Obama To Rolling Stone: We’re Not Going To Legalize Weed Anytime Soon

President Obama clarified his position on medical marijuana in an interview with Rolling Stone, telling publisher Jann Wenner that he can’t “nullify congressional law.”

“What I specifically said was that we were not going to prioritize prosecutions of persons who are using medical marijuana. I never made a commitment that somehow we were going to give carte blanche to large-scale producers and operators of marijuana – and the reason is, because it’s against federal law. I can’t nullify congressional law,” Obama said.

“I can’t ask the Justice Department to say, ‘Ignore completely a federal law that’s on the books.’ What I can say is, ‘Use your prosecutorial discretion and properly prioritize your resources to go after things that are really doing folks damage.’ As a consequence, there haven’t been prosecutions of users of marijuana for medical purposes,” Obama said.

Obama also said in a late night TV appearance Tuesday on Late Night with Jimmy Fallon, that he didn’t expect Congress to change that law: “We’re not going to be legalizing weed … anytime soon.”

  1. Weed is already legal. Just because the corrupt politicians say a plant is illegal, it doesn’t make it so. They can pass a law to roast children on the whitehouse front lawn, but that does not make it legal. There is no constitutional amendment banning weed, as there was needed for alcohol prohibition.

  24. Concerning the above mentioned statement that the government can’t make something illegal absent a constitutional amendment; you are wrong. In fact, the government can make a lot of things illegal without a constitutional amendment; i.e. there is not amendment saying heroin is illegal, but it is.

    All that said, it is not up to the federal government to legalize, the only thing congress & Obama can do is to rid of federal law making it illegal. Once that it gone, it then is in the individual states hands.

    Example:
    While some think if the health care law is found unconstitutional, that means that it cannot be implemented; and that is far from the truth. Even if deemed unconstitutional for the federal government to implement, states can, and have (see Mass), implement a program requiring all residents of the state to purchase health care.

    Marijuana is similar. It is up to the states to make legal; once states do it, at that point the federal government will rid of their law.

    The driving force for the legalization of weed will never be the federal government, it is up to the states. As more and more states make it legal for medical purposes, and hopefully soon for general public use, the federal government will eventually follow.

    STOP WASTING EFFORTS trying to change the federal law. Concentrate on your state, that is the only hope for full legalization

Republicans control Congress because they are the majority, so therefore— marijuana will not be legalized any time soon. The President is just telling the truth. That’s the ball game folks. Another avenue is to promote medical marijuana and get approval of the FDA. Again, as you know, this is a Republican strong hold. So once again, can’t get anything done with that avenue because the Republicans will not allow the research to take place by the FDA. Again, —nothing the President can do about the Republicans blocking research of medical marijuana from the FDA. A bill came forward to allow research of medical marijuana by the FDA just a short time back, and who shot it down before it could be researched? Congress itself probably won’t legalize weed anytime soon…the thing is that the best case scenario I could see happening within a relatively short (I’m talking maybe ~8-20 years) would be a netherlands-type situation, where on the books weed may be ‘illegal’ since congress would, as usual, just kind of sweep the issue under the rug, kind of like how most uncomfortable issues work in national politics, but states would recognize it as legal and there would be little support for continued prohibition, and with no backing and minimal cooperation it would be difficult for the government to continue actively pursuing current cannabis laws.

    That, of course, highlights another issue that I commonly think about; the disconnect between politicians and constituents. The fact that a large portion of the general public is now beginning to go ‘meh, weed should just be legal already’, while congress is saying ‘hell no’ is disconcerting, but then again I doubt I need to say any of this because anyone who’s even in the least bit familiar with this issue realizes full well the extent to which governing bodies often ignore the actual will of U.S. citizens.

    It’s a bit of a grey area, but congress is able to do things to implement treaties that the constitution doesn’t explicitly grant them the power to do. Actually in this one and only this one instance I do agree with obama, the Federal Government does not have the authority to Nullify Congressional Laws, but each of the individual States do have the authority to Nullify Federal Laws using the Tenth Amendment to the Constitution. Over 16 states have literally Nullified the Federal Prohibition of Marijuana, but they actually need to go one step further, the State Legislatures need to pass a State Law that makes it a State crime for Federal Agents if they attempt to come into a State that has passed Medical marijuana laws and raid either medical marijuana dispensaries, or private homes of marijuana users.
    The State Legislatures haven’t done this as of yet, but I believe the time is coming soon when enough marijuana users complain to their State Legislatures that they need protection from the Federal Agents raiding their homes or dispensaries and charging these people who are harming nobody.
    Remember, in order for a crime to have been committed two things need to occur,
    1.Damage or harm to somebody.
    2.Property damage has to occur.
    If neither of these two conditions have been met then no crime has occured.
    That also means that if a law is created that doesn’t have these two provisions in it, then the law itself is Null and Void of any legality. With no victim, there is no crime.

In fact the *only* branch of government that can Constitutionally be ordered to do anything at all are those departments and agencies within the President’s own Executive Department, even though Obama uses this order to dictate things wholly outside of the Executive Branch constantly in violation of the United States Constitution.

  76. I agree that you can’t blame the Republicans for this mess. The Democrats are just as bad (and I still am one, for now). We have Obama, Biden, Feinstein, etc. who are all rabid prohibitionists if you judge them by their actions. A California Democrat introduced legislation to consider anyone caught driving with any level of THC metabolites in their system to be driving under the influence. California has a Democratically controlled legislature and a Democratic governor, yet medical marijuana patients have no employment protection. They can be fired for testing positive for the medicine their doctor recommends they use.
    What I don’t get is how Democratic politicians get away with this considering the latest Gallup poll showing that Democrats and “liberals” clearly support legalization. I think Republicans should jump on this as a state’s rights issue. They like to call themselves the party of small government and personal liberty. If as a party (not just Paul), they truly embraced their own philosophy, I would consider changing my affiliation. But, of course, they don’t have the guts. Romney will continue to come out in favor of the same draconian policies that Obama supports. I’m afraid that sanity on this issue is still a ways off.

