminality from the former black market, and that means job security: “DEA and its law-enforcement partners must therefore remain well equipped and staffed to accomplish this task: to protect our families from truly dangerous drugs and to drive drug cartels, gangs and dope dealers from our society.”

    Still, a remarkably candid confession from a man who made a living prosecuting marijuana offenders. Too bad he didn’t find himself on the road to Damascus when he still had the prosecutors’ powers.

  19. He makes some very good points, yet generalizes way too much. Emery has sparked the fire of justice in many people and will always be remembered as a advocate of freedom. Also, he did not coin the phrase “prince of pot”; a news station named him such and he used the term somewhat jokingly.

  23. While this is clearly outside the usual aesthetics of a pro-pot motif, it would be an outrage to not see this as a promising sign of marijuana progress. The lack homogeneity inside the marijuana debate shows just how diversely legalization and regulation are needed. It should be legal because it’s safe. It should be legal because it’s dangerous. It should be legal is the central aggregation to which anyone looking forward to that glorious dawn when we can leave this all behind should welcome with open arms.

  24. As an addendum we were able to see a profound effect on my wife’s health after many years of abuse of pharmaceuticals sanctioned and forced upon her by a dysfunctional establishment. We were able to save her life with Marijuana use as she came down harsh from 18.5 years of pharmaceutical use after a misdiagnosis. To say Marijuana is harmful is to ignore the truth.

  32. We’re going to see loads of career politicians jumping on the ‘legalization bandwagon’ in the coming months, due to their already poor standing with most of their constituents. The simple fact that McKay calls us ‘idiots’ and then cites the nonexistant ‘addiction’ caused by cannabis goes to show how he truly feels about the situation at hand.

    Yet I wonder what his views on alcohol in this country are, considering it has been PROVEN to be highly addictive, mind altering and dangerous in the wrong hands. I can guarantee that McKay goes home at the end of a long day and kicks back a few beers or a few shots of his favorite hard liquor.. Guess we can turn around and call him an idiot when he ends up with dead and dying organs due to prolonged alcohol abuse!

    To be completely honest, this seems like a ploy in order to continue to spread misinformation and a sad attempt at fear mongering. Next thing we know is that more government officials are going to scream ‘legalize it!’ and then a decade down the road are going to point at falsified figures and trumped up charges when they begin to bust people for DUI that end up having a bit of cannabis in their vehicle.

    It’s time for these people to realize that no matter what they say, they’re never going to change people’s personal opinions on cannabis and they need to get out and stay out of our business.

    Lets just hope that prop 19 ends up doing what everyone says it will do — then we’ll be able to see the sweeping reforms that we have all be waiting on for such a long time.

  34. i guess in hearing the state’s real reasons for wanting to prosecute people for marijuana use from those who stand to profit off their incarceration, that even a lawyer feels a little guilty for telling all these lies.

    Honestly I am a little shocked that someone so immersed in the other side’s propaganda can even speak of decriminalization, but again I’m guessing he was exposed to the real reasons (money), and simply trusted in the law when experiencing the peak moments of disillusionment.

    I suppose having some basic human decency is better than having none at all, but I would be careful if I were him: there is a lot more guilt to feel over this that he can possibly imagine. The injustice of getting paid to decide the fate of so many people for doing something that is simply none of your business is overwhelming even for me, who doesn’t participate in it: the effect of this guilt on someone who is actually responsible for it is beyond my comprehension.

    Short of him being personally responsible for its nation-wide legalization, and full pardons for all who have been charged, I don’t see him being capable of coping with the full scope of guilt he could feel from the part he has played in prohibition.

Marc Emery’s arrest actually had a positive effect on the legalization movement, to me: because it told me that the federal government considers it to be enough of a possibility to take action against it. Had they done nothing, I would still be thinking that the legalization movement isn’t considered a threat and that minimal attention is paid to it.

    I have come to this conclusion after smoking pot. It’s not that weed makes you more depressed; it is the kind of weed you are smoking. Some weed makes me cry, especially white widow. I changed to King Kush and I am all better. I have suffered from Depression for 29 years. I was diagnosed with clinical depression and anxiety. I take no pills anymore for it. I control it with pot. There are certain strains I have to stay away from.

Your posts called him a prosecutor when the fact is he’s a former prosecutor and currently a college law professor (from the newspaper post). Of the 43 post I read (excluding my own, #15), only 1 other called him a teacher. He is teaching our kids lies and his students become prosecutors for the drug war.

    If anyone has children attending Seattle University, complain. College professors should not sprout lies, especially in their field.

