The beginning of the end…has begun.
Yesterday’s elections have forever changed the playing field regarding cannabis prohibition laws in America (and probably in large parts of the world too).
The citizens of Colorado, Washington and Massachusetts delivered game changing victories last night for the nearly fifty year-old cannabis law reform Movement. Massachusetts becomes the eighteenth state to pass legal protections for qualified medical patients who’ve cannabis recommended to them by a physician. Colorado and Washington become the first places in the world, ever, where citizens have cast votes to reject cannabis prohibition, and replace the failed public policy with alternatives like tax-n-regulate models (similar to the control and taxation models widely accepted for alcohol and tobacco product use by adults).
NORML’s board of directors, staff, chapter network and members congratulate the state-based organizers who planned and worked hard to qualify and pass these important voter initiatives, and we thank the voters of these states for helping to propel the nation to the eventual—if not soon coming—end to cannabis prohibition.
Will there continue to be fits and starts, federal government incursion into state sovereignty and obstinate politicians?
Surely.
However, the die for major cannabis law reforms is now cast.
NORML will continue to be the central hub of information about all things cannabis and yesterday’s victories ensure that 2013 is going to be another landmark year for needed cannabis law reforms.

Firstly thanks to everyone who voted, organised and campaigned (even if you initiative did not win). I live in the UK and all this activity and now success has given NORML UK a real boost and I will do all I can to help replicate your success in my country
On the subject of what the next move will be from your glorious returning president or the federal government – How can Obama suddenly turn around and say you can’t do that because … or flout state law with federal law enforcement when he has kept silent while the initiatives were added to the ballot, campaigning took place etc. If he now tries something that goes against the votes in Washington or Colorado it will look like he has tricked voters in those states or just kept his mouth shut to win an election (which he probably did). Even if it is legal to do whatever they try then it will still look bad – accusations such as misleading the electorate or lying will be brought against him. If Obama says he did not know that things would turn out this way then he looks like an incompetent fool. I think he has backed himself into a corner and the only way is to let it run (at least for a few months). As soon as those raids start Obama will look very bad

concerning legalization, Obama once said that was “a first-term question for a second-term president.” I wonder if we’ll see the real Obama when it comes to the question of legalization now that he’s got his second term.

I feel very relieved and happy. It is the medicine I need to live through the next four years of Obama administration. Texas may become the first Republican State to legalize cannabis. I hope that day will come soon.
It’s the very kind of peaceful revolution that this country is supposed to be all about. Will the Feds take the hint or bring in the troops and inflict more violence on it’s own citizens to repress use of this abundantly useful, non-toxic plant?

I shed tears for the many people that have suffered at the hand of the governments plan to keep this natural plant illegal, one because it brought people from different walks of life together peacefully,and two, it has kept their private prisons filled to the proverbial BRIM!! I also look forward to the MANY, MANY talented and smart youth that will be able to live and grow and not be labeled or have their life smudged by a drug charge. Ah, to be on the outside looking in. Just gotta wait until the Appalachian neck of the woods puts 2 and 2 together. BTW, here in Tennessee that would be the perfect outdoor growing environment and the big fat piggy bank that is the cannabis industry.
I don’t see any realistic way for the Feds to stop this? It was easy for them to go after the medical in CA, as it was so regulated. But please give an opinion as to what if anything they can do, as I just don’t trust them.

I think that President Obama is going to allow Colorado and Washington’s citizens to operate in accordance with their state law. The United States is becoming increasingly liberal in its social stances, and he recognizes that this is the beginning of a larger movement. Now that he does not have to worry about re-election, he can quietly support a marijuana movement that he has personally favored all along.
The main stream press couldn’t ignore it this time.

I’m optimistic. I think Obama will back off in him second term. He needed to secure reelection so he probably didn’t want to be seen as “soft” on drug laws but with no need to be reelected I anticipate a change in attitude. Kudos to Colorado and Washington.. the end of prohibition is near