  82. When will you ppl realize its US against THEM? Republicans arent going to fix it, nor are Democrats, or liberals or conservatives or any flavor above. Its all divide and conquer and this thread is proof of it. We ALL agree we would like some legalization of marijuana yet we continue to disagree as to who did what and what someone has done or not done to make it happen.. So, divided we FALL. Both parties have been in office at one point or another and neither has done diddly to advance what WE THE PEOPLE have clearly stated and the STATS show that even those who are not advocates, agree it makes NO sense to put someone in jail at an average cost of $40-60grand a YEAR for simple possesion or even dealing in small amounts. This being the case, we have to take from each lemon (government official) we squeeze what we can and continue to take babysteps forward if need be. I also am dissappointed in Obama and the ONLY reason I voted for him was because I thought, just maybe this black man will do something different then the many wealthy white men ahead of him did and make a stand. Well, I didnt count on him being so concieted and thinking he was the golden child and could make both parties play nice when he had the house and senate in his hands. Now that he doesnt, NOTHING is getting done, accept they are still collecting their checks, still getting cost of living increases and low and behold even were able to be friends long enough to pass a law that THIER kids do not have to pay back their student loans even! Wake up and smell the coffee ppl. Get out and VOTE for those who have the courage to say, ON THE RECORD that they oppose criminal consequences and ON THE RECORD that they dont actually agree with it, but, jailing ppl for it makes no COMMOM SENSE. When you sit here and birate ONE GUY and think he is the cause of all this and not the system thats broke (on purpose) then you show your ignorance and they have won.. again. BTW. I am long term pain management, am prescribed 120mg of methadone/day and 40mg of Hydrocodone and yet just recently my doctor who IS not against my self medicating with marijuana as it hasnt proven to be a problem in the 7yrs he has treated me, was just sent a letter by my comp carrier asking that I be urine tested. Since I have always been honest with MY doc, I told him it was a setup and he was naive and told me they were just looking for coke or heroin. I agreed to take it for HIM and that I would test pos for MJ. Well, I did, and next thing he knows, the Ins Carrier is pressing him on what he plans to do about my ILLEGAL use and poppin off article such and such of the National Pain Management guidelines and in short threatening his license if he doesnt take appropriate action. I am on day 14 of being “clean” so in another 30 days I can give him a “clean” test that shows ONLY my current hard core prescribed drugs. So, this while thing is near and dear to my heart. I have 2 kids in college another teen on the honor roll, been married for coming up on 30 yrs. Refused full disability and retrained for computers so I could show my kids I didnt need a hand out until I could REALLY no longer make a living. I do work for police depts, banks and lawfirms and have many good clients who work with me and my bad days.. Yet here I am, having to take a month off because without my little bit of smoke to help with nausia and deep nerve pain, I cant get it together enough to do much of anything.. so, please, if you can offer any info or GOOD advise, I would appreciate it. The only reason the Ins carrier did this, and by the way this is the second time, the first they were successful in getting me expelled from a diff doctor I was otherwise good with, is so they dont have to pay the small bill I cost them each month. I dont do a ton of doctors. Just the one I need to carry on with life, pain management. Once again.. its US vs THEM.. and anything other then that is but a diversion of whats important and does more harm to the cause then good. Keep it focused ppl and have a great day!

  83. While Congress does need to get involved to “free the plant” and it’s users legislatively, the combined DEA / IRS raids that have occurred under Obama can be changed administratively. All Obama needs to do is to command, by Executive Order, that the DHHS & DEA follow 2 separate DEA Administrative Law judicial decisions that would shift cannabis (the plant) into the same or lessor CSA Schedule classification that Big Pharma has been granted for their synthetic THC “products” to provide relief for medical marijuana patients.

    But for Obama to do that, he would have to be willing to surrender a close and mutually beneficial relationship with the Medical Industrial Complex and the Prison Industrial Complex. He would also be signaling to the Bankster Cabal that their free ride with laundering $100’s Billions of drug cartel profits per year. Obama is an authoritarian who is always trying to grab more Executive power, not yield any of that power back to We the People.

    Obama needs to go — either by impeachment or by defeat at the ballot box. So does every Congressman and Congresswoman, Democrat or Republican, that continues to support cannabis prohibition AND the police state. They have all violated their oaths of office, willfully and repeatedly.

  85. I think we all know that President Obama can’t, by himself, make marijuana legal. He could use his power to get the ball rolling in the correct direction. I am disgusted by his stance on this subject and feel betrayed; as I’m sure many millions of us that voted for him feel.

    It is truly sad that the Republican party is just as bad or worse regarding ending this idiotic prohibition.

    Amen.. I couldnt have said it better. THAT is where the focus needs to be placed and in a unified way. Ousting JUST Obama wont do a thing. Romney will be no better and may not even concede the VERY little Obama has been FORCED to. The problem goes further then party lines and even beyond marijuana reform for that matter.     I take this as admission the supreme court *does see the wisdom* of medical marijuana and just wanted to pretend they don’t have the authority to send the law back to congress and have them fix it now. Failing that, declare it null and void.

I think there just MAYBE a chance that after the election is over, he will ease up on the federal crackdowns or maybe even use executive power to move it down to schedule II. Even if he doesn’t we really don’t have a choice, because what do you think Romney will do? According to him drug dealers are “Narco-Terrorists” and he may use the same rules for weed dealers and possibly users as he would for Al Qaeda and lock them up indefinitely without a trial.