    The U.S. has no money for domestic programs but spends $100B yearly on marijuana prohibition. Make prohibition an issue, not Crime. Marijuana Prohibition is a crime against humanity. It affect our planet. Tell anyone that any politician that supports Prohibition is pro-crime.

    I will be voting 3rd party in November as both major candidates in my area support prohibition. Imagine IF 20 million pot smokers voted 3rd party this November.

  39. I weatched on TV last night ” JAIL ” for an hour here on the West Coast . It was filmed in the Las Vesgas Jail . Out of the approxaimately 12 bookings i saw eleven were Alcohol related . Ten out of eleven were , combative , non cooperative ,combative ,foul mouthed , violent & non compliant with the Officers . The other one was there because he killed ( manslaughter ) someone while driving drunk .I said 11 out of 12 were Alcohol related . So what was the 12th one in jail for ? Answer ;.Possession of Marijuana . He was 100% cooperative with being booked , did not raise his voice or shout obscenities at the Police Officers like all the drunks did .He was quiet ,compliant & non combative, nor did i hear any obscenities flow from his mouth directed toward the Officers .

  45. It all sounded like a prohibition compromise from those who never tried marijuana. There were a few cheap shots and some propaganda in that article accusing pot legalizers in giving false information on the safety of marijuana and its health benefits.

    Many anti-marijuana police, politicians, and prohibitionist really do know the truth about marijuana but that is not going to stop them from keeping it illegal.

    When the late former President Nixon first introduce the “Control Substance Act of 1970”, the majority of the people knew that it was all a joke because of the listing marijuana being dangerous as heroin. Then came President Ronald Reagan who made it to a “Declaration of War on Drugs”. Still nobody took it serious until 1991, when police dressed up in military commandos outfits and ski mask and carrying automatic rifles as standard procedure. Everything changed for the worse. Tougher penalties and more anti-marijuana laws leads to more criminals, and more prisons.
    America becomes a Drug War Zone all because of marijuana being placed as Schedule I by Nixon’s hatred towards college “Anti-Viet Nam WAR” hippies.

    Please Legalize Proposition 19 and stop this madness.

If John McKay is truly being honest and sincere about what he now claims to believe, he should do everything in his power to right the terrible wrong that is happening at this very moment to Marc Emery. Marc is obviously a political prisoner that people like McKay wanted to persecute and then use as a shining example of what happens to people who dare defy the law – regardless of whether or not the law is a good law… If he chooses to do nothing, then I’m not sure he is worthy of anyone’s respect.

    Mr McKay’s OP-ED piece is not directed to this audience of the herb friendly. Please open your mind, he is writing to the majority who don’t support cannabis, the folks who see us as hippie potheads etc. When you see that perspective you can see how brilliant his opinion is stated and how he is a true friend to our side. He acknowledges their arguments from the beginning and neutraizies them point by point as exemplified by the brilliant opening, “I don’t smoke pot And I pretty much think people who do are idiots.” John is skillfully channeling the everyman who does think pot smokers are idiots. Next bold statement, ” Our marijuana policy is dangerous and wrong and should be changed through the legislative process to better protect the public safety.” This gives the everyman a means to change their mind, after all if a US Prosecutor who thinks pot smokers are idiots wants change then so can I.
    Wearing rasta colors and playing Cypress Hill loud do nothing to advance our cause, that’s only “preaching to the choir” We need to be aware of who we need to enlighten, the folks who don’t attend hempfests.

    An open/honest discussion as to the “wisdom” of why cannabis was categorized as “useless” should take place. Facts need only apply.   59. I actually like this article. Despite the false statements here and there, I think a person who is not empathetic to cannabis users might keep reading if they feel the writer is on their side, and not some avid cannabis proponent.

    This article was written by someone who is skeptical of cannabis use, and can more easily reach other skeptics who are not as friendly as he, and who might hold some of these mistaken views. To me, it says, “despite these stupid ideas, legalize!”

    The truth is truth no matter who speaks it. So someone who makes dollars doing something wrong realizes one of his job duties makes him cringe a little, lose a little sleep. But hey it’s a living.

    A drunk is not wrong when he says alcohol abuse is harmful. When a cop/prosecutor says unjust Cannabis scheduling causes misery that good intentions cannot justify, they are right. This isn’t a novelty. The truth is the truth. Honest people have been saying the same thing for years. These don’t have a personal interest or goal of in wringing people through the costly and overburdened legal system.

    Prisons are meant to hold the violent or antisocial or those who lack conscience. Imprisoning cannabis users/sellers is exploitation of the criminal justice system to make revenue for unethical privatized prison administrators.

    I’ll infer that McKay has realized that Cannabis prohibition is going to end. But he is not saying it is going to end because it is unjust to its core and the prohibiton itself is a crime.