Now it’s imperative to take this amazing start, and turn it into an unstoppable force by legalizing in California. The concern now is that the feds will crush WA and CO to “set an example”, knowing that the political risks are relatively small.
But if you add the size and money of CA, the might of that public voting block would force the feds to back down.
What a historical year for this movement!
However, I must observe a broad misunderstanding within the media regarding whether the CO and WA initiatives conflict with federal law. I think that the CO and WA initiatives do not conflict, yet media continues to hype this “showdown with the feds” scenario.
Specifically, federal power cannot constitutionally require a state to carry a civil or criminal penalty: A federal preemption issue only resides where a state attempts to regulate within a pre-existing federal scheme. While the preemption doctrine may pose problems with a state’s taxation and regulation attempts, it in no way affects a state’s ability to remove criminal and civil penalties for possession, cultivation, use, and probably INTRA-state sale of marijuana (if 1 ounce or less is at play).
A federal court would only be able to strike down the state initiatives if it found that the regulation and taxation schemes were unseverable from the remainder of an intiative. However, I presume that I-502 and A64 initiatives do have a severability clause, which would uphold parts of the initiatives not federally preempted (e.g. removal of criminal and civil penalty for under one ounce), while striking down the portions of the initiatives possibly preempted (state level regulation and taxation schemes).
In essence, the removal of civil and criminal penalty simply does away with state law and does not create a positive federal conflict. However, state regulation and taxation may create a positive federal conflict if these state activities are interpreted as active state government participation in marijuana in contravention of the Federal Controlled Substances Act.
In the end, and interestingly, CO and WA voters may have just passed laws that remove its criminal and civil penalties, while preventing the state government from regulating or taxing marijuana. Legalization supporters would be overjoyed with this result.
However, my above analysis is only theoretical. As a practical matter, I foresee the federal executive allowing the state to actively regulate and possibly tax marijuana anyway, just as the federal executive “turns its head” with the current medical marijuana dispensary scheme.
Eventually, federal law will need to catch up to reflect state reality, which I presume is the entire point anyway.

Your analysis is spot on. There is little the federal government can do except to scratch their heads regarding the decision of voters in CO and WA to end state criminal prosecutions for minor, adult cannabis offenses.]
Does anyone know of any organizations in the peoria illinois area. I feel illinois is very close to going the medical route however i have never seen any org. in the area to give a positive point of view so that everyone in this area of the state can come together and get this bill past finally. The last i checked our bill was still on hold after only losing by a handful of votes 2 years ago. God only knows our broke state could use the revenue.

Bring back the stamp! If weed is taxed properly,it could cover alot of our debts. Ex: charge 200.00 per stamp, per

As we’ve seen in CA, the federal government (through the US Attorneys) can and will go after local businesses that are engaged in MJ sales even when those sales are in compliance with state law.
Obama can instruct the DOJ to not do that, but he promised to take that position in 2008 and completely went back on it. The four US Attorneys in CA publicly stated THIS YEAR that they would be going after medical marijuana dispensaries; and then shut down hundreds.
So CO and WA growers and stores might not need to worry about local and state police since there will be no state laws against MJ, but they’ll still have to worry about federal law enforcement. And even local PD “cooperating” with feds in carrying out busts, etc.
This is a victory. But the fight is by no means over.
So proud to wear my NORML t-shirt today. Congrats to all the hard working organizers in WA and CO for making it happen. We knew it would take an energized grassroots effort because there is no corporate lobby benefiting from legaization.
@ j rod….I agree. If it can be grown locally and the supply chain kept short, seems like there should be room for modest profits, a resonable tax, and still sold at a kind price. What a great day it is! Alcohol prohibition ended with states defying the federal government and voting to allow alcohol sales. This is the largest step towards freedom our country has made in a long time. Now, if I could get some help here in the deep south!! Alabama needs be more NORML!

This is indeed a historic day :-). I was overjoyed to hear about this amazing first step. I have a feeling we are going to see nationwide legalization by the end of Obama’s second term. Fittingly, two days ago I found for the first time a recording of ALAN WATTS (the greatest existential spiritual philosopher of the 20th century) talking about the marijuana laws, and how they stem from the government taking over the role of the church (making laws against “sins” as opposed to actual crimes). First thing I’d be doing if I were in either state is enjoy a joint on the porch with my coffee, openly and freely, but not an “in your face” kinda’ way. There will likely be a lot of scrutiny. Stay the course, keep it civil and may the force be with you.

Let’s be real..the growing of any plant in your yard..basil, oregano, chives, rue, lemon-balm, parsley, hops, wine-grapes or cannabis….is a joy..the genome project has shown that plants have the most sophisticated genetic structure of any organisms on the planet..let us respect these organisms and allow our relationship with them to remain what nature intended..you and nature, together, figuring eachother out…we have so much to learn..
I would recommend that NORML create a plan on how to address the pending challenge the Feds will bring to nullify these laws. I’m seriously concerned about this.

The federal prohibitionists should realize they can’t stop more states from jumping on board. They’ve tried, but it is not working. Each state that becomes an MMJ state, moves the nation a notch along the cannabis continuum toward the legalization end. Each state that legalizes adult recreational use further nudges the nation along.
It’s time to stop wasting money, and start making it–jobs, tax revenues, cash flow stream.

i think the next step is to organize a push for a Constitutional Amendment to end the federal prohibition of cannabis, just as was done for alcohol with the 21st Amendment.

If the Feds usurp the will of the people plant ONE BILLION seeds on every square inch of public land in Washington DC AND fully implement jury nullification. Lastly mail a joint to each member of Congress each day until the Federal ban on Marijuana is repealed.
I was (still am pretty much) ignorant regarding the 18th amendment (prohibition) and the 21st amendment (repeal of 18th)… It looks like marijuana prohibition, as part of the CSA – Controlled Substances Act – isn’t part of the constitution. So does that make it easier to modify the situation? Changing a law rather than amending the constitution? Just wondering how hopeful to be about avoiding a tortuous state-by-state transition and just dealing with it at the fed level. Might require the momentum of four or five more states, but sure would be less tedious in the long run.
Great work Norml – I live in Canada and we simply follow the US when it comes to MJ rules and regs, so I find this a historical occasion, not only for the US, but eventually Canada.

I understand why President Obama would not make a move on it in his first term: it would be political suicide. But who’s to say in his second term, when he doesn’t have much to lose, and the nation has a lot to gain, such as a deficit reduction, reformed immigration policies, further healthcare overhaul (including pharmaceuticals), among other things, that he may in fact orchestrate some marijuana reform legislation. And with most people worried about the economy right now, and the Bush-era tax cuts set to expire soon, why not tax-and-regulate MJ? Makes sense to me!
I heard through relatives in Colorado that the Governor had this to say about the victory, “Don’t bust out the cheese puffs and Goldfish yet, we need to lead by example” or something to that affect. Thought it was forward thinking and smart.

If I was handed millions of dollars by those people and became president (most likely only because of them) I would probably have trouble outwardly accepting marijuana, also.

Our own President is proof that the war on drugs is wrong by being the one “who didn’t like to let a single bit of Pot smoke go to waste”. Using it, all the while working to better himself and the people he’d seen needing help. Then I don’t know what more can be done to prove Marijuana’s not the bad drug Big Pharma, the cartel’s and all those company’s that are making big money off “the war on drugs” would lead you to believe. All the lies they have perpetuated for years about it being bad for you, and “leads to a life of crime & harder drugs” are only to make big bucks off the system and the American people. If He wants to become the great president I know He can be, He’ll tell them to, “go to hell” now since he won’t need the campaign contributions anymore and be the one who had balls enough to legalize it the same as alcohol.
One thing I would like to know is how this is going to affect gun buying laws in either state. I currently live in CO and am moving back to WA soon. I am an avid gun enthusiast and in Colorado they ask on the paperwork if you are addicted to illegal drugs such as marijuana. Also in Colorado one can’t be in possession of a gun under the influence of intoxicants. But I’m glad that we have won two battles, 49 to go including federal abolishment of marijuana prohibition!

Life would be so much easier without it, but I absolutely refuse to just pop pills every day that are more harmful than any amount of weed I could possibly smoke. I will not take pills when this beautiful plant exists. I’m from MN, so no legal medical use, and I have loose connections to illegal weed, so I can’t toke often. Which is sad. If only society wasn’t a bunch of selfish fuck tards, maybe they’d realize what a pain prohibition is to everybody. God put this plant on Earth for a reason, let’s fight for it!

True Reform of Cannabis laws are upon us!!!
We have lived to see the start of Legalized Marijuana in the US and every single American from NORML on down, can say, We Did It! Thank You to Mason Tvert in Colorado and Vivian McPeak in Washington State both were integral people in helping to change minds and eventually the law, Wow! The voters in both states sent a very convincing message that it’s time has come, its over, I want my THC.

I agree that years from now history books will look closely back at this time as the end of the horrible mistake of mj prohibition, and they’ll try to figure out why the country repeated the errors of alcohol prohibition.
My local paper today in Illinois reported the arrest of 2 people for mj. It was a reminder of how often these senseless laws have completely ruined lives and wasted taxpayer money. Prohibition cannot end soon enough. You have all our support.
Way to go WA and CO!! Bravo! I never donated to Norml, but I did write the bloodsucking politicians a few times(always with a snobby reply). Keep up the rewarding, although tiring, work! To the affected agencies: How did THAT kick in the (fiscal) nuts feel? 😉

No matter what anyone says, you were at the helm of the eldest and most respected marinuana law reformation advocay group when the war broke. Could this have happened under someone else? Maybe. But it didnt. I’m not saying that you deserve the most accolades or credit for Colorado and Washington. What I am saying is that no other Dircetor of Norml will ever be able to say what you can.
My heartfelt thanks and congratulations also go out to those freedom fighters in Washington and Colorado who poured their sweat and determination into making this dream a reality.

Here’s one for ya,I have been a merchant mariner for 33 years,so because I have to be licensed through the fed there is no way I could ever smoke weed,So for my med condition doctors have had me on all kinds of meds instead of MJ.So check this out I am 49 not ready to retire but because of the meds I have been on I am being forced to go on Disability,,weed did the job just fine for years and after 911 they got so tight on security that you can’t even mask it anymore,,So yes I am out but every drunk is still leagal and and drinking on the job WHAT A CONTRY !!!!!
I remember being in Colorado when they voted to legalize. Was a glorious day. It’s about time people gave freedom and liberty a try.
There isn’t a true argument for why marijuana should be illegal. The arguments against it are based on speculation and opinions. Facts are facts. Legalizing marijuana would solve a large number of problems in our country right now.
Some day kids won’t have to worry about being imprisoned for such petty “crimes.”
